MUNICIPAL PARKING GARAGE
VARIANCE JUSTIFICATION
A.'Special conditions and circumstances exist at the site due
to the fact that the rapid growth of the City has created
the need for an expansion of the municipal complex, and '
the amount of property that the City owns to be used for
the expansion is limited. The configuration of the land '
with respect to the building square footage and parking
required does not lend itself to the construction of such
needed facilities to serve the public. Furthermore, as a
'part of the masterplan for the expansion ~f the municipal
complex, it is proposed that N.E. 1st Avenue be abandoned
at a future date. The future abandonment of this City-
owned right-of-way will eliminate the need for the front
yard setback and the property occupied by this right-of-
way is to be incorporated within the overall municipal
complex. The future abandonment of this right-of-way
will resolve all setback problems, as the City also
owns the property across from the proposed parking
garage where the new parking lot was recently constructed.
It should also be noted that the PU (Public Usage) zoning
category consists primarily of City-owned property and
property owned by other public agencies, and the City has
no other land in this zoning category affected by these
same conditions.
B. The special conditions and circumstances are a result of
the rapid growth of the'City's population, creating the
need for expanded facilities to serve the needs of the
public, where the amount of available property for such
purposes is limited, and .these constraints are not a re-
sult of any action tak~n by the City.
.
C. Granting the variance requested will not confer on,the
-City-any special privilege that is denied to other lands,
buildings, or structures in the same zoning district,
because all lands within the PU zoning district are to be
used for public purposes, and the future abandonment of
N.E. 1st Avenue will eliminate the setback issue.
D. The literal interpretation of the provisions of this
chapter would work unnecessary, and undue ha;dship on
on the City, in that it,would deprive the 'City of being
able to provide those facilities necessary to serve the
increasing needs of the public, particUlarly in consider-
ation of the fact that the future abandonment of N.E. 1st
Avenue will resolve the setback issue.

The variance requested is necessary to provide ample land
for the proposed parking structure, owing to Site-specific
design constraints, and is not at all unreasonable as the
future abandonment of N.E. 1st Avenue will resolve the
variance issue.
F. The grant of the variance will be in harmony with the gen-
eral intent and purpose of the Zoning Regulations, and such
variance will not be injurious to the area involved or
otherwise detrimental to the public welfare, in that the
property in the entire block between Boynton Beach Boulevard'
and Ocean Avenue is zoned for Public Usage and is owned by
the City, with the exoeption of the property to the south-
west which is owned by the School Board.
