Request for Height Exception
Dear Mike:
The building proposed with our recent applications complies with the 75 foot height limitation of
the MU-L zoning district except for the stair towers and elevator shafts. These features exceed the
maximum height by 5'-4". Therefore, we hereby request an exception of the height for those
structural and mechanical features pursuant to Chapter 2, Section F.3 of the code.
Attached is a response to the code criteria required for the height exception. We ask that the
height exception be processed simultaneously with the land use change, rezoning and site plan

AJ. Whether the height exception will have adverse effect on the existing and proposed land
uses.
The proposed stair towers and elevator shafts requiring the height exception are located
on the east tower of the building. These structural and mechanical features are required
for adequate access and are a small portion of the building roof structure. The height
exception will not have an adverse effect on either the existing or proposed land uses. We
anticipate this project to have a positive influence on the City and be considered an
example for new development to the Federal Highway corridor.
BJ. Whether the height exception is necessary.
The height exception is necessary for the mechanical and structural features that provide
access to the upper floors and roof structure of the building.
C). Whether the height will severely reduce light and air in adjacent areas.
The stair towers and elevator shafts extend from the roof deck of the building and are a
small proportion of the overall building footprint. These necessary building features will not
reduce light or air for the adjacent areas.
DJ. Whether the height exception will be a deterrent to the improvement or development of
adjacent property in accord with existing regulations.
The City has adopted the mixed use land use and zoning districts to promote the type of
development proposed by this project. Other properties along the Federal Highway
corridor have the same right as the applicant to utilize the MU zoning districts for similar
types of developments. The building features that require the height exception are
necessary to comply with accessibility regulations and will not be a deterrent for other
properties in the area to be redeveloped.
E). Whether the height exception will adversely affect property values in adjacent areas..
We believe that the proposed Boynton Beach Lofts project will enhance property values
in the area by utilizing the MU-L zoning district development standards. Again, the height
exception is necessary to accommodate building features that are required for access to
the upper floor and roof of the proposed building. The height exception will not affect
property values.
F). Whether the height exception will adversely influence living conditions in the
neighborhood.

The proposed mixed use project includes 48 residential units thus encouraging and
enhancing the living conditions in the neighborhood. Residents could have the
opportunity to work and shop within their own building. They will also have the opportunity
to walk to nearby shopping, restaurants and other personal service type of uses. The
requested height exception is to accommodate a structural building requirement and will
not adversely influence living conditions in the neighborhood.
GJ. Whether the height exception will constitute a grant of special privilege to an individual
owner as contrasted with the public welfare.
The section of the code is established to allow height exceptions for mechanical and
structural features of a building. Other property owners have the same right to utilize this
section of the code as the applicant for Boynton Beach Lofts. Each height exception
request is reviewed and evaluated on its own merits. The requested height exception for
Boynton Beach Lots will not grant a special privilege.
HJ. Whether sufficient evidence has been presented to justify the need fOI a height exception.
A site plan application and re-zoning application for the mixed use has been submitted
for review by City staff. Included in the site plan package are architectural elevations and
floor plans illustrating the proposed building, including the stair towers and elevator shafts
that require the height exception.
