Based on our review, the Traffic Division has determined that the revised development
plan of the proposed residential project generates less daily and peak hour trips than
previously approved and therefore meets the Traffic Performance Standards of Palm
Beach County. No building permits are to be issued by the town, after the build-out
date specified above. It should be noted however that the County is concerned over the
build-out of this proiect and should the development completion not meet the build-out
date specified above. a new traffic study addressinq the new build-out date would be
required. The County traffic concurrency approval is subject to the Project Aggregation
Rules set forth in the Traffic Performance St:md;m1~ Ordinance

Dear Mr. Rumpf:
Yvonne Ziel Traffic Consultants, Inc. was retained to prepare an equivalency statement for the
above referenced project located along the northwest comer of High Ridge Road and Miner
Road. The project received traffic concurrency 126 town homes and 48 single family units.
The proposed site plan will consist of 110 single family units. Tables 1 and 2 provide the trip
generation calculations for the approved and proposed plans. Trip generation indicates that the
proposed changes result in a decrease of 19 AM and 11 PM peak trips and a new traffic study is
not required. If you have any questions, or need additional information, please call me.

Limiting Conditions
1. This permit shall expire on January 8, 2027.
2. Application for a permit modification may be made at any time.

Total maximum monthly allocation is 1.0588 MG.
These allocations represent the amount of water required to meet the water demands as a result of
rainfall deficit during a drought with the probability of recurring one year in ten. The Permittee shall not
exceed these allocations in hydrologic conditions less than ;;~ 1 in 10 year drought event. If the rainfall
deficit is more severe than that expected to recur once every ten years, the withdrawals shall not
exceed that amount necessary to continue to meet the reasonable-beneficial demands under such
conditions, provided no harm to the water resources occur and:
(a) All other conditions of the permit are met; and
(b) The withdrawal is otherwise consistent with applicable declared Water Shortage Orders in effect
pursuant to Chapter 40E-21, FAC.
6. Pursuant to Rule 40E-1.61 05, F.A.C., Notification of Transfer of Interest in Real Property, within 30
days of any transfer of interest or control of the real property at which any permitted facility, system,
consumptive use, or activity is located, the permittee must notify the District, in writing, of the transfer
giving the name and address of the new owner or person in control and providing a copy of the
instrument effectuating the transfer, as set forth in Rule 40E-1.61 07, FAC.
Pursuant to Rule 40E-1.61 07 (4), until transfer is approved by the District, the permittee shall be liable
for compliance with the permit. The permittee transferring the permit shall remain liable for all actions
that are required as well as all violations of the permit which occurred prior to the transfer of the permit.
Failure to comply with this or any other condition of this permit constitutes a violation and pursuant to
Rule 40E-1.609, Suspension, Revocation and Modification of Permits, the District may suspend or
revoke the permit.

7. Withdrawal Facilities:
Surface Water - Proposed:

8. Permittee shall mitigate interference with existing legal uses that was caused in whole or in part by the
permittee's withdrawals, consistent with the approved mitigation plan. As necessary to offset the
interference, mitigation will include pumpage reduction, replacement of the impacted individual's
equipment, relocation of wells, change in withdrawal source, or other means.
Interference to an existing legal use is defined as an impact that occurs under hydrologic conditions
equal to or less severe than a 1 in 10 year drought event that results in the:
(1) Inability to withdraw water consistent with provisions of the permit, such as when remedial structural
or operational actions not materially authorized by existing permits must be taken to address the
interference; or
(2) Change in the quality of water pursuant to primary State Drinking Water Standards to the extent
that the water can no longer be used for its authorized purpose, O~ such change is imminent.
9. Permittee shall mitigate harm to existing off-site land uses caused by the permittee's withdrawals, as
determined through reference to the conditions for permit issuance. When harm occurs, or is
imminent, the District will require the permittee to modify withdrawal rates or mitigate the harm. Harm
as determined through reference to the conditions for permit issuance, includes:
(1) Significant reduction in water levels on the property to the extent that the designed function of the
water body and related surface water management improvements are damaged, not including
aesthetic values. The designed function of a water body is identified in the original permit or other
governmental authorization issued for the construction of the water body. In cases where a permit was
not required, the designed function shall be determined based on the purpose for the original
construction of the water body (e.g. fill for construction, mining, drainage canal, etc.)
(2) Damage to agriculture, including damage resulting from reduction in soil moisture resulting from
consumptive use; or
(3) Land collapse or subsidence caused by reduction in water levels associated with consumptive use.

