In response to your request dated December 8, 2006 for the
administrative review and approval of the modifications proposed to
the above-referenced approved site plan, depicting the following:
. Modification of Building D - Linens n Things - to accommodate a
trash compactor next to the loading dock (as depicted on the
attached plan) .
. Addition of compactor and loading zone on the south side of
Building F (as depicted on the attached plan) .
. Addition of parking spaces along the NE corner of Target (as

the southeast corner of Building "F" will be accepted, it is being
noted that the approach to the compactor enclosure overlaps the
loading area and may impact the ability of Solid Waste to pick up
if the loading zone is in use, which may inconvenience your tenant.
2. Rotate the dumpster enclosure northeast of Building "J" so that it
is opens to and is approached from the southeast. As currently
depicted solid waste trucks may be required to back into the main
drive between Buildings "H" and "J".
3. Several areas of potential conflict have been noted on the partial
set of landscape plans provided. In general, palm trees will be
the only tree species allowed within utility easements. Canopy
trees must be planted outside of the easement so that roots and
branches will not impact utilities within the easement. Conflicts
were noted in the landscape island northeast of Building "L" (Live
Oak v. water main), third landscape island, north of the northeast
corner of Building "H-1" (Tibouchina v. water main), and long
island north of Buildings "F" and "G" ((Tibouchina v. sewer main.).
Submi t revised plans for the City Forester and Senior Engineer
review at time of permitting.
4. The lift station will require landscape screening, planted a
minimum of one-half the wall height, at the time of planting.
5. A separate Minor Site Plan Modification approval will be required
for Building H and the 16 dwelling units. Approval of this Minor
Modification in no way implies the City's approval of the areas
encompassed by Building H, the area north of the roundabout and the
building proposed to contain the 16 dwelling units.
6. please note that changes or revisions to these plans may generate
additional comments. Acceptance of these plans during the minor
site plan modification review process does not ensure that
additional comments may not be generated at permit review.

The above referenced Site Plans, received on 6/05/07, were reviewed against the 1st Review Comments
provided to the P&Z Dept.12/18/06. Following are our revised comments:
PUBLIC WORKS - SOLID WASTE
1. While the location of the new trash compactor and loading area at the southeast corner of Building
"F" will be accepted it is being noted that the approach to the compactor enclosure overlaps the

SMU Parcel submittal

Dear Mr. Breese:
As per our previous discussions, we are submitting our responses to comments to
the SMU Parcel for the above referenced submittal. The previous SMU and C3
parcel submittals were filed under the same MMSP No 07-011. We have already
submitted a separate application for the C3 parcel. For the SMU parcel, we will
maintain the same applications number.
Our responses to comments are as follows:
1. With respect to the new trash compactor and loading area at the southeast
corner of Building "F" - the approach to the compactor enclosure overlaps
the loading area. Please be advised this may impact the ability of Solid Waste
to pick up if the loading zone is in use. It is recommended that there be no
overlap of the two uses to resolve this conflict.
The proposed configuration for the compactor and loading area was discussed
with Staff prior to implementation. Due to several restrictions as to the
placement of the loading area and compactor, it was determined this would be
the best alternative. The parking calculations at the time also indicated that we
could not afford to loose additional spaces or we would fall below the City's
parking requirements. Several other alternatives were looked at prior to arriving
at the current configuration. Loading zone was originally proposed on the
eastern side of building F, but was rejected. We then relocated the loading zone
to the current location, but with the compactor opening to the SE and parallel
parking spaces east of the building, but that configuration was rejected. Finally,
after discussions between City staff and Mr. Brad Jacobs with Sembler, parallel

