Dear Mr. Rumpf:
The purpose of this letter is to request a time extension for the approved Casa Del Mar
project (NWSP # 06-015) located on North Federal Highway. This project was approved
for the development of 82 condominium units on a 4.11 acre parcel in the Infill Planned
Unit Development (IPUD) zoning district. This project was originally approved on July 18,
2006 and will expire on July 18, 2007. We respectfully request an extension of one year
to July 18, 2008. A timeline for the steps taken thus far to receive appropriate approvals
prior to filing for a building permit with the City is as follows:
. Filed a Request for Exemption and Statewide Programmatic General Permit
(SPGP) on June 9, 2006.
. Received SPGP on July 7,2006.
. Filed with the South Florida Water Management District (SFWMD) a Joint
Application for Environmental Resource Permit I Authorization to use State
owned submerged lands I Federal dredge and fill permit with the Florida
Department of Environmental Protection I Water Management Districts I U.S.
Army Corps of Engineers (ERP) on November 15, 2006.
. Filed an amendment to above ERP to include docks on December 13, 2006.
. First Request for Additional Information (RAI) from SFWMD dated December
13, 2006.
· Supplemental RAI from SFWMD January 12, 2007.
. After meeting with SFWMD filed response to RAI on March 5,2007.
. Second RAI from SFWMD on April 6, 2007.
Since the last RAI, the applicant has had several discussions and two site visits with
SFWMD and are in process of scheduling a 3rd site visit with SFWMD before making a
formal response. Please see attached documentation verifying above information.
Additionally, it should be noted that the current property owner took title of the property
in January 4, 2007. Unfortunately, the state review process is lengthy and obtaining
permits requires the review of several state agencies. It is the applicant's intent to file for
building permit and develop the Project once the above mentioned permits have been
awarded. The applicant believes that the above demonstrates that a good faith effort to
advance the project has been made.

Staff has completed a review of the applicant's submittal received March 8, 2007.
Please be advised that staff continue to have serious concerns that potential
direct, secondary and cumulative impacts to seagrasses and seagrass habitats
have not been eliminated or reduced to the greatest extent practicable as
required in the District's Basis of Review. The District cannot support the
placement of docking facilities and boat slips over seagrasses and seagrass
habitats that are expected to cause adverse direct, secondary and cumulative
impacts and therefore cannot recommend approval of the project as currently
proposed. As previously advised, the applicant should consider a smaller
docking facility with many fewer slips in a configuration that eliminates direct,
secondary and cumulative resource impacts.

In the event that the applicant wishes to continue pursuit of this application, the
District is requesting the following information needed to complete the application
pursuant to Rule 40E-4, Florida Administrative Code (FAC):
1. The Applicant's March 8, 2007 submittal included revised project drawings
showing the proposed access walkway length was increased from 568.5 feet
to 649.5 feet to move the proposed mooring area to deeper water. No
mooring signs, railings and grated decking were expanded from the earlier
proposal to include the entire access walkway from shore to the first slip
labeled S-1. Drawings indicate the walkway is proposed to be elevated 4.21
feet above mean high water. As described in the March 8, 2007 submittal the
applicant proposed the revisions with the intent to reduce potential impacts to
jurisdictional resources located within the project area. While the District
encourages project modifications to reduce potential impacts, please be

advised additional project modifications to eliminate direct, secondary and
cumulative will be needed to meet requirements for issuance of the requested
permit. As previously requested, please revise the proposed dock
configuration to significantly reduce the amount of shading resulting from the
dock and associated mooring of vessels. Substantially reducing the number
of slips is needed in order for the application to be recommended by staff for
approval.
2. As previously discussed, the seagrass survey report submitted on December
13, 2006 appears to be inconsistent with information reviewed in other
projects within the vicinity of the Lancore Nursery parcel. In addition to the
previously described inconsistencies, historical data provided by Palm Beach
County Department of Environmental Resource Management in the report
titled "Seagrass Monitoring in Lake Worth Lagoon: Final Cumulative Report
2000 through 2004" indicate the proposed project area includes significant
areas of seagrass habitat that have persisted over the course of decades.

being located over seagrass habitats as ffie greatest threat to seagrass
resources (critical habitat for the West Indian Manatee) within the Lake Worth
Lagoon. In order to provide reasonable assurances that adverse direct,
secondary and cumulative impacts to seagrass resources do not result from
this project, please coordinate a site visit with staff from the District, the U.S.
Army Corps of Engineers and FWC during the 2007 seagrass growing !)< a::,/"/ i).,
season to assess the likely effects of the proposed facility on seagrass,.',Jtl'"
resources. As discussed with the applicant and consultant during a meeting l" _I -'-I~C"
at the District's main office on January 31, 2007, it was agreed that.a new ~"C" ;r,.......
benthic resource survey conducted during the 2007 seagrass growing season
is needed to fully assess the environmental effects of the proposed project on
jurisdictional resources.
3. The applicant's March 8, 2007 response addressed portions of the \ I

4. The application was forwarded to the DEP, Division of State Lands for a title
determination on the submerged lands. The project is located on sovereign
submerged lands and will require a sovereign submerged lands lease.

