Enclosed is the Development Order granted by the City Commission on May 20, 2008. The major site plan modification
approval is valid for eighteen months from the date of final approval. In order to maintain vested status, a building permit
must be secured or an extension requested prior to expiration.
To continue this project through the development process, please revise relevant pages of your approved site plan to
incorporate all conditions of approval as applicable. A copy of the Development Order, including these conditions, must
accompany the submission of the fully amended site plan set. The person managing your permit applications should be made
aware of any additional documents and third party letters listed in the conditions of approval that need to be submitted with
your permit package.
The Building Division is committed to speedy and efficient completion of the building permit process for your project.
However, please note that failure to meet all applicable Development Order conditions in the submitted plan set may produce
unnecessary delays in permit issuance. A thorough review will be conducted by the Plan Review Analyst and if the necessary
documentation is not attached and/or the plans are not amended to reflect all of the approval conditions, the plans will be
returned to the applicant for correction and re-submittal before the permit is further processed. Feel free to contact any T ART
member for additional clarification of comments.
Important: If you plan to introduce any changes to your approved site plan beyond those required by conditions of approval,
please contact our staff for a review before submitting a permit package to the Building Division.
A copy of the complete Development Order and Amended Site Plans reflecting the "Conditions of Approval" must be
submitted to the Building Department along with the first permit request to avoid any delays in the processing of your
permit.

Comments:
1. Enter into a maintenance agreement for S. Circle Dr. with the HOAIPOA's X
for the developments to the west and south of Boynton Vistas. A copy of this
maintenance agreement will be required at the time of permitting for Paving,
Grading & Drainage.

2. Please note that changes or revisions to these plans may generate additional X
comments. Acceptance of these plans during the Technical Advisory Review
Team (TART) process does not ensure that additional comments may not be

6. At time of permitting, fire flow calculations will be required demonstrating X
the City Code requirement of 1,500 g.p.m. (500 g.p.m. some residential
developments) with 20 p.s.i. residual pressure as stated in the LDR, Chapter
6, Article IV, Section 16, or the requirement imposed by insurance
underwriters, whichever is greater (CODE, Section 26-16(b)).
7. The CODE, Section 26-34(E) requires that a capacity reservation fee be paid X
for this project either upon the request for the Department's signature on the
Health Department application forms or within seven (7) days of site plan
approval, whichever occurs first. This fee will be determined based upon
final meter size, or expected demand.
8. A building permit for this project shall not be issued until this Department has X
approved the plans for the water and/or sewer improvements required to
service this project, in accordance with the CODE, Section 26-15.
9. All utility construction details shall be in accordance with the Utilities X
Department's "Utilities Engineering Design Handbook and Construction
Standards" manual (including any updates) and will be reviewed at the time
of construction permit application.

provisions of 2004 FLORIDA BUILDING CODE, Section 1609 (Wind
Loads). Calculations that are signed and sealed by a design professional
registered in the state of Florida shall be submitted for review at the time of
permit application.

13. At time of permit review, submit signed and sealed working drawings of the
proposed construction.
14. At the time of permit review, submit details of reinforcement of walls for the X
future installation of grab bars as required by the Federal Fair Housing Act,
Title 24 CFR, Partl00.205, Section 3, and Requirement #6. All bathrooms
within the covered dwelling unit shall comply.
15. Bathrooms and kitchens in the covered dwelling units shall comply with the X
Federal Fair Housing Act, Title 24 CFR 100.205. Indicate on the plans which
design specification ("A" or "B") of the FEDERAL FAIR HOUSING ACT is
being used. The clear floor space at fixtures and appliances and turning
diameters shall be clearly shown on the plans. Master bath shower in
Building "A", Unit # 2 shall be changed to a tub.
16. A water-use permit from SFWMD is required for an irrigation system that X
utilizes water from a well or body of water as its source. A copy of the
permit shall be submitted at the time of permit application, F.S. 373.216.
17. If capital facility fees (water and sewer) are paid in advance to the City of X
Boynton Beach Utilities Department, the following information shall be
provided at the time of building permit application:
. The full name of the project as it appears on the Development Order and
the Commission-approved site plan.
. If the project is a multi-family project, the building numberls must be
provided. The building numbers must be the same as noted on the
Commission-approved site plans.
. The number of dwelling units in each building.
. The number of bedrooms in each dwelling unit.
. The total amount paid and itemized into how much is for water and how
much is for sewer.