parking spaces east of the building were removed, compactor opening changed
to the SW and loading zone located just west of the compactor. We ask the City
to reconsider comment and allow configuration as show on plans.
2. Rotate the dumpster enclosure northeast of Building "J" so that it opens to
and is approached from the southeast.
Please, see response to comment No.1. As indicated by previous staff
comments, the dumpster truck can not back-up into main driveways. That was
the reason why we rotated the opening of the compactor from its original
opening to the southeast, to the southwest. In order to make the suggested
opening work, we would have to shift the dumpster enclosure to the west in
order to allow for a 60' back-up distance for the truck, without encroaching on
the main drive. This would push back the compactor enclosure and the loading
zone to the west, were it would become an obstruction to the fayade of the
building as well as reduce the number of parking spaces significantly.
3. Reduce the amount of lighting depicted on the north side parking lot of
Linens-N- Things, as there are hot spots depicted on the photometric plan.
Lighting in this area has been reduced as requested. Please, refer to sheet SL- I.
4. A lift station now appears along the spine road and no orientation or
landscaping has been depicted with it. Please provide greater detail.
The proposed lift station has always been part of the construction documents.
Per coordination with the City's Engineering Division, Planning and Zoning
Division and Utilities Department, the proposed lift station enclosure will
consist of an 8' high CMU block wall. The lift station enclosure has been
constructed as of this date, and has been approved by the Utilities Department.
5. The fountain depicted in the easternmost truffic circle will not be allowed due
to utilities located beneath it. Staff recommends relocating the fountain to the
westernmost traffic circle or re-adjusting the utility runs.
Fountain has been relocated to the western roundabout. Gazebo previously
proposed on the western roundabout is now proposed on the eastern roundabout.
We provided gazebo details and proposed location information to the Utilities
Department staff and the new location of gazebo has been approved.
6. As discussed previously, Staff is looking to create more of a gathering
area/public plaza and outdoor dining experience along the common areas on
the north side of the easternmost traffic circle. Rather than having covered
walkways, Staff envisions enlarged pavered spaces both along the eastern side

of Building Hand for a sizeable portion of the green space south of the
townhouse units, meandering down to the waters edge. In these areas should
be umbrella tables and chairs or some assortment of covered seating areas,
perhaps designed to capture the theme of the public area and/or building
fa~ade embellishments slated for the north side of Linens-N- Things. The
public should be able to take advantage of these areas for outdoor dining, for
entertainment purposes, or space to leisurely read the newspaper, people
watch or enjoy the water feature in the lake.
Building H, and the areas described in this comment, will be handled in a
subsequent Minor Modification submittal.
7. No landscape plans were submitted so that they could be evaluated for
potential conflicts with dumpster/compactor enclosure locations and utility
(water & sewer) mains and easements.
Landscaping plans have been included for review.
8. The submittal of revised landscape plans is a necessary part of the Minor Mod
submittal in order to accurately depict the landscape situation based upon
changes in building footprints and relocation of various site features.
Per previous conversations between our landscaping architect, Mr. Thomas
Lund and the City's Forester, Mr. Kevin Hallahan, and further information
provided by Mr. Brad Jacobs with Sembler, it was our understanding that the
City would not require any additional landscaping plans be submitted for Minor
Modification review. Minor changes to the landscaping plans would be
addressed via a "record drawing" set at the end ofthe project. We have now
included landscaping plans with this Minor Modification review submittal.
9. Correspondence submitted with the minor modification plans indicates that
the plans have been submitted and approved by the Deputy Director of
Utilities, Peter Mazella. Please provide a copy of the written approvalfrom
Mr. Mazzellafor the files.
We have provided the back-up documentation to Miss Laurinda Logan with the
Engineering Department as part of our response to comments for the C3 parcel.
To this date, the Health Department has issued a release on the water and sewer
system. Please, see attached Health Department release form and Utilities
Department form indicating they have reviewed and approved the system.
10. Palm Beach County Health Department permits may be requiredfor the water
and sewer system revisions.
Per conversations on 12/07/06 with Miss Tish Fox (561-355-3070 ext: 1135)
with Palm Beach County Health Department, the addition of grease traps to the
system (as required for restaurant uses) would not required a formal permit
modification request from the Health Department. Only requirement is to show
their location on the "as-built" drawings to be submitted for sanitary sewer
system certification.
11. The revision to any floor plans are not subject to Minor Mod review and
therefore have not been reviewed of approved.
Comment noted.
12. Although the submittal letter indicates color elevations were part of the
package, they were not submitted as part of this Minor Mod application.
We apologize for the confusion this statement may have caused. Building
elevations have been submitted separately for each building and are not required
for this submittal. Building H elevations will be submitted at the time of re-
submittal for Building H Minor Modification comments.
13. All comments requiring changes and lor corrections to the plans shall be
reflected on all appropriate sheets