-Two prints of a survey prepared, signed and sealed by a person properly
licensed by the State of Florida Board of Land Surveyors with the following
details shown:
A.The location of mean high water (MHW).
B.The location and dimensions of existing and proposed structures.
C.The location of the applicant's upland property lines and the length of
shoreline within the applicant's ownership.
D. The location of the primary navigation channel.
E. The distance between the waterward limits of the docking facility and
the near edge of the ICWW navigational channel.
F. Documentation that the docking facility does not extend more than 25%
of the width of the waterway.
E. A legal description of the preempted area to be leased (please refer to
the definition in Rule 18-21.003, FAC).
-Current local zoning and status of any other government approvals
necessary for the proposed activities.
-Florida Department of Revenue registration number. Leases without sales
tax exemption certificate shall be subject to Florida sales tax.
-A completed billing information form (refer to the attached copy).
- A list of names and addresses of all property owners within a 500' radius of
the proposed new lease area, which has been verified by the County Property
Appraiser's Office that these names came from the latest tax assessment
rolls.
-Once a project design has been agreed to by the applicant and the District,
you may complete and send the enclosed draft notice including the location of
the project and proposed square footage of the lease area, with a location
map and plan-view drawing, by certified mail to each individual on the list of
adjacent property owners in accordance with the following instructions for
noticing your proposed project. In order to ensure that sufficient evidence is
provided to the District that the project has been properly noticed, please
have each certified mailing marked return receipt requested with the District's'
address listed as the return address as follows:

Pursuant to Chapter 253:115(3), F.S., please also consider publishing the
enclosed notice in a newspaper of general circulation within the affected area
and provide proof of publication to the District. Be advised that the
application cannot be deemed complete until it has been documented that all
adjacent property owners within a 500' radius of the project have been
noticed of the proposed submerged lands lease
5. The processing fee collected by the District for a submerged lands lease is
$200.00. Please submit a check payable to the South Florida Water
Management District for $200.00. Include the application number 061117-24
in the memo portion of the check to ensure proper crediting of the fee.
6. As previously requested, please reduce the preempted area of the proposed
docking facility to comply with subsection 18-21.004(4), F.A.C. The
applicant's December 13, 2006 submittal indicates a shoreline of 410 feet.
The applicant's March 8, 2007 response indicates the area of main pier and
finger piers to be 7,310 square feet and incorrectly states the "area-shoreline
ratio =17.8 to 1". Please be advised, pursuant to subsection 18-21.003(40),
F.A.C. preempted area not only includes the area of the proposed dock, but
also includes any other area where traditional public use will be excluded by
the project, such as the slips occupied by moored vessels. At 40 square feet
per linear foot of shoreline, the project qualifies for a preempted area of
16,400 square feet. As previously requested, please provide a signed and
sealed plan-view drawing that labels the length of shoreline owned by the
applicant at the project site and the preempted area of the proposed
submerged lands lease (proposed lease area), including the area of all slips
as well as the area preempted by proposed structures.

7. Drawings submitted on December 13, 2006 indicate the applicant owns 410
linear feet of riparian shoreline. The project is located within Palm Beach
County, which does not currently have an approved manatee protection plan
in place. In the interim, guidance from the Florida Fish and Wildlife
Conservation Commission, Imperiled Species Management Section indicates
that the applicant must control 100 feet of shoreline per slip to protect
manatee populations from increased boat traffic. As previously requested,
please describe how the project will meet the current FWC, Imperiled Species
Management Section's requirements.
8. Please provide revised plan view and cross sectional drawings incorporating
the requested reduction in preempted area, reduction in the number of slips
and other requested modifications to the proposed project.
9. The elevations shown on the topographical survey indicate that some outside
runoff from the property located on the southwest corner of the project may

currently be discharging into the project's site. Any offsite runoff needs to be
accounted for in the drainage calculations and the proposed surface water
management system for the site. Please address and indicate what
mechanism will be used to accept the offsite runoff into the proposed surface
water management system for the project.
10. The cross sections details provided on the plans (Cross Sections 8-8, C-C,
0-0, and E-E) indicate that the masonary wall is proposed outside the project
right-of-way. If the walls are proposed as part of this project they should be
located within the project boundary, Please revise the drainage plans to
account for this correction. Please provide the top elevation of the walls on
the plans.
11 . Details for C8#8A do not show the weir crest elevation. Please provide the
width and elevation of the weir crest on the plans.
12. Please provide flood routing calculations for the 5-year 1-day, 1 a-year 1-day,
and the 25-year 3-day with discharge. Please demonstrate that the post
discharge rate for the 25-year 3-day storm event will not exceed the pre-
development discharge rate.
13. Please provide a copy of the HOA document when it becomes available.
In accordance with 40E-1.603(1)(c), FAC, if the information is not received within
30 days of this date, to render the application complete, the application may be
processed for denial if not withdrawn by the applicant. Please attach a copy of
the enclosed "Transmittal Form for Requested Additional Information" to each of

