Our concern was related to the lighting that would glare out over the water, such as the "security
light" that was previously installed on the old sea view dock, and illuminated all our back yards.

Please find attached the correspondence to satisfy conditions 1, 2 and 3 to the
Development Order for Seaview Park Club Minor Site Plan Modification for the Dock
Facilities. We have been in contact with INCA since February 6, 2006 in regards to the
Dock configuration. They have responded with positive feedback and seem to be
pleased with the design we presented to them. I have asked the Association to formally
respond in writing of their approval of our Dock design. I will forward this to you directly
upon receipt. I will also be speaking at the INCA Homeowners Association on June 12,
2006 to answer questions and/or concerns the residents may have concerning our
development and to give them an update on our progress.

Per our conversation today, we are seeking an extension to our site plan approval Development Order for
Seaview Park. As you can see from the attached letter to Mike Rumpf, we are making good progress on
our entitlements for Seaview but with the delays caused by the park eviction and subsequent lawsuit we
have yet to be issued any building permits by the City of Boynton.
We are asking for your support, both in terms of the Yachtman's Cove neighborhood and also from INCA
in expediting our request so that we may proceed as soon as possible to both CRA and to City
Commission. It would be greatly appreciated if you could provide written support for our continued
progress to Mike Rumpf.
I have also attached to this email our proposed dock arrangement for Seaview. We feel that this
proposed design keeps the dock facilities as far north as possible and would ask that you distribute copies
of the proposal amongst those folks (Buck, Stan, Harry etc.) with home we met last year to discuss the
dock concept. Please let me know if there are any concerns or comments on the design.

The City of Boynton Beach staff has reviewed the revisions to your plans for the above-mentioned
project. The following comments are being forwarded to you for your review and response:
1. As per Condition of Approval # 63, the applicant must contact the HOA known as
"INCA" five days prior to submitting for a minor modification to the site plan.
2. Within the same condition, you must contact the attorney representing the 16 clients
within Yachtsmans Cove and Coquina Cove subdivisions.
3. Provide copies ofthese communications to the Planning & Zoning Director.
Please submit the above in order continue the review of your request through the process. In the
event that you have already complied with #1 and #2 please forward copies of same in order to
satisfy #3.

63. As agreed upon by all parties, the additions of any dock facilities will be X
processed as a minor request for minor site plan modification. At least 5 days
prior to submittal to staff or the relevant permitting agencies, builder will
provide notification of the intended submittal to the HOA known as
"INCA" and to the attorney for the 16 clients of selected residents within the
Yachtmans Cove and Coquina Cove subdivisions, copying the P&Z Director,
and will if requested, provide copies of the plans to both INCA and the
attorney described above or a subsequently agreed upon representative.
64. As agreed upon by all parties, project lighting plan shall be as X
submitted to both adjacent residents and labeled P.1.a. Modifications to
said plan shall follow similar notification process as described in Conditions
#62 and #63.

My clients have authorized me to represent to you that based upon Lennar's presentation to
the June 12, 2006 INCA meeting about their Seaview Park Club project, they approve the new
dock plan with the boardwalk re-located on the north side of the dock and property only.
It is also my understanding that at the June 12, 2006 INCA meeting, there was discussion
about two (2) remaining issues: (1) dock lighting and (2) drainage.
With regard to the dock lighting issue, my clients are concerned that as of the June 12th
meeting they had not seen anything yet that shows how Lennar proposes to light the dock or
the boardwalk area. This is of concern to those clients who will have these lights
glaring over the water into their homes and back yards. It is my understanding that these
clients expressed their desire to Lennar's representatives for the lowest possible wattage
"downcast" lighting that will safely light the docks without glaring out over the water.
With regard to the drainage issue, it is my understanding that my clients further
expressed their concern to Lennar's representatives over sediment pollution and how the
two pipes will look sticking out into the bay.
It is my understanding that Lennar's representatives listened attentively to these
concerns at the June 12th meeting. It is my further understanding that Lennar's
representatives have also agreed to meet again with INCA representatives (including my
clients' representative, Harry Woodworth) to further discuss both of these concerns.
While neither the dock lighting or drainage issues are major issues that relate to my
clients' approval of the dock site plan, my clients remain pleased to know that the lines
of communication between themselves and their good neighbor Lennar remain open to discuss
these concerns.

Dear Mr. Breese:
The Seaview Park Club is respectfully submitting a Minor Site Plan Modification
request for the addition of a dock facility to the project Site Plan. Please find
enclosed with this letter 4 sets of revised Site Plan Drawings showing the
proposed new dock location and configuration. Also included is a check for $100
and an email from the US ACOE approving the dock and stating that the project
as proposed qualifies for the Nationwide Permit Number 28.
Our intention is to reconfigure an existing 8-slip marina, without expansion into
the waters of the U.S. or an increase in slips. A thorough observation of the
submerged areas within the project vicinity was conducted on August 31, 2005,
by Isminger and Stubbs Engineering, Inc. No sea grasses of any kind were
observed within the project footprint. Therefore no significant adverse
environmental impacts are anticipated, direct or indirect. We will be removing the
existing docks and building the new 8 slip dock as shown on the plans.

on in-water investigation on August 31, 2005, no Johnson's seagrass exists within the
project footprint. The project is not located within designated critical habitat for
Johnson's seagrass. The proposed work is not "likely to jeopardize the continued
existence" of the West Indian Manatee, because no increase in slips is proposed.