14. Please note that changes or revisions to theses plans may generate additional
comments. Acceptance of these plans during the Minor Site Plan
Modification process does not ensure that additional comments may not be
generated at permit review.

After reading through FAC section 62-555.536, J gather that the type of changes that we have performed
on the site do not require a "construction permit modification". It seems though that we need to provide a
written notification of the changes to your department.
For your information, the changes performed where as follows:
· Shifted water mains in a couple of locations to accommodate shift in driveway and other utilities
- covered under FAC 62-555.520(1 )(c}3 and 62-555.536(1 )(a)2
· Shifted some valve locations due to conflicts in the field - covered under FAC 62-555.520(1 )(d)11
· Proposed grease traps for indiVidual services at restaurant locations - covered under FAC 62-
555.520(1 )(d)13
As per our previous conversations, these changes will be represented on the "as-built" drawings that will
be submitted for review by the City of Boynton Beach Utilities Department and Health Department.
Let me know if you need a "formal" written notification of the changes.

Staff has reviewed the revisions to the above-mentioned project, and as a result of our review, the
following comments and questions are being forwarded to you for your review and response:
SMU related comments:
With respect to the new trash compactor and loading area at the southeast comer of
Building "F" - the approach to the compactor enclosure overlaps the loading area. Please
be advised this may impact the ability of Solid Waste to pick up if the loading zone is in
use. It is recommended that there be no overlap of the two uses to resolve this conflict.
Rotate the dumpster enclosure northeast of Building "J" so that it is opens to and is
approached from the southeast.
Reduce the amount of lighting depicted on the north side parking lot of Linens-N-Things,
as there are hot spots depicted on the photometrics plan.
A lift station now appears along the spine road and no orientation or landscaping has been
depicted with it. Please provide greater detail.
The fountain depicted in the easternmost traffic circle will not be allowed due to utilities
located beneath it. Staff recommends relocating the fountain to the westernmost traffic
circle or re-adjusting the utility runs.
As discussed previously, Staff is looking to create more of a gathering area/public plaza
and outdoor dining experience along the common areas on the north side of the
easternmost traffic circle. Rather than having covered walkways, Staff envisions enlarged
pavered spaces both along the eastern side of Building H and for a sizeable portion of the
greenspace south of the townhouse units, meandering down to the waters edge. In these
areas should be umbrella tables & chairs or some assortment of covered seating areas,
perhaps designed to capture the theme of the public art and/or building fa9ade
embellishments slated for the north side of Linens-N-Things. The public should be able to
take advantage of these areas for outdoor dining, for entertainment purposes, or a space to
leisurely read the newspaper, people watch or enjoy the water feature in the lake.

