PROPERTY OWNER NOTIFICATION Owners of properties within 400 feet of the subject conditional use were mailed a notice of this request and its respective hearing dates. The applicant certifies that they posted signage and mailed notices in accordance with Ordinance No. 04-007. Features: The subject site is comprised of two (2) lots: parcels #0203 and #0206, which total 1.757 acre. Parcel #0203 is located on the west side and contains the existing Boynton Vista development consisting of a two (2)-story apartment building with eight (8) units, and a one (l)-story apartment building with four (4) units. Parcel #0206 is located on the east side and currently vacant. This parcel is the subject property for the proposed Boynton Vistas II project consisting of a proposed one (l)-story building with four (4) units, a one (l)-story building with three (3) units and a 1,000 square foot rental office. An existing parking lot separates the existing and proposed buildings. A Unity of Title is required to combine the two (2) parcels into a unified parcel. BACKGROUND Proposal: Mr. Jeff Wolff, representing the property owner Wolff and Company, Inc., is requesting major site plan modification approval to allow construction of seven (7) additional multi- family residential apartment units and a rental office. All units would be rental apartments, consistent with the existing Boynton Vistas development. The property is zoned Multi-family Residential (R-3) and apartments are permitted uses in the R-3 zoning district. Based on total acreage (1.757 acre) and the maximum density of 10.8 dwelling units per acre as allowed in the High Density Residential (HDR) land use classification, the maximum allowable dwelling units is 19. The existing development consists of a total of 12 units, and an additional seven (7) units are proposed, for a total of 19 dwelling units. It should be noted that, with the project being proposed at the maximum density, the proposed rental office space could not be converted to an additional dwelling unit in the future. Staff Report Boynton Vistas II (MSPM 07-004) Page 3 ANALYSIS Concurrency: Traffic: A traffic statement was sent to the Palm Beach County Traffic Division for concurrency review in order to ensure an adequate level of service. The Palm Beach County Traffic Division has determined that the proposed residential project meets the Traffic Performance Standards of Palm Beach County. No building permits are to be issued by the City after the 2009 build-out year. The County traffic concurrency approval is subject to the Project Aggregation Rules set forth in the Traffic Performance Standards Ordinance. School: The School District of Palm Beach County has reviewed the request and determined that adequate capacity exists to accommodate the seven (7) additional dwelling units. Utilities: Sufficient sanitary sewer and wastewater capacity is currently available to serve this project, subject to the applicant making a firm reservation of capacity, following approval of the site plan. Police/Fire: Staff reviewed the site plan and determined that current staffing levels would be sufficient to meet the expected demand for services. Drainage: Conceptual drainage information was provided for the City's review. The Engineering Division has found the conceptual information to be adequate and is recommending that the review of specific drainage solutions be deferred until time of permit review. All South Florida Water Management District permits and other drainage related permits must be submitted at time of building permit (see Exhibit "C" - Conditions of Approval). Driveways: The project proposes two (2) points of ingress/egress to the subject site: from NE 1ih Avenue to the north, and from South Circle Drive to the south. Each access point and the drive aisle within the parking lot is 25 feet in width to accommodate two (2)-way traffic movements. The existing parking lot will be reconfigured and upgraded to several current code requirements for traffic and pedestrian circulation, accessibility, and landscaping. The parking lot will be surfaced and restriped and include new curbing, landscape islands, and sidewalks. Dumpster: The location and angle of the proposed trash enclosure would efficiently facilitate the removal of its contents due to the anticipated traffic flow and design of the garbage trucks. Staff's review of the site plan requires the existing dumpster to be completely screened and landscaped in compliance with City requirements. Parking: Two (2) and three (3) bedroom dwelling units require two (2) parking spaces per unit. The project proposes