Dear Mike,
Pursuant to Chapter 2, Section 4,F. of the City of Boynton Beach Land Development
Regulations, we are applying for a Height Exception for four (4) feet, ten (10) inches as
depicted in the architectural elevation drawings forming part of our site plan being
submitted simultaneously to the City.
Each of the four proposed buildings are four (4) stories, which normally would not be
over forty-five (45) feet in height. However, to facilitate roof access and to
accommodate certain mechanical functions there are elements which exceed forty-five
(45) feet in height. These elements comprise 4.83% of the total roof area of each of
buildings #1, 2 & 3 and 4.24% of the total roof area of building #4.
The attached drawings prepared by The Martin Architectural Group show the required
height exception in detail.
Section 4.F.3 lists several standards which should be considered as part of the
application process. These standards, together with our responses are listed below:
(a) Whether the height exception will have an adverse effect on the
existing and proposed land use.
Answer: The requested height exception will not have an adverse effect
on the existing and proposed land uses since the proposed buildings are
only slightly higher than permitted by the Special High Density Residential
Zoning District which allows for a height of forty five (45) feet.
(b) Whether the height exception is necessary.
Answer: The requested height exception is necessary to hide the elevator
shafts and the stairwell.

(c) Whether the height exception will severely reduce light and air in
adjacent areas.
Answer: The requested height exception will not severely reduce light and
air in adjacent areas. The property is bordered by Federal Highway to the
west, the Intracoastal Waterway to the east, Manatee Bay Apartment
complex to the north and Yachtman's Cove, a single family home
development, to the south. The only impact would be to Yachtman's
Cove and any impact has been mitigated by appropriate building
setbacks.
(d) Whether the height exception will be a deterrent to the improvement
or development of adjacent property in accordance with existing
regulations.
Answer: The requested height exception will not be a deterrent for the
improvement or development of adjacent property, To the contrary, this
community will act as a catalyst for the redevelopment of other properties
in the adjacent area.
(e) Whether the height exception will adversely affect property values in
adjacent areas.
Answer: Not only will the height exception not adversely affect property
values in adjacent areas, it will serve to increase surrounding property
values.
(f) Whether the height exception will adversely affect living conditions
in the neighborhood.
Answer: The requested height exception will not adversely affect living
conditions in the neighborhood. The proposed buildings will provide for a
more aesthetically pleasing view and neighborhood appearance,
compatible with the surrounding area.
(g) Whether the height exception will constitute a grant of special
privilege to an individual owner as contrasted with the public
welfare.
Answer: The requested height exception will not constitute a grant of
special privilege, since without the requested height exception certain
architectural features which have been introduced to enhance the overall
appearance of the proposed buildings would not be possible. The height
exception affects only a very small percentage of the overall building
footprint and as previously stated is required to accommodate elevator
shafts and stairwells.
(h) Whether sufficient evidence has been presented to justify the need
for a height exception.
Answer: For the reasons set forth herein, sufficient evidence has been
presented to justify the need for the requested height exception for the
functional and architectural features of the project.
