FYI,
In an attempt to ensure that all concerned parties are notified about the upcoming public hearings for this time
extension, I notified Carol Mahoney, a city employee who lives in the area of the proposed project. As luck would
have it, Carol is a "board member" of the loosely organized community board, not a formal HOA. I told her of the
P&D date and the City Commission date and asked if she could relay the information to the community since they
are outside of the 400 ft radius that requires noticing by the applicant. She indicated she would and thanked me
for the information.

Attached is the notice to be sent to property owners within 400 ft of the property boundaries. Per the
ordinance (attached) this should be postmarked not later than 10 days prior to the Board meeting.
Sign(s) shall also be posted not later than 10 days prior to the Board meeting. (one per road
frontage). Take photos of the signs on the property.
Complete the affidavit indicating this has occurred within the specific time frame.
Submit the affidavit, photos of sign, property owners list (those notified) and radius map indicating the
400 ft. to the Office of the City Clerk in the week prior to the Board meeting (April 20- April 24).
Accompanying this fax is the ordinance regulating the noticing, a sample of the site sign as well as a
courtesy notice.
Keep in mind that should the noticing within the proper time frame fail to occur, this item will
be postponed from the meeting until the following month. The notice is a courtesy notice
only, please proofread to ensure accuracy and validity of the information as the responsibility
for accuracy falls upon the property owner.

Per City Of Boynton Beach Ordinance 04-007 and 05-004
No quasi-judicial proceeding shall proceed until proof of notice of the proceeding,
in affidavit form, has been filed with the Office of the City Clerk and copied to
Planning & Zoning. Proof of notice must include the name and address of each
property owner to whom notice was mailed and a photograph of each sign posted,
as hereinafter required. The following notices must be paid for and provided by
the applicant:
1) All property owners, homeowner associatIons, and condominium
associations that own property within four hundred (400) feet of the
boundary line of the property which is the subject of the quasi-judicial
hearing shall be mailed, by first class mail, a notice of hearing postmarked
no less than ten (10) calendar days prior to the hearing.
2) One (1) sign for each street frontage of the property shall be posted no less
than ten (10) days prior to the hearing. The sign shall be legible from a
distance of 100 feet and shall contain a description of the approval being
sought, the date, time and location of the hearing, and a statement that the
application being considered is available for inspection in the Development
Department of the City of Boynton Beach.

NOTICE IS HEREBY GIVEN that the Planning and Development Board of THE
CITY OF BOYNTON BEACH, FLORIDA, will conduct a PUBLIC HEARING, on
Tuesday, April 28, 2009 at 6:30 p.m. The City Commission will also hear the
request on Tuesday, May 26, 2009 at 6:30 p.m. or as soon thereafter as the
agenda permits. Both meetings to be held in the CITY HALL COMMISSION
CHAMBERS, 100 East Boynton Beach Boulevard, to consider this request as
submitted by Michael C. De Simone. The request is described as follows:

Site plan time extension for a one (1 )-year site plan time
extension for the Ocean 95 Exchange Plaza New Site Plan
Development Order.
This request can be viewed between the hours of 8:00 a.m. and 5:30 p.m. at the
City of Boynton Beach Planning and Zoning Division, 100 East Boynton Beach
Boulevard.
All interested parties are notified to appear at said hearings in person or by
attorney and be heard. Any person who decides to appeal any decision of the
Planning and Development Board or City Commission with respect to any matter
considered at these meetings will need a record of the proceedings and for such
purpose may need to ensure that a verbatim record of the proceedings is made,