a mix of two (2) and three (3) bedroom units for a total of 19 dwelling units. In addition, office space requires one (1) space per 300 square feet of gross floor area. Therefore, based on 19 total units and 1,000 square feet of office space, the project requires a total of 42 parking spaces (38 spaces for 19 units, and 4 spaces for apartment rental office). The site plan proposes a total of 45 off-street parking spaces, including two (2) handicap spaces. According to the Typical Handicapped & Standard Parking Detail, the 90-degree parking stalls would be dimensioned nine (9)- Staff Report Boynton Vistas II (MSPM 07-004) Page 4 feet six (6)-inches in width by 18-feet six (6)-inches in length. The handicap parking spaces would be dimensioned 12 feet in width (with an adjacent striped loading/unloading area of five (5) feet) and 18 feet six (6)-inches in length. Landscaping: Although the proposed units would only occupy a small portion of the site, the entire site (1.757 acre) will be landscaped to comply with current requirements. The Survey indicates there are a total of six (6) existing Queen Palms on-site to be removed and mitigated. According to the landscape plan (sheet LP-1), the total pervious area proposed would equal 52% of the site, while the total impervious area would equal 48% of the site. Chapter 7.5, Article II, Section 5.P of the Land Development Regulations requires that a minimum of 50% of landscape plants be native species. The Plant List (sheet LP-1) indicates that 38 of the 47 trees (82%) would be native, while 1,040 of the 1,196 shrubs (87%) would be native. The landscape plan indicates that 46 trees are required and 47 trees (+ 1) are provided, and 1066 shrubs are required and 1196 shrubs (+ 130) are provided. Proposed trees include Live Oak, Pigeon Plum, East Palatka Holly, Geiger Tree, Yellow Elder, and Cabbage Palm. Proposed shrubs and groundcover include Dwarf Firebush, Red-tip Cocoplum, Green Buttonwood, Golden Dew Drop, Dwarf Variegated Arboricola, Lantana, and Morning Glory Vine. A large open space area of approximately one-quarter acre (100 ft. by 100 ft.) is located at the northeast corner of the subject property. This landscaped area will serve as a usable open space and recreation area for the residents. Buildings: As previously mentioned, the seven (7) additional dwelling units are proposed within two (2) separate one-story buildings on the easternmost portion of the combined 1.78-acre site. Building "A" would contain four (4) dwelling units, and Building "B" would contain three (3) dwelling units and an office. The minimum living area for multi-family units in the R-3 zoning district is 750 square feet. Each dwelling unit and the office would be approximately 1,000 square feet in size. The maximum structure height in the R-3 zoning district is 45 feet (4 stories). The building elevations (sheets A-1 through A-4) indicate that the proposed one-story buildings would be 14 feet - six (6) inches measured at mean roof height of the pitched roof, and 21 feet at the highest point. The minimum building setback requirements in the R-3 zoning district are 40 feet for front and rear yards, and 20 feet for side yards. The site plan (sheet SP1) shows the proposed setbacks are consistent with these requirements. A covered porch is proposed at the front and rear of each unit. The building elevations indicate that a five (5) foot high CBS privacy wall would be placed between the exterior doors and extend to the edge of the covered porch to provide for extra privacy between units. Design: The proposed one-story buildings resemble a contemporary design with painted smooth stucco on concrete block with a pitched shingle roof. Decorative features include paneled doors, colonial-style windows, stucco banding and quoins at each corner. The exterior paint would consist of the following Benjamin Moore colors: Walls - Pecos Spice AC-14 (nutty brown), and trim / doors - Mochachino AC-13 (light beige). Roof shingles would be a coordinating brown color known as Shakewood. Staff Report Boynton Vistas II (MSPM 07-004) Page 5 The plans propose a total of eight (8) freestanding light fixtures (sheet SE-1) within the parking lot that are 27 feet in height, of medium bronze color, and baffled to shield light away from adjacent properties. In addition, a total of five (5) outdoor light fixtures will be located near each building entrance. At time of permitting, the Photometric Plan (sheet SE-1) is required to be revised to comply with the minimum average light levels to ensure no light spillage onto adjacent properties (see Exhibit "C" - Conditions of