Dear Jason:
This letter is in response to your request for written verification of the Master Plan/Site Plan
expiration date for the above-referenced property. Our records indicate that a time extension (SPTE
06-008) was granted which extended Master Plan/Site Plan approval to September 20,2007. Please
be advised that the subsequent Development Order for the Master Plan Modification (MPMD 07-002)
approved by the City Commission on March 20, 2007 does not extend the project site plan approval
date for one (1) year to March 20, 2008. Based on Chapter 2.5, Section 12. of the Land
Development Regulations, non-substantial (minor) modifications to Master Plans will not extend time
limitations for development of property. I apologize for the incorrect information previously provided
to you and any related inconvenience. Should additional time be needed after the September 20,
2007 deadline to obtain permits for the project, you may request a time extension prior to the
deadline.

I have reviewed the above referenced plat and have the following comments:
1. Plat (Page 1) - Staff recommends that Tract "H" be listed under Tract "A", for recreational purposes.
2. Plat (Page 2) - Condition of Approval #40 from the original master plan/site plan approval requires
HOA documents to stipulate maintenance of landscape buffers and no ability of
individual homeowners to remove the required plantings. Since the applicant chose
not to depict certain required buffer areas as Tracts, provide the language contained
in the HOA documents which meets this requirement. Most notably, the landscape
buffers and fence/wall improvements located on the north, south and west sides of
the project and not included in any Tracts for purposes of maintenance and to ensure
the required improvements are not removed/modified by individual homeowners.
3. Any re-plat approval is subject to Commission approval of the revised master plan (MPMD 07-002).

December 21st. It is also noted that your office submitted a revised set of
conceptual development to the Planning and Zoning Division of the Development
Department at the same time, which generated a major modification application within

no comments will be generated and sent to you until the revised project master plan
