Fence Addressing the Planning and Zoning Board

We feel the fence is not an obstruction to traffic on either side of road as the
set back on the front side is approx.50ft. from the road to the fence, on the
west side the fence is approx 25ft. back from the road.
Now we have a shed and we are told the shed has to be fenced in with a 4ft.
fence. Now you want us to take to 2ft.off of the fence that is there which
would actually, in my way of looking at the situation would be more of an
obstruction, as the shed would be higher than the fence, which is on the same
side of the 6ft. fence and is not that much further back than the fence, but
would not be obstruction as it does meet code requirements as far as the
distance required from the fence on the property, that is not that far from the
fence f As shown in picture.
Now about the shed:
First of all we were never informed by Pro Built Inc. we had to get a permit
or given any paper work to present to the city until we were notified with a
violation and we called them and we ourselves picked up the prints that
seem to meet the requirements according to Scott Blasie who we met at the
property. If at this time we have to get.a permit we are prepared to do so.
Again back to the fence:
Across from the street on S. W. 4th. St. we are looking at a concrete wall
alo!18 95. As shown in pictures labeled our fence, # I and 2 at.444 S.W.

Why should we have to look at an ugly yellow wall approx 12 ft. high and
the yellow and green signs on 95 t not to mention the guard wall and all the
yellow signs referring to the danger of that wall being there They are at
every west bound street and there sure are plenty of them, which is telling
me that is more of a danger aspect than where our fence is. Again not to
mention we would have to look at all that mess. And our fence looks much
better than that! r!!! Does the ordinance code not apply to that wall ?
As again shown in pictures.
There a many homes with the same situation of a 6ft. fence on comer lots
but do not have the WlSightly sight of a 12 foot concrete wall to look at.
Not to mention the properties with 6 to 8 ft. hedges, trees and fences further
out than fence on our property.
Next let's discuss variance's
We live next store to the Islam Family on Riviera Drive.
Shall we discuss the variance he received to be allow to build that house as
high as he did without any notification to anyone on our block !! which is
Riviera Drive.
We and others on our block went to the town meeting and were actually
thrown out of the meeting. They refused to discuss the matter within the
meeting and made us go out to the hall way to discuss that matter.
The house went up way over code, and now we are expected to get a
variance for a fence, which we will if we have to. But there is really
something wrong with this whole picture !
Also referring to the Islam house, I believe a building must be lOft.from the
property line. The Islam house is 8ft. from the property line. We measured it
during the building process. Explain how he was able to get away with that
also !
In conclusion we honestly feel our fence is not an obstruction to any traffic
and see no reason why we have to cut the fence down to 4 ft.

Two property owners, Mr. Di Nizo and Mr. Deacon contacted the city on or about April 9, 2001 via a letter stating
that they had never been notified of the variance request/hearing, and that they are owed to say what is approved
next to their properties. I spoke to them on May 1 st at the Commission meeting and explained the process and
that we had no evidence to support the claim that the mailing had been deficient or faulty. We have both
gentleman/property owners listed on the printout of property listings that were included in the mailing.
I sent out a letter in follow-up to that conversation. I'll provide you a copy. MR

This letter is in response to both your letter dated April 9, 2001, and the public inquiry made during the May 1,
2001 City Commission meeting, whereby you question the approval of the above-referenced requ~st, given the
lack of direct notifications received by property owners.
As discussed with you on May 1St, the City ofBoynton"Beach is required to mail notices on a pending variance
to all individuals who own property located within 400 feet from the subject variance request. As also
indicated to you, our project file still contains an accurate listing of all adjacent property owners who shall
have received a direct notice, and according to the City's established process for distributing legal notices and
positive track records, I have no reason to believe that the subject notices were not mailed out.
Currently, the City is not required to distribute direct notices via Certified Mail. Whether there is room for
improvements to our present system is always being considered through ongoing process evaluation; however,
we must acknowledge that any changes made from this point forward will not reverse history nor address your
concerns. At this time, I can only reiterate that it was the intent of the City, as confirmed by file documents, to
have properly notified all property owners within the required radius.
Please understand that it has not been my intent to explain why notices may not have been received by you or
other nearby property owners, but rather to explain the intent of the City's process and file documentation.
However, please contact me should you have further questions on this response, or the subject variance
application.

I understand from our previous conversation on June 15th that you wish to request an additional
variance for the shed and postpone the hearing for the variance requests to the August 28,
2007 Planning and Development Board meeting. You were advised on June 15th to submit a
revised variance application (including justification) for the additional variance you have
requested (for the shed). It has been a month and nothing has been submitted. It is important
that you take care of this as soon as possible in order to remain on the agenda for 8/28. Also,
an application fee of $100 is required for the additional variance and is due when the revised
application and documentation is submitted to us.

Per City Of Boynton Beach Ordinance 04-007
No quasi-judicial proceeding shall proceed until proof of notice of the proceeding, in affidavit form, has
been filed with the Office of the City Clerk. Proof of notice must include the name and address of each
property owner to whom notice was mailed and a photograph of each sign posted, as hereinafter
required. The following notices must be paid for and provided by the applicant:

Scott, Have they been cited for the shed? Our dilemma is that if there are two violations,
it is preferable to process both at the same time, rather than one for the fence now and
one for the shed at a later date. Since I specifically asked Ms. Denizo if it was one or
two variances and she said one, I don't know whether she is in denial or hasn't been cited
for the shed as well. Bottom line is I can't call her and tell her she has to do two, she
has to request it and unless she's been cited, I see no reason for her to request.

Dear Mr. & Mrs. Di Nizo:
As per request via the City Manager's office I've reviewed the issues regarding the violations
associated with Code Compliance cases 06-851 and 06-2472. The following information
provides a chronological picture with regard to the fence that is central to this issue:
. July 19,2005 - Ordinance #05-034 changed existing requirements for comer lots
lowering the height for fences from 6 feet to 4 feet.
. April 4, 2006 - Violation Notice issued for a fence installed without permit/inspections
as per Red Tag from the Development Department.
. July 13, 2006 - Bulldog Fence application for permit filed (application #06-5191)
. September 14,2006 - Affidavit of Compliance Issued based on conversation with Karen
Main relative to permit #87-344 (Fence)
. October 3, 2006 - Bulldog Fence requested permit #06-5191 be voided.
. October 3,2006 - Notice of Violation issued by Officer Webb as per Red Tag from
Development dated 9/26/06 to include the fence as well as a newly installed shed, both of
which require permits/inspections.
Summary:
The Code Compliance Division issued the Affidavit of Compliance to you in error based on
information obtained from you along with proof of an existing fence associated with permit #87-
344. Subsequent review of two sets of aerial photographs clearly indicates the complete absence
ofa fence on January 15, 2005 and a new fence on July 1, 2005. It's my understanding you
purchased the house on July 25, 2005 and therefore you are now responsible for the permitting of
this fence. I apologize for this oversight on our behalf however, the fact remains that we have a
fence and a shed that need to be legally permitted and inspected to ensure compliance with our
Codes.

As we discussed on October 13th, I did my best to research this matter to the extent you may have
been able to keep the 6 foot height on the S.W. 4th Street side, but as you'll note above the Code
was amended prior the installation of the fence. My office will work with you in terms of

shed and will assist you in any way possible to help you complete this process. If you should