Approval). Signage: No signage for the development is proposed. RECOMMENDATION: Staff has reviewed this request for major site plan modification and is recommending approval of the site plan, subject to satisfying all comments indicated in Exhibit "C" - Conditions of Approval. Any additional conditions recommended by the Board or required by the City Commission shall be documented accordingly in the Conditions of Approval. Label right of way widths of all adjacent streets under street names (i.e. NE 17th Ave, 60'R!W South Circle Dr 30' R!W) Include the following information in the site plan data (sheet C-l) for the R-3 district: Proposed Use (Multi- family Apartments); Minimum zoning district setbacks (required and provided); Minimum lot area; Minimum lot frontage; Minimum living area (per unit) and size of units proposed; Proposed density (dwelling units per acre); Maximum density per future land use classification; Building lot coverage (in %, does not include parking lot); Pervious % of site, Impervious % of site (does include parking area), Maximum structure height and height proposed; Area devoted on site for recreational and any amenities proposed. Revise tabular site data (on sheet C-l) to include: acreage (next to sf under site area heading); revise "current zoning" to Zoning District" and name for R-3 zoning (Multi-family Residential); revise "current land use" to "Future Land Use classification", correct "multifamily residential" to "High Density Residential (HDR) maximum 10.8 du/ac". Revise parking information in site plan data (sheet C-l) to include # of bedrooms for existing and proposed. Code requires 2 spaces per unit with 2 bedrooms or more. Plan states 8 units proposed, floor plans indicate 7 units and office proposed. Office space is 1 space per 300 sf of GF A. Correct calculations and total number of spaces accordingly. Indicate locations of freestanding lights on both site plan and landscape plan, and label as proposed or existing. Indicate locations of all 220 volt receptacles on electrical plans (E-l ,2). Label covered porches on building footprints in Phase II. On site plan (sheet C-1), indicate with ghost lines the existing parking lot configuration (boundaries only, not each parking space) and indicate the existing dumpster pad and label "existing parking lot to be reconfigured" and "existing dumpster pad to be removed". Revise new dumpster screening detail (sheet C-4) to match plans (include side wall). Note on site plan and floor plan that the development at 19 units total is the maximum density allowed and the proposed Office cannot be converted to a dwelling unit. Revise Privacy Wall detail (on sheet A-5) from 6' to 5' (to match floor plans and building elevations). Consider reducing the sidewalk width from 5 feet to 4 feet on the two southernmost buildings, to provide an additional 2 feet of landscape area on the west side of the SE building, so additional landscape material (including Pigeon Plum trees) can be accommodated. Improve/enhance building elevations with some additional architectural features such as decorative shutters, medallions, quoins, colonial style windows. Enhance entrances to each unit by providing decorative doors, porch lights, etc. On each building elevation, indicate the building height (measure from midpoint of pitched roof). The building height / roof elevation depicted on all elevation drawings should directly correspond to the proposed building height in the site plan tabular data. Revise all building elevations to include colors and materials proposed for building walls, trim, roof, doors, privacy walls, etc. with paint manufacturer, name color of paint and paint code (i.e. Sherwin Williams "Sea Salt SW 6204"). Equipment placed on the walls of the buildings shall be painted to match the building color (Chapter 9, Section 1O.CA.). Place a note on the building elevations indicating this requirement. Provide paint swatches for the colors described on the revised building elevations. Staff recommends using a color schedule (Chapter 4, Section 7.D.). Colors must be compatible with adjacent development per the Land Development Regulations. Include a color rendering of all elevations prior to the TART meeting (Chapter 4, Section 7.D.2.). These will be on display at the public meetings. An aerial photograph indicates existing trees along the perimeter of the property and a few interior plants. Submit a tree survey which indicates the location, size, and common name of all existing trees on site and whether the tree is to be removed and mitigated or relocated on site, specifying the proposed location. The