SEAGRASS SURVEY

INTRODUCTION
Ibis Environmental, Inc. was retained by SEA Diversified Inc., to conduct a
benthic resource survey at a vacant parcel located within the Lake Worth Lagoon
Section 2, Township 45 S, Range 35 E, adjacent to Lake Drive North in Hypoluxo,
Palm Beach, Florida. The purpose of the survey is to identify and map submerged
resources within the proposed project area. The results of our site inspection are
described herein and on the enclosed Seagrass Map.
METHODOLOGY
Ibis staff conducted a field evaluation of the site on April 28th and May 1st
2006. The boundaries of the survey were as depicted on the attached Seagrass
Map. Ibis assessed the survey area with the use of snorkeling equipment. Random
serpentine transects were swum throughout the entire survey area. Areas that
contained benthic resources were investigated in greater detail. Seagrass species
and their locations were marked and recorded.
SURVEY RESULTS
The survey was conducted during a high tide with an outgoing current on the
first field day and a low tide on the second. Water temperatures were in the mid-
seventies. Water visibility was fair (2-3 feet). The weather on the first day of work
was partly cloudy with high winds blowing on shore out of the northeast. Weather
conditions on the second day of work were sunny with a light off shore breeze.
There was relatively little boat traffic in the survey area, with the exception of an
occasional craft entering or exiting the adjacent marina. The property is a vacant
parcel with an abandoned house located on the north peninsula of the property. A
seawall surrounds the northern portions of the property and extends southward

along the property line to an outfall pipe. At this point the shoreline is stabilized
with rip rap. The seagrass survey area also includes the shorelines and waterward
extents of the two single family homes to the south. The vegetation on the property
consists mostly of herbaceous plants typically found in disturbed areas.
Several bottom types exist throughout the survey area. The area adjacent
and to the north of the outfall pipe consists of fine sand that has created a small
beach area waterward of the bulkhead. The sand continues east from the outfall
pipe creating a shoal that is exposed at low tide. A bottom type of course sand and
shell hash continues from the shoal area to approximately 150 ft waterward of the
shoreline. The remaining areas consisted of deeper water with more significant
current influences. The bottom type in these areas tended to be hard sand with a
fine layer of silt deposits.
As displayed on the Seagrass Map, approximately 10% of the survey area is
composed of a continuous bed of shoal grass (Ha/odu/e wrightil). Aerial coverage of
seagrass within this bed is patchy throughout the waterward limits with less than
5% coverage. The landward portions of the bed follow the contour where the
course sand bottom type begins. Seagrasses in this area have a more concentrated
distribution with some areas containing as much as 20%-30% aerial coverage.
Portions of the landward edge also contain significant amounts of Ha/ophi/a
johnsoniimixed in with the shoal grass. The northern most extent of the bed
contains small amounts of Ha/ophi/a decipiens scattered among the shoal grass.
Several small patches of seagrass were found east of the main bed. The patches
have varying composition and distribution and were not found to be connected to
any larger seagrass bed. These patches are depicted on the attached seagrass map.
The depths east of the seagrass locations were significantly deeper than the
inshore areas. Much of the waterward survey area was at depths of 6.0-8.0 ft.
during low tide. Seagrasses rarely grow at such depths in water with low visibility.
With poor water clarity, depths greater than 5.0 ft. limit light availability to the
seagrasses. The seagrass bed itseif was found to be in reiativeiy heaithy condition.
Some areas of the eastern portion of the bed were found to be covered in a light
layer of silt and some were significantly covered with filamentous algae.
A significant amount of marine life was observed within the survey area.
Schools of mullet, sardines, and other bait fish were observed during both field
visits. Several sheepshead were found using piling remnants within the survey area
for refuge. Within the H. wrightii bed, staff observed several large southern
stingrays, as well as mating horseshoe crabs. Shorebirds such as killdeer, terns, and
a little blue heron utilized the exposed shoal for foraging purposes during low tide.
There were no threatened or endangered wildlife species observed during either
field visit.

CONCLUSION
,
Permits from the Florida Department of Environmental Protection (FDEP), the
Army Corps of Engineers (ACOE), and Palm Beach County will be required for dock
construction. The presence of seagrasses will need to be considered when
designing the docking facility for the proposed project. Any docking facilities
originating from the southern property boundary will likely need to extend in excess
of 200.0 ft. waterward of the shoreline in order to obtain sufficient depths for
ingress and egress, as well as mooring. Specific walkway construction requirements
must be followed for any structures passing over seagrasses. Also, the agencies will
likely require consideration of endangered and threatened species, including the
manatee, when permitting this project. The draft Palm Beach County Manatee
Protection Pian should also be consulted with respect to creating a construction plan