Limiting Conditions
10. Permittee shall mitigate harm to the natural resources caused by the permittee's withdrawals, as
determined through reference to the conditions for permit issuance. When harm occurs, or is
imminent, the District will require the permittee to modify withdrawal rates or mitigate the harm. Harm,
as determined through reference to the conditions for permit issuance includes:
(1) Reduction in ground or surface water levels that results in harmful lateral movement of the fresh
waterlsalt water interface,
(2) Reduction in water levels that harm the hydroperiod of wetlands,
(3) Significant reduction in water levels or hydroperiod in a naturally occurring water body such as a
lake or pond,
(4) Harmful movement of contaminants in violation of state water quality standards, or
(5) Harm to the natural system including damage to habitat for rare or endangered species.
11. If any condition of the permit is violated, the permit shall be subject to review and possible modification,
enforcement action, or revocation.
12. Authorized representatives of the District shall be permitted to enter, mspect, and observe the
permitted system to determine compliance with special conditions.
13. The Permittee is advised that this permit does not relieve any person from the requirement to obtain all
necessary federal, state, local and special district authorizations.
14. The permit does not convey any property right to the Permittee, nor any rights and privileges other than
those specified in the Permit and Chapter 40E-2, Florida Administrative Code.
15. Permittee shall submit all data as required by the implementation schedule for each of the limiting
conditions to: S.F.W.M.D., Supervising Hydrogeologist - Post-Permit Compliance, Water Use
Regulation Dept. (4320), P.O. Box 24680, West Palm Beach, FL 33416-4680.
16. In the event of a declared water shortage, water withdrawal reductions will be ordered by the District in
accordance with the Water Shortage Plan, Chapter 40E-21, F.A.C. The Permittee is advised that
during a water shortage, pumpage reports shall be submitted as required by Chapter 40E-21, FAC.

Limiting Conditions
17. Landscape and golf course irrigation is prohibited between the hours of 10:00 A.M. and 4:00 P.M.,
except as follows:
a) Irrigation using micro-irrigation system is allowed anytime.
b) Users whose average annual allocation is made up of 75% or greater volume of reclaimed water for
irrigation may irrigate at anytime.
c) Irrigation of, or in preparation for planting, new golf courses and recreational areas is allowed at any
time of day for one 30 day period provided irrigation is limited to the amount necessary for plant
establishment. Irrigation of newly seeded or sprigged golf course areas is allowed any time of day for
one 60 day period.
d) Watering in of chemicals, including insecticides, pesticides, fertilizers, fungicides, and herbicides
when required by law, recommended by the manufacturer or constituting best management practices
is allowed anytime within 24 hours of application.
e) Irrigation systems may be operated anytime for maintenance and repair purposes.
f) The use of water to protect golf course turf from heat and wind stress damage is allowed anytime.
NOTICE OF RIGHTS
As required by Sections 120.569(1), and 120.60(3), Fla. Stat., following is notice of the
opportunities which may be available for administrative hearing andlor judicial review when the
substantial interests of a party are determined by an agency. Please note that this Notice of
Rights is not intended to provide legal advice. Not all the legal proceedings detailed below may
be an applicable or appropriate remedy. You may wish to consult an attorney regarding your
legal rights.
Right to Request Administrative Hearing
A person whose substantial interests are or may be affected by the South Florida Water
Management District's (SFWMD or District) action has the right to request an administrative
hearing on that action pursuant to Sections 120.569, 120.57, and 120.60(3), Fla. Stat. Persons
seeking a hearing on a District decision which does or may determine their substantial interests
shall file a petition for hearing with the District Clerk within 21 days of receipt of written notice of
the decision in accordance with Rule 28-106.111, Fla. Admin. Code. Any person who receives
written notice of a District decision and fails to file a written request for hearing within 21 days
waives the right to request a hearing on that decision as provided by Subsection 28-106.111 (4),
Fla. Admin. Code.
The Petition must be filed at the Office of the District Clerk of the SFWMD, 3301 Gun Club
Road, P.O. Box 24680, West Palm Beach, Florida, 33416, and must comply with the
requirements of Rule 28-106.104, Fla. Admin. Code. Filings with the District Clerk may be
made by mail, hand-delivery or facsimile. Filings bye-mail will not be accepted. A petition
for administrative hearing is deemed filed upon receipt during normal business hours by the
District Clerk at SFWMD headquarters in West Palm Beach, Florida. Pursuant to Rule 28-
106.104, Fla. Admin. Code, any document received by the office of the District Clerk after 5:00
p.m. shall be filed as of 8:00 a.m. on the next regular business day.
. Filings made by mail must include the original and one copy and must be addressed to
the Office of the District Clerk, P.O. Box 24680, West Palm Beach, Florida 33416.
. Filings by hand-delivery must also include the original and one copy of the petition.
Delivery of a petition to the District's security desk does not constitute filing. To
ensure proper filing, it will be necessary to request the District's security officer to
contact the Clerk's office. An employee of the District's Clerk's office will file the
petition and return the extra copy reflecting the date and time of filing.
. Filings by facsimile must be transmitted to the District Clerk's Office at (561) 682-6010.
Pursuant to Subsections 28-106.104(7), (8) and (9), Fla. Admin. Code, a party who files
a document by facsimile represents that the original physically signed document will be
retained by that party for the duration of that proceeding and of any subsequent appeal
or subsequent proceeding in that cause. Any party who elects to file any document by
facsimile shall be responsible for any delay, disruption, or interruption of the electronic
signals and accepts the full risk that the document may not be properly filed with the
clerk as a result. The filing date for a document filed by facsimile shall be the date the
District Clerk receives the complete document.

The following provIsions may be applicable to SFWMD actions in combination with the
applicable Uniform Rules of Procedure (Subsections 40E-0.1 09(1 )(a) and 40E-1.511 (1 )(a), Fla.
Admin. Code):
(1 )(a) "Receipt of written notice of agency decision" as set forth in Rule 28-106.111,
Fla. Admin. Code, means receipt of either written notice through mail or posting
that the District has or intends to take final agency action, or publication of notice
that the District has or intends to take final agency action.
(b) If notice is published pursuant to Chapter 40E-1, F.A.C.,
publication shall constitute constructive notice to all persons. Until notice is
published, the point of entry to request a formal or informal administrative
proceeding shall remain open unless actual notice is received.
(2) If the District's Governing Board takes action which substantially differs from the
notice of intended agency decision, the persons who may be substantially
affected shall have an additional point of entry pursuant to Rule 28-106.111 , Fla.
Admin. Code, unless otherwise provided by law. The District Governing Board's
action is considered to substantially differ from the notice of intended agency
decision when the potential impact on water resources has changed.
(3) Notwithstanding the timeline in Rule 28-106.111, Fla. Admin. Code, intended
agency decisions or agency decisions regarding consolidated applications for
Environmental Resource Permits and Use of Sovereign Submerged Lands
pursuant to Section 373.427, Fla. Stat., shall provide a 14 day point of entry to
file petitions for administrative hearing.
Hearings Involving Disputed Issues of Material Fact
The procedure for hearings involving disputed issues of material fact is set forth in Subsection
120.57(1), Fla. Stat., and Rules 28-106.201-.217, Fla. Admin. Code. Petitions involving disputed
issues of material fact shall be filed in accordance with Rule 28-106.104, Fla. Admin. Code, and
must comply with the requirements set forth in Rule 28-106.201, Fla. Admin. Code.
Hearings Not Involving Disputed Issues of Material Fact
The procedure for hearings not involving disputed issues of material fact is set forth in
Subsection 120.57(2), Fla. Stat, and Rules 28-106.301-.307, Fla. Admin. Code. Petitions not
involving disputed issues of material fact shall be filed in accordance with Rule 28-106.104, Fla.
Admin. Code, and must comply with the requirements set forth in Rule 28-106.301, Fla. Admin.
Code.
Mediation
As an alternative remedy under Sections 120.569 and 120.57, Fla. Stat., any person whose
substantial interests are or may be affected by the SFWMD's action may choose to pursue
mediation. The procedures for pursuing mediation are set forth in Section 120.573, Fla. Stat.,
and Rules 28-106.111 and 28-106.401-.405, Fla. Admin. Code. Choosing mediation will not
adversely affect the rights to a hearing if mediation does not result in a settlement.
DISTRICT COURT OF APPEAL
Pursuant to Sections 120.60(3) and 120.68, Fla. Stat., a party who is adversely affected by final
SFWMD action may seek judicial review of the SFWMD's final decision by filing a notice of appeal
pursuant to Florida Rule of Appellate Procedure 9.110 in the Fourth District Court of Appeal or in
the appellate district where a party resides and filing a second copy of the notice with the SFWMD
Clerk within 30 days of rendering of the final SFWMD action.

I have completed my research on your questions, and offer the following.
1. Land dedicated to PBC must be free of all encumbrances; therefore, I doubt that PBC
would accept this ROW having a requirement to plant landscaping on it. Please contact
Kat Chopin at 478-5795 for more information about dedications of ROW to PBC.
2. As this property is not in unincorporated PBC, I would not have access to any
agreements. If the developer is not producing any documents, you may contact Dave
Young in Roadway Production at 684-4149.
3. According to our records, High Ridge Road is already at maximum ROW width of
80' in this area. Miner Road is already at maximum ROW width of 110' in this area.
4. It is unknown whether or not the BCC would require additional widening to these
Thoroughfare Plan roads. Please contact Dave Young in Roadway Production at 684-
4149 regarding future road widening plans for this area.

Hi Maureen -
I'm reviewing a site plan for New Urban High Ridge LLC for the NW corner
of High Ridge and Miner Rd. Instead on putting their perimeter
landscape strip on their property, they are proposing it within the 15
feet they have to dedicate to PBC for future right of way. If the
developer of High Ridge PUD (in the City) puts the perimeter landscape
strip required along the east property line of the development, entirely
on the land to be dedicated for additional RjW, and then the road is
widened, there will be no landscaping left. Can you forward this em ail
to the person in Land Development that could help me address my
concerns:
Does PBC have an agreement with the developer regarding landscaping in
the right of way in lieu of the project property?
How likely is it that High Ridge Road will be widened to an 80 foot RjW
in this area?
What is the proposed timeframe regarding the future road widening plans
for this area?
What are the conditions of permit approval (on the back of permit
LA000002-0107)?