C-3 related comments:
Revise the yellow lane separator at the driveway adjacent to the northeast comer of
Building "A" (Super Target) to line up with the roadway/aisle alignment. It may be
necessary to extend the length of the separator and curve it to accurately "inform" the
traveling public.
Sheet C3 indicates (in two separate places) the total square footage at 246,506, while
Sheet MSD depicts the total at 246,373.
General comments:
No landscape plans were submitted so that they could be evaluated for potential conflicts
with dumpster/compactor enclosure locations and utility (water & sewer) mains and
easements.
The submittal of revised landscape plans is a necessary part of the Minor Mod submittal
in order to accurately depict the landscape situation based upon changes in building
footprints and relocation of various site features.
Correspondence submitted with the minor modification plans indicates that the plans
have been submitted and approved by the Deputy Director of Utilities, Peter Mazzella.
Please provide a copy of the written approval from Mr. Mazzella for the files.
Palm Beach County Health Department permits may be required for the water and sewer
system revisions.
The revision to any floorplans are not subject to Minor Mod review and therefore have
not been reviewed or approved.
Although the submittal letter indicates color elevations were part of the package, they
were not submitted as part of this Minor Mod application.
All comments requiring changes and/or corrections to the plans shall be reflected on all
appropriate sheets
Please note that changes or revisions to these plans may generate additional comments.
Acceptance of these plans during the Minor Site Plan Modification process does not
ensure that additional comments may not be generated at permit review.
Minor Mod 06-050 (Bid!!. H) comments:
Consider rolling this older Minor Mod request into this latest request, as part of the
responses/changes noted herein. Some portions of the previous request may now be
outdated or superceded by this most recent application.
As noted in the SMU comments, the new traffic circle (southeast of Building "H-I") is
depicted (and labeled) with a fountain in the middle. No structural features will be
allowed, as they will fall within a utility easement that contains water and sanitary sewer.
Paving, drainage and site details will not be reviewed for construction acceptability at this
time. All engineering construction details shall be in accordance with the applicable City
of Boynton Beach Standard Drawings and the "Engineering Design Handbook and
Construction Standards" and will be reviewed at the time of construction permit
application.
Palm Beach County Health Department permits may be required for the water and sewer
system revisions.

A building permit for this project shall not be issued until this Department has approved
the plans for the water and/or sewer improvements required to service this project, in
accordance with the CODE, Section 26-15.
The proposed "header" configuration for sanitary sewer laterals to the west of the eight
townhomes will not be permitted. Provide sanitary sewer main along the front of the
townhomes, with laterals properly tied into the main. Connect the new main to the
sanitary sewer in the primary east-west roadway (at the traffic circle.) Delete the proposed
sanitary sewer that runs from the mid-point of the proposed townhomes west and
connects into the secondary roadway in front of Buildings "K", "L", and "M."
Likewise, the sanitary sewer laterals for Buildings "J" and "K" will be re-evaluated at the
time revised Utility plans are submitted for review and approval.
Revise the water main loop around Building "H-1" and "H-2" so that the fire hydrant at
the southeast comer of Building "H -1" comes off the main, instead of the main corning
off the fire hydrant lead.
A note for a 3-in. service line with a 2-in. meter is shown southeast of the eight
townhomes but no line is shown. Please correct.
Please identify whether townhomes will be 2- or 3-story.
No fire line or meter(s) were shown for the proposed townhomes or Building "H-2."
Please correct.
The correspondence regarding this minor modification (dated 8/16/06) states that grease
traps were added throughout the Boynton Town Center & Village site although only one
of the utility sheets was included in the plan set. Is Sheet C13 the only sheet with new
grease traps identified?
Utility construction details will not be reviewed for construction acceptability at this time.
All utility construction details shall be in accordance with the Utilities Department's
"Utilities Engineering Design Handbook and Construction Standards" manual
(including any updates) and will be reviewed at the time of construction permit
application.
Building elevations were not provided for the townhomes or the garages north of
Building H.
It would appear as though all glass depicted on Building H is vision glass. If this is
incorrect, please accurately depict areas of vision and non-vision glass.
Originally, Building H appeared to have a good deal of what looked like brick fayade.
Staff would prefer to retain some of that fayade element.
Please submit revised plans reflecting the changes discussed above to continue the review of your
request through the process. Staff will be happy to meet with you to discuss any of these issues or
any potential plan revisions prior to your resubmittal. Do not hesitate to contact me with any