Dear Mr. Fakhoury:
On behalf of Lancore Nursery, LLC, Sea Diversified, Inc., received your Request for Additional
Information (RAI), dated January 12, 2007. A subsequent meeting was held at SFWMD between
the owner, engineer, consultant, and SFWMD staff to discuss and resolve the requested items.
Based on this meeting, the following response is hereby submitted
1. Please be advised that the required permit processing fee for an individual
Environmental Resource Permit (non-agricultural) is $5,000.00, for a project between
1 and 100 acres and more than 9 boat slips. The applicant's original submittal
included a check for $2,000. Please submit a check for the outstanding $3,000.00
balance in order to allow processing of this application to continue.
The requested balance of the application fee has been submitted directly from the applicant.
2. The revised application proposes a 568.5 foot long, T-shaped dock with 18 finger
piers providing a total of 38 proposed slips on the T-shaped dock. The revised
submittal also includes an 8 foot wide marginal dock along the riparian shoreline of
the project site and includes dredging a basin adjacent to the marginal dock to -5
feet MLW, which is labeled for use by an indeterminate number of personal
watercraft and kayaks. The T-shaped dock is comprised of a 6 foot by 560.5 foot
access walkway over seagrasses to an 8 foot by 76 foot terminal platform that
includes a wave attenuatar extending below the dock to 1.5 feet above the seabed.
Please revise the proposed dock configuration to significantly reduce the amount of
shading resulting from the dock and associated mooring of vessels.
After detailed discussions with SFWMD staff, the configuration of the docks has been minimized,
as requested and agreed. It was concluded that the marginal walkway would have no shading

impacts, as this structure is proposed above the mean water line. The dock structure was
extended to the 25% width of waterway limit in order to move the mooring areas as far from the
documented seagrass beds as possible. The railings, no mooring signs, and grated decking were
expanded to include the entire access walkway and not just the areas directly over the seagrass
beds in order to protect adjacent areas that may become future habitat.
3. New dredging is proposed in the December 13, 2006 submittal within 10 feet of
seagrasses, which may result in direct, secondary and cumulative impacts to
seagrass resources and seagrass habitat. Please consider eliminating the proposed
dredging component of the project. If dredging is not eliminated, please provide an
explanation why dredging is necessary and why the impacts cannot be avoided.
Discussions with SFWMD staff led to considerations of dredging to a reduced depth, dredging a
smaller footprint, and dredging as restoration I mitigation. After consideration of these options, the
client has agreed to accept the request of SFWMD and eliminate the dredging component of this
project altogether. Please note, sheets 4.1 and 4.2 of the permit drawings have been eliminated.
4. The seagrass survey report submitted on December 13, 2006 appears to be
inconsistent with information reviewed in other projects within the vicinity of the
Lancore Nursery parcel, specifically the seagrass survey report does not indicate
seagrass resources in the northern and northeastern portions of the survey area,
where extensive seagrasses were observed in surveys conducted for the Gateway
Marina project reviewed by the Florida Department of Environmental Protection,
Southeast District office. In order to provide reasonable assurances that adverse
direct, secondary and cumulative impacts to seagrass resources do not result from
this project, please coordinate a site visit with staff from the District, the U.S. Army
Corps of Engineers and FWC during the 2007 seagrass growing season to assess
the likely effects of the proposed facility on seagrass resources. Please be advised,
a new benthic resource survey conducted during the 2007 seagrass growing season
may be needed to fully assess the environmental effects of the proposed project on
jurisdictional resources.

The first seagrass survey in the vicinity of this project was conducted during the 2004 seagrass
growing season by Dan Moss, Sea Diversified, Inc., for adjacent project(s). Because this
application was being submitted in 2006, a new seagrass survey was conducted by Jena Myer,
Ibis Environmental, who has regularly conducted these investigations for SFWMD.
I n comparison of the two surveys, the most dynamic changes appeared in the nearshore area,
where severe accretion has been occurring, unchecked, from a variety of factors, including
shoreline erosion, outfall sedimentation, and littoral deposition. In the two years between
observations, between two (2) and ten (10) feet of seagrass beds have receded.
In relation to the Gateway project to the north, the survey area for this Lancore project did not
extend that far northward, as the Gateway project is not adjacent to the Lancore property, but
farther north. The boundary for the current benthic survey is identified on sheet 2 of 5.
It should also be noted that the earlier survey in 2004 did not identify the eastern limits of seagrass,
as it was a nearshore survey intended for the adjacent single-family docks to the south. The
recent survey in 2006 did identify these limits and extended well beyond the project area (sheet 2).
We would be willing to meet onsite to observe the seagrasses again. However, the client should
not be required to bear the expense of another seagrass survey, when the 2006 survey should be
adequate for an application submitted in 2006.
5. Please clarify the number of personal water craft vessels proposed at the project
location. Please be advised, each personal water craft will be counted as a proposed
slip for purposes of FWC's manatee review and in the District's review of sovereign
submerged lands authorization.
After discussion with SFWMD, the personal watercraft area has been eliminated.
6. Per Section 40E-4.101 of the Florida Administrative Code (F.A.C.) "A permit shall only
be issued to the record title holder, holder of a recorded easement conveying the
right to utilize the property for a purpose consistent with the authorization requested
in the permit application, those having the right to exercise the power of eminent