18. Pursuant to approval by the City Commission and all other outside agencies, X
the plans for this project must be submitted to the Building Division for
review at the time of permit application submittal. The plans must incorporate
all the conditions of approval as listed in the development order and approved
by the City Commission.
19. The full address of the project shall be submitted with the construction X
documents at the time of permit application submittal. The addressing plan
shall be approved by the United States Post Office, the City of Boynton
Beach Fire Department, the City's GIS Division, and the Palm Beach
County Emergency 911.

zoned R-3, Multi-family Residential.
Ms. Zeitler noted the subject property for the proposed Boynton Vistas II project
consisted of a proposed 1-story building with four units, a 1-story building with three
units, and a 1,000 square foot rental office. The project was proposed at the maximum
density. The proposed rental office could not be converted into an additional dwelling
unit in the future.
Staff reviewed the site plan and determined the project, along with the recommended
conditions of approval, complied with the Land Development Regulations. The project
had received approval for traffic and school concurrency. The existing parking lot
would be reconfigured and upgraded to several current Code requirements for traffic
and pedestrian circulation, accessibility and landscaping. The parking lot would be
resurfaced and restriped and would include new curbing, landscaped islands and
sidewalks. The project proposed a mix of two and three-bedroom units, based on 19
total units, and 1,000 square feet of office space. The project required 42 parking
spaces and a total of 45 parking spaces were provided, included two handicap spaces.
The entire site would be landscaped to comply with current requirements. A large,
open-space area, approximately 100 feet by 100 feet, would remain vacant, serving as
usable open space and a recreation area for the residents. Building IlA" would contain
four dwelling units and Building IlBIl would contain three dwelling units and an office.
The minimum living area for multi-family units in the R-3 zoning district was 750 square
feet. Each of the dwelling units, and the office would be approximately 1,000 square
feet in size. Staff reviewed this request for major site plan modification and was
recommending approval with conditions.

Jeff Wolff, President, Wolff & Company, Inc., and owner of Boynton Vistas, concurred
with all the conditions of approval. He noted the existing buildings were fully occupied
and as such, there was a need for the project. Additionally, in order to accommodate
requests of Section 8 Housing and Affordable Housing, he included three-bedroom, and
three-bath units in the mix.
Board discussion ensued. Highlights included:
· The floor plan was not good, as the bedrooms were larger than they needed to
be (especially the master bedroom), while the living room and dining rooms
should be larger.
· The plan was consistent with today's market, and the kitchen and bedrooms
were the most important features.
Mr. Wolff noted, in dealing with handicap issues, he was requested to modify the
bathrooms, which reduced the size of the living area. Representatives of companies
with which he dealt believed it was more important for individuals to be able to
navigate more easily in the bedrooms than in the living rooms. Mr. Wolff advised all
units in the development were rentals and, in his opinion, were very marketable. He
was prepared to build the units immediately upon approval. He added funding should
be available within the next 30 days. He pointed out the floor plans for the proposed
units were consistent with the floor plans of the existing buildings, and the proposed
units would be upgraded to provide hurricane shutters. He reiterated Section 8
Housing would be provided pursuant to the Fair Housing Act.
Board discussion ensued. Highlights included:
· As the units in existing buildings were fully occupied, the need existed for the
development.
· The necessity for the provision of Section 8 Housing was noted.
Motion
Mr. Lis moved to approve, with all conditions of approval as noted. Mr. Saberson
seconded the motion that passed 5-1 (Mr. Myatt dissenting).

Ed Breese, Principal Planner, requested Items 7.C1., Safe & Secure Phase III, Major
Site Plan Modification, and 7.C2., Safe & Secure Phase III, Community Design Plan
Appeal, be addressed simultaneously for presentation and voted on individually. The
board had no objection to the request.