removal and/or relocation of landscape material is subject to review and approval of the City Forester / Environmentalist. Revise plant list (sheet LP-1) with symbol noting native species per plant category. Move total trees and shrubs from bottom of plan to end of plant list. Ensure that total trees and shrubs match what is shown on landscape plan and on plant list. Revise % of native required to 50% in total trees and shrubs information. Yellow Elder trees are required to be 12 feet high over all with a 3" caliper trunk diameter. Provide Phase lines on landscape plan which correspond to revised site plan. Clarify through noting on landscape plan the existing plantings and proposed planting areas. Provide notes on landscape plan regarding sf/percent of site that is pervious and impervious on site. Revise Note 2 on Sheet C-l and Note 15 on LP-I to indicate unobstructed visibility between 2 1'2 feet and li feet. Required landscape buffers adjacent to rights-of-way shall contain two layers of plant material. The first layer shall be a combination of colorful groundcover plants and a minimum of two colorful shrub species planted in a continuous row. The next layer shall consist of a continuous hedge or decorative site wall and one (1) tree spaced a maximum of 30 feet apart. The continuous hedge (2nd layer) shall be a minimum of 24 inches in height, 24 inches in spread and planted with tip-to-tip spacing immediately after planting. A masonry wall 3 feet in height may substitute for the decorative site wall or continuous hedge requirements (2nd Layer) (Chapter 7.5., Article II, Section S.D.). The dumpster is required to be screen with landscape material a minimum of one-half (1/2) the height of the walls. All above ground mechanical equipment such as, but not limited to, exterior utility boxes, meters, and transformers shall be visually screened. Back-flow preventers shall be painted to match the principal structure (Chapter 9, Section 10.CA.). Place a note on plan indicating this requirement and revise landscape plan to indicate screening. Indicate locations of AC equipment around proposed buildings and how they will be screened. Revise note 5 on site plan (sheet C-I) to state: On-site irrigation will be from a non-potable water source (well). Indicate revised note on irrigation plan and landscape plan as well. Indicate the well location and label as such on site plan, and landscape plan. Revise photometric plan to include the following: a plan title of Photometric plan rather than site plan; a sheet number which corresponds to the drawing index on cover sheet; removal of all site plan tabular data/notes; a drawing that is to scale, not reduced; lighting professional (name and contact number) who prepared plan (notes from bottom left indicate Pro Lighting Resources, title blocks indicate Lighting Representatives, and LSI Industries (clarify which one); and relocate notes from bottom left to another location on plan where visible (can't read when plans stapled in set). On photometric plan provide an elevation drawing of all proposed lighting (freestanding and attached) and label with corresponding details from legend. Indicate height (from grade to top), color, and material of freestanding lighting. Provide the following as notes on the photometric plan: A minimum average light level of one (1) foot candle shall be provided, with no more than 10% of the spot readings below one (1) foot candle and none below 12 foot candle (Chapter 23, Article II.A.I.a). The design, style, and illumination level shall be compatible with the building design (height) and shall consider safety, function, and aesthetic value (Chapter 9, Section 1O.F.1.). Lighting shall not be of an intensity that produces glare on adjacent property (Chapter 9, Section 1O.F.2.). Feature lighting emphasizing plants, trees, barriers, entrances, and exits is encouraged (Chapter 9, Section 10.F.3.). Revise Photometric plan to include light levels all around proposed buildings demonstrating compliance with minimum average light level of one (1) footcandle on site. On the photometric plan, continue the light level readings to all property lines, to ensure no light spillage onto adjacent properties. Indicate location of any existing or proposed signage. Provide details of any proposed signage. Indicate where residents will receive their mail (location of mail kiosk or other). Applicants who wish to utilize City electronic media equipment for presentations at City Commission Public Hearings must notify the Planning and Zoning Department representative at least one week prior to the scheduled meeting.