domain or having a contract to purchase real property." As previously requested,
please provide the corresponding ownership information indicating the entities
which own the parcel or alternatively the entity(s} that it possesses and executed
contract for the properly.
A copy of the warranty deed identifying Lancore Nursery LLC, as the owner is attached.
7. Please provide a detailed statement describing the existing and proposed activities
located at the project site. This statement must include a description of docks and
piers, types of vessels (e.g., commercial fishing, liveaboards, cruise ships, tour
boats) sewage pumpout facilities, fueling facilities, boatlifts, boat ramps, travel lifts,
railways, and any other structures or activities existing or proposed. Indicate the
total number of slips existing and proposed and the percentage of those slips
available to the general public on a tlfirst come, first served" basis. [See 18-21.011,
F.A.C.] Note: if fueling facilities are planned over water, you are required to submit
an oil spill containment and contingency plan. If liveaboards will be allowed, please
state how many slips.
Proposed activities at this site include residential development and a docking facility. Existing use
is a nursery. One walkway is proposed marginally along the bulkhead for pedestrian use. An
access pier is proposed connecting the uplands with the proposed docking area. This docking
area is proposed to include (23) 30-foot slips, (14) 40-foot slips, and one (1) transient slip at the
end T-dock. Drafts of the vessels are expected to average 2.5 feet. Slips are intended to be
offered to the public on a first come, first served basis.
No commercial vessels, including fishing, cruise ships or tour boats are proposed. Liveaboards will
not be permitted. There are no proposed fueling facilities, boat ramps, travel lifts, or railways. A
sewage pumpout system is proposed, as recommended by the Florida Department of
Environmental Protection (FDEP), as part of the Clean Marina Program. Individual boatlifts are not
currently proposed, but may be added once the project is open to the public. If added, a new
application would be submitted.

8. The plan view drawing in the original submittal shows a drainage easement and an
existing 18" pipe extending into Lake Worth Lagoon. Since the surlace water
management system is being revised at this site, please describe measures
proposed to ensure any discharge will meet state water quality standards and will
not cause harmful erosion or shoaling. Please clarify whether there is an exclusion
gate on this pipe to ensure manatee protection and provide a detail of the grate.
As we discussed, this discharge pipe and its associated upland components are, to our knowledge,
owned and maintained by the Florida Department of Transportation (FDOT). The client will attempt
to contact the FDOT regarding this matter. At the same time, SFWMD agreed to look into this
issue directly with the FDOT.
9. The seagrass survey submitted on December 13, 2006 indicates "heavy accretion
from outfall" in the nearshore area of the proposed docking facility, which may be
affecting seagrass habitat in the project area. Aerial photos show an apparent
alluvial pattern of deposition in this area. Please describe measures proposed to
eliminate the potential adverse effects of the existing outfall discharge. Measures
considered in other similar projects include retrofitting and regular maintenance of
sediment catch basins on pipes discharging to seagrass habitats.
As noted above, this outfall is owned and maintained by the FDOT.
10. Please describe measures proposed to ensure long term adverse impacts to water
quality do not result from this project. Indicate if liveaboard vessels, sewage pump-
out facilities, fueling facilities, fish cleaning stations, floating platforms or boat lifts
are proposed.
Adverse impacts to water quality will be avoided by prohibiting fish-cleaning stations, vessel
maintenance, painting, and other activities over water. Liveaboard vessels and commercial
vessels are not proposed. No floating platforms and no fueling facilities are proposed. A sewage
pumpout facility servicing every slip is proposed to further protect water quality.

11. Please provide a map indicating the locatiorro of any existing boat ramps in the area,
and indicate the feaSibility of the applicant using those existirng facilities for persona!
water craft and other appropriate sized vessels.
A new permit sketch, sheet 1A, is attached indicating the nearest, public boat ramps. The Boynton
Boat Club Park ramps are situated approximately 3,000 feet to the south and will be available for
the personal watercraft, which have been removed from this project per discussions with SFWMD.
12. The application has been forwarded to the DEP, Division of State Lands for a title
determination on the submerged lands. The project as proposed may require a
sovereign submerged lands lease. If a lease is required, the following information
will be needed to process the lease: [refer to RAIJ
Once SFWMD receives the title determination and relays this information, we can proceed to
prepare the additional documentation for a sovereign submerged lands lease, if required.
13. The processing fee collected by the District for a submerged lands lease is $200.00.
If a lease is required, please submit a check payable to the South Florida Water
Management District for $200.00. Include the application number 061117-24 in the
memo portion of the check to ensure proper crediting of the fee.
Once SFWMD receives the title determination and relays this information, we can proceed to
prepare the additional documentation for a sovereign submerged lands lease, if required.
14. Based on the information submitted with the application, the proposed marina
project is considered a multi-family residential docking facility as described in
subsection 18-21.004(4), F.A.C. The proposed multi-family docking facility is subject
to the limitation of preempted area of no more than 40 square feet per linear foot of
shoreline. Please provide a signed and sealed plan view drawing that labels the
length of shoreline owned by the applicant at the project site and the preempted area
of the proposed submerged lands lease, including the area of all slips as well as the
area preempted by proposed structures.

