Ftumpf: The purpose of this letter is to request a one year time extension for the referenced project. The date of the Development Order approval was September 6, 2005 and subsequently extended until September 6, 2007. The applicant is requesting the time extension because of unforeseen delays in the development process, including the relocation of FPL facilities which was just reasonably resolved with FPL, modification to the Project to accommodate a major BellSouth duct bank which could not be relocated as originally envisioned, and changes in market conditions requiring re-design of the Project to provide more work force housing. The Developer had anticipated that it would take FPL several months to review the Project and the relocation of its facilities. Instead, 500 Ocean Plaza was caught in a backlog of projects requiring FPL signoff. Only recently has FPL signed off on the relocation of its facilities. In addition to the FPL relocation, the Developer had anticipated the relocation of a major BellSouth fiber optic trunkline serving a substantial portion of the City of Boynton Beach. The relocation was determined not to be economically feasible and would delay the project an inordinate amount of time. To avoid this problem the Developer was required to substantially modify the plans and relocate the elevator banks to accommodate the BellSouth fiber optic trunkline without relocation. The process of identifying the BellSouth facilities, evaluating the ability to relocate same and the redesign of the Project to accommodate the BellSouth fiber optic trunkline has substantially delayed the Project. The Developer had previously completed a full set of plans and specifications for the Project which has cost the Developer more than $800,000.00 to prepare and had submitted same to the City for courtesy review. During the last year the Developer has been revising the plans and specifications to address comments from the City and to reduce project costs to enable the Developer to provide more affordable units in light of the changes in market conditions. The revised plans and specifications are anticipated to be completed within the next few months for Atlanta . Bethesda . Boston . Chicago . Fort Lauderdale . Jacksonville . Los Angeles Miami. The Developer has now expended in excess of $2,000,000.00 in connection with the design of the Project. During the last year the Developer and its engineers has been working closely with City staff to replat the Property. The proposed replat is now virtually finalized, subject to finalization of the plans and specifications. In addition, the Developer has removed the FPL utility lines from the site, installed a 2,000 amp transformer to power the site during construction and planted approximately 20 palm trees along Federal Highway to beautify the site during construction. The Developer has paid multiple fees associated with the development of the Project including: the courtesy review fee; water/sewer capacity fees (approximately $350,000.00); BellSouth permit fee; fees to demolish existing structure on the site; and the fence permit fee. As significant as unforeseen difficulties have arisen, including changes in market conditions, a one year extension of time is reasonable.