CONDITIONS fOR RIGHT.Of.WAY LANDSCAPING ANDIOR IRRIGATION
1.
The landscaping anellor irrigation within the right-of-way of the subject road(s) as granted by this permit ~hall be owned a,nd
maintained by the Permittee, any successors, legal heirs and assigns. The maintenance area shall be the entire swale or medIan
in which the landscaping andlor irrigation are permitted, within the limits permitted. The drainage facilities (swales, inlets, etc..)
shall be kept clear of grass clippings, branches, leaves, etc.. The landscaping and/or irrigation may be replaced in like-kind if
necessary. If replacement is within the road(s) pavement, a permit shall be obtained from the Office of the County Engineer.
Any transfer of this Permit shall require the approval of the Office of the County Engineer.
A set of plans bearing the stamp of approval of the Office of the County Engineer. The plans and a copy of this permit shall be
present at the site during construction.
The Permittee, any successors, legal heirs or assigns shall obtain a permit from the Office of the County Engineer for any and all
additions or modifications to the landscaping or irrigation.
That no sight obstructions for the traveling public on the subject road(s) shall be caused by the installation ofthe landscaping anellor
irrigation.
Irrigation includes any and all materials associated with the system, including electrical, controllers, etc.
The Permittee, any successors, legal heirs or assigns, shall, upon request and within 30 days after notice by the Office of the County
Engineer. remove or relocate the landscaping and irrigation from the right-of-way of the subject road(s) at no expense to Palm
Beach County. This request can be initiated by the Office of the County Engineer with or wlthoutcause.
The Permittee. any successors, legal heirs or assigns, shall indemnify and hold Palm Beach County harmless from any and all
claims, liability, losses and causes of action which may arise specifically out of its negligent, improper or non compliant performance
of this Permit. The Permittee. any successors, legal heirs or assigns shall pay all claims and losses of any nature whatsoever in
connection herewith. and shall defend all suits in the name of Palm Beach County where applicable, and shall pay all costs of
judgements which may arise thereon.
The Permittee, any successors, legal heirs or assigns shall, at its expense, promptly correct any failure of the landscaping and/or
irrigation within the right-of-way of the subject road(s). If in the Office of the County Engineer's opinion the landscaping anellor
irrigation caused or contributed to the damage or failure of any part of the subject road(s), the Permittee, any successors, legal heirs
or assigns, shall in such case also at their expense, repair the damage or failure sOstained by the subject road(s) within 48 hours
of notification by the Office of the County Engil1~~n the event that the Permittee any successors, legal heirs or assigns fail to
repair said damage or failure wl~hln the 48.hmir period, Palm Beach County shall have the right to make any and all repairs, and
in the event Palm Beach County should exercise and give effect to such right, the Permittee, any successors, legal heirs or assigns,
shall be liable to pay and indemnify Palm Beach County upon completion of said repairs. The total cosl may include engineering
and legal fees.
The Office of the County Engineer shall be the sole and final authority as to the placement of the landscaping andlor irrigation and
the quality and quantities of materials used in the installation. Adjustments to the landscaping andlor irrigation may be required
as deemed necessary by the Office of the County Engineer.
In the event of widening, repair, or reconstruction of the subject road(s), the Permittee, any successors, legal heirs or assigns, shall
upon request and within 30 days after notice by the Office of the County Engineer, remove or relocate the landscaping and/or
Irrigation within the right-of-way of the subject road(s) at no expense to Palm Beach County.
If the landscaping and/or Irrigation are not removed or relocated pursuant to Sections 6 and 10 of this Permit, Palm Beach County
shall have the right to remove or relocate said landscaping and/or irrigation, and the Permiltee agrees to pay all costs thereby
incurred by Palm Beach County.
Irrigation system's shall comply with the "Palm Beach County Water and Irrigation Conservation Ordinance" (Ordinance 91-52).
The permittee shall be responsible for coordinating the installation of the landscaping and/or irrigation with existing utilities. Should
damage occur to the utility during installation or In the future due to the landscaping or irrigation, the permittee shall be responsible
for repair costs.

project. The letter of credit shall be held until such time as the

8. Even though this development has approved utility plans on file for the
original development concept, please provide a time line that clearly
illustrates when water and sewer services will be required to serve this
revised project. Your starting date for the time line should be the date of
City Commission approval. Also provide milestone dates for permit
application, the start of construction, and the setting of the first water meter.
This time line should be used to determine the adequacy of water and
wastewater treatment capacity for this project's completion, so please be as
accurate as