15. Drawings submitted on December 13, 2006 indicate the applicanf owns 410 Din ear
feet of riparian shoreline. The project is located within Palm Beach County, which
does not currently have an approved manatee protection plan in place. In the
interim, guidance from the Florida Fish and Wildlife Conservation Commission,
Imperiled Species Management Section indicates that the applicant must control 100
feet of shoreline per slip to protect manatee populations from increased boat traffic.
Please describe how the project will meet the FWC, Imperiled Species Management
Section's requirements.
As evident at our meeting, the owner understands these stipulations. The project is designed to
meet the requirements of the Palm Beach County Manatee Protection Plan (MPP) in its
anticipated, draft form. Once the MPP is adopted, changes, if any, will be addressed at that time.
16. Please clarify the box on drawing 3.1 of 5 which includes the caption IIproposed
personal water craft area." Is this a proposed structure? If so please provide a
description of the structure and dimensions on the plan view drawing.
After discussion with SFWMD, the personal watercraft area has been eliminated.
17. Based on depth contours shown on project plans, it appears slips are proposed in
depths less than -4 feet MLW. In order to prevent prop dredging, please revise the
project to eliminate slips with depths less than -4 feet MLW.
Based on the recommendations provided by SFWMD, the project has been minimized, including
the relocation of the mooring areas eastward. The revised proposal does not have any slips
proposed in water depths less than -4 feet MLW.
18. Please clarify the dashed lines shown extending waterward of the existing bulkhead

All drawings have been revised pursuant to the request of SFWMD, based upon our meeting,
discussions, and this response. The new drawings (attached) should replace the original set in its
entirety to avoid any potential confusion.
Questions 20 through 30 are regarding the upland components of this project. These
requests have been answered and prepared by Flynn Engineering Services, P.A., and
are attached with this response.

facility associated with the condominiums proposed on the uplands. Please be
advised that staff has serious concerns that potential direct, secondary and
cumulative impacts to seagrasses and seagrass habitats have not been
eliminated or reduced to the greatest extent practicable as required in the
District's Basis of Review. The District cannot support the dredging of seagrass
habitats and placement of docking facilities and boat slips over seagrasses and
seagrass habitats that _are expected to cause adverse direct, secondary and
cumulative impacts and therefore cannot recommend approval of the project as
currently proposed. Before expending significant time and money on the current
proposal and responding to the questions in this letter, the applicant should
consider a smaller docking facility with many fewer slips in a configuration that
eliminates direct, secondary and cumulative resource impacts.
In the event that the applicant wishes to continue pursuit of this application, the
District is requesting the following information needed to complete the application
pursuant to Rule 40E-4, Florida Administrative Gode (FAG):
1. Please be advised that the required permit processing fee for an individual
Environmental Resource Permit (non-agricultural) is $5,000.00, for a project
between 1 and 100 acres and more than 9 boat slips. The applicant's original
submittal included a check for $2,000. Please, submit a check for the
outstanding $3,000.00 balance in order to allow processing of this application
to continue.

2. The revised application proposes a 568.5 foot long, T-shaped dock with 18
finger piers providing a total of 38 proposed slips on the T-shaped dock. The
revised submittal also includes an 8 foot wide marginal dock along the
riparian shoreline of the project site and includes dredging a basin adjacent to
the marginal dock to -5 feet MLW, which is labeled for use by an
indeterminate number of personal water craft and kayaks. The T -shaped dock
is comprised of a 6 foot by 560.5 foot access walkway over seagrasses to an
8 foot by 76 foot terminal platform that includes a wave attenuator extending
below the dock to 1.5 feet above the seabed. Please revise the proposed
dock configuration to significantly reduce the amount of shading resulting
from the dock and associated mooring of vessels.
3. New dredging is proposed in the December 13, 2006 submittal within 10 feet
of seagrasses, which may result in direct, secondary and cumulative impacts
to seagrass resources and seagrass habitat. Please consider eliminating the
proposed dredging component of the project. If dredging is not eliminated
from the project, please provide an explaination why dredging is necessary
and why the impacts cannot be avoided.
4. The seagrass survey report submitted on December 13, 2006 appears to be
inconsistent with information reviewed in other projects within the vicinity of
the Lancore Nursery parcel, specifically the seagrass survey report does not
indicate seagrass resources in the northern and northeastern portions of the
survey area, where extensive seagrasses were observed in surveys
conducted for the Gateway Marina project reviewed by the Florida
Department of Environmental Protection, Southeast District office. In order to
provide reasonable assurances that adverse direct, secondary and
cumulative impacts to seagrass resources do not result from this project,
please coordinate a site visit with staff from the District, the U.S. Army Corps
of Engineers and FWC during the 2007 seagrass growing season to assess
the likely effects of the proposed facility on seagrass resources. Please be
advised, a new benthic resource survey conducted during the 2007 seagrass
growing season may be needed to fully assess the environmental effects of
the proposed project on jurisdictional resources.
5. Please clarify the number of personal water craft vessels proposed at the
project location. Please be advised, each personal water craft will be counted
as a proposed slip for purposes of the FWC's manatee review and in the
District's review of sovereign submerged lands authorization.
6. Per section 40E-4.101 of the Florida Administrative Code (F.A.C.) "A permit
,shall only be issued to the record title holder, holder of a recorded easement
conveying the right to utilize the property for a purpose consistent with the

authorization requested in the permit application, those having the right to
exercise the power of eminent domain or having a contract to purchase real
property." As previously requested, please provide the corresponding
ownership information indicating the entities which own the parcel or
alternatively the entity(s) that it possesses an executed contract for the
property.
7. Please provide a detailed statement describing the existing and proposed
activities located at the project site. This statement must include a description
of docks and piers, types of vessels (e.g., commercial fishing, Iiveaboards,
cruise ships, tour boats), sewageupurnpouUacllitLe_~, fueling facilities, boatlifts,
boat ramps, travel lifts, railways, and any other structures or activities
existing or proposed. Indicate the total number of slips existing and
proposed and the percentage of those slips available to the general public on
a "first come, first served" basis. [See 18-21.011, F.A.C.] Note: If fueling
facilities are planned over water, you are required to submit an oil spill
containment and contingency plan. If liveaboards will be allowed, please state
how many slips.
8. The plan view drawing in the original submittal shows a drainage easement
and an existing 18" pipe extending into Lake Worth Lagoon. Since the
surface water management system is being revised at this site, please ~,
describe measures proposed to ensure any discharge will meet state water
quality standards and will not cause harmful erosion or shoaling. Please
clarify whether there is an exclusion grate on this pipe to ensure manatee
protection and provide a detail of the grate.
9. The seagrass survey submitted on December 13, 2006 indicates "heavy
accretion from outfall" in the nearshore area of the proposed docking facility,
which may be affecting seagrass habitat in the project area. Aerial photos
show an apparent alluvial pattern of deposition in this area. Please describe
measures proposed to eliminate the potential adverse effects of the existing
outfall discharge. Measures considered in other similar projects include
retrofitting and regular maintenance of sediment catch basins on pipes
discharging to seagrass habitats.
10. Please describe measures proposed to ensure long term adverse impacts to
water quality do not result from this project. Indicate if liveaboard vessels,
sewage pump-out facilities, fueling facilities, fish cleaning stations, floating
vessel platforms or boat lifts are proposed.
11. Please provide a map indicating the location of any existing boat ramps in the
area, and indicate the feasibility of the applicant using those existing facilities
for personal water craft and other appropriate sized vessels.

12. The application has been forwarded to the DEP, Division of State Lands for a
title determination on the submerged lands. The project as proposed may
require a sovereign submerged lands lease. If a lease is required, the
following information will be needed to process the lease:
-Satisfactory evidence of title in the applicant's riparian upland property.
-Two prints of a survey prepared, signed and sealed by a person properly
licensed by the State of Florida Board of Land Surveyors with the following
details shown:
A.The location of mean high water (MHW).
B.The location and dimensions of existing and proposed structures.
C.The location of the applicant's upland property lines and the length of
shoreline within the applicant's ownership.
D. The location of the primary navigation channel.
E. The distance between the waterward limits of the docking facility and
the near edge of the ICWW navigational channel.
F. Documentation that the docking facility does not extend more than 25%
of the width of the waterway. .
E. A legal description of the preempted area to be leased (please refer to
the definition in Rule 18-21.003, FAG).
-Current local zoning and status of any other government approvals
necessary for the proposed activities.
-Florida Department of Revenue registration number. - Leases without sales
tax exemption certificate shall be subject to Florida sales tax.
-Computation of the lease fee, including the total square footage of
preempted sovereignty land to be leased (refer to Rule 18-21.011, FAC).
-A completed billing information form (refer to the attached copy).
- A list of names and addresses of all property owners within a 500' radius of
the proposed new lease area, which has been verified by the Gounty Property
Appraiser's Office that these names came from the latest tax assessment
rolls.
-A draft notice including the location of the project and proposed square
footage of the lease area to the District for review. Include a plan view
drawing of the proposed lease area and all adjacent shorelines. Once
reviewed and approved by the District you may send the notice by certified
mail to each individual on the list of adjacent property owners in accordance

13. The processing fee collected by the District for a submerged lands lease is
$200.00. If a lease is required, please submit a check payable to the South
Florida Water Management District for $200.00. Include the application
number 061117-24 in the memo portion of the check to ensure proper
crediting of the fee.
14. Based on the information submitted with the application, the proposed
marina project is considered a multi-family residential docking facility as
described in subsection 18-21.004(4), F.A.C. The proposed multi-family
docking facility is subject to the limitation of preempted area of no more than
40 square feet per linear foot of shoreline. Please provide a signed and
sealed plan-view drawing that labels the length of shoreline owned by the
applicant at the project site and the preempted area of the proposed
submerged lands lease, including the area of all slips as well as the area
preempted by proposed structures.
15. Drawings submitted on December 13, 2006 indicate the applicant owns 410
linear feet of riparian shoreline. The project is located within Palm Beach
County, which does not currently have an approved manatee protection plan
in place. In the interim, guidance from the Florida Fish and Wildlife
Conservation Commission, Imperiled Species Management Section indicates
that the applicant must control 100 feet of shoreline per slip to protect
manatee populations from increased boat traffic. Please describe how the

project will meet the FWC, Imperiled Species Management Section's
requirements.
16. Please clarify the box on drawing 3.1 of 5 which includes the caption
"proposed personal water craft area". Is this a proposed structure? If so
please provide a description of the structure and dimensions on the plan view
drawing.
17.Based on depth contours shown on project plans, it appears slips are
proposed in depths less than -4 feet MLW. In order to prevent prop dredging,
please revise the project to eliminate slips with depths less than -4 feet MLW.
18. Please clarify the dashed lines shown extending waterward of the existing
bulkhead north of the northern project riparian line shown on drawing 3.2 of 5.
19. Please provide revised plan view and cross sectional drawings incorporating
the requested modifications to the proposed project.
20. As previously requested, please provide a separate topographical survey for
the site extending at least 100 feet outside the property line.
21.As previously requested, please clearly demonstrate that the project is not
currently receiving runoff from adjacent projects. If the project is currently
receiving offsite runoff, then the surface water management system for the
project must be designed to accommodate any offsite runoff. Please provide
calculations as needed.
22.As previously requested, the post development calculations indicate that the
25-year 3-day stage will be higher than the adjacent sites. Please indicate if
a berm at or higher than the 25-year 3-day stage is proposed for the project.
If so, please show the berm on the plans and provide cross sections at
different locations. Please show all elevations and dimensions on the cross
sections.
23.As previously requested, please provide a complete schedule for the
stormwater sewer system. In addition, please provide additional proposed
grades for the project.
24. Plan sheet C5.1 shows details for a Control Baffle and it's labeled "Control
Baffle (Inside CB# 15). However, plans C3.1 and C4.1 have some the inlets
labeled as CB #1 and the rest are not labeled. As previously requested,
please provide appropriate labeling for the inlets and indicate inside which
inlet the baffle is proposed.

25. The maximum volume exfiltrated through the trenches that can be used in the
stage-storage calculations is 3.28 inches times the project area. In this
project this volume is calculated to be 1.1 acre-feet. This storage volume is
obtained at the top of the trench (5.00 feet NGVD). The calculations indicate
that the entire 1.1 acre-feet storage volume was obtained at 3.00 feet NGVD
which is 2 feet below the top of the trench. Please revise the stage-storage
calculations for the exfiltration trenches and prorate the 1.1 acre-feet from
elevation 2.00 to elevation 5.00 feet NGVD linearly. As previously requested,
please, revise the flood routing calculations and the surface water system's
design accordingly.
26. The plans show a 15-foot drainage easement with a pipe discharging from
U.S. 1 to the Lake Worth Lagoon. As previously requested, please indicate
how the easement will be impacted as a result of the proposed project and
indicate if an authorization for any proposed impacts has been obtained from
the D.G.I. Please address.
27.As previously requested, please indicate if onsite consumptive water use
withdrawals for dewatering or irrigation are proposed for which a District
Water Use permit is required. The environmental resource and water use
permits must be processed simultaneously (Basis of Review, Section 3.2).
Please indicate the status of any proposed dewatering/irrigation permits
intended to address the consumptive use of water. Please contact the
District's Water Use Division at 1-800-547-2694 with any questions regarding
the water use permitting process.
28.As previously requested, please indicate the entity responsible for the
operation and maintenance of the surface water management system for the
project. Will the project have a property/homeowners association? If so,
please provide a draft copy of the property/homeowners association
document.

29. As previously requested, please clarify whether dewatering is proposed
during any project construction activities. As you may be aware, the District
requires a water use permit for short-term dewatering activities unless the
work qualifies for a "No Notice Dewatering Permit" pursuant to 40E-20.302(3),
F.A.C. If a dewatering permit is required, staff will process these applications
concurrently and recommend final agency action when both applications are
complete. Please coordinate with the SFWMD Water Use Division at 1-
800547-2694 regarding the water use permit for dewatering.
30. As previously requested, please identify the potable water and waste water
suppliers for the proposed project and provide letters of commitment from the
suppliers.

Advisory Comments:
The following comments are advisory and do not require a response from the
applicant. However, this information should be considered to assist in
developing a permittable project.
1. Please indicate the project's review status by the U.S. Army Corps of
Engineers.
2. Included with this letter/permit is a brochure from the Florida Department of
Environmental Protection (DEP) on Florida's National Pollutant Discharge
Elimination System (NPDES) program for construction activities.
As the brochure indicates, the U.S. Environmental Protection Agency
authorized the DEP in October 2000 to implement the NPDES stormwater
permitting program in Florida. The District is assisting DEP by distributing this
information to entities which may be subject to regulation under the NPDES
program. No response to the District is required.
A "Generic Permit for Stormwater Discharge For Stormwater Discharge from
Large and Small Construction Activities (CGP) is required for a construction
activity which contributes stormwater discharges to surface waters of the
State or into a municipal separate storm sewer system. Phase I regulates
"large" construction activity (disturbing five or more acres of total land area)
and Phase" regulates "small" construction activity (disturbing between 1 and
5 acres of total land area).
The permit required under DEP's NPDES stormwater permitting program is
separate from the Environmental Resource Permit required by the District.
Receiving a permit from the District does not exempt you from meeting the
NPDES program requirements.
If you have any questions on the NPDES program, there are DEP phone
numbers, mailing addresses and internet web page addresses in the brochure.
The DEP web site, at www.dep.state.fl.us/water/stormwater/npdes/. provides
information associated with the NPDES program including all regulations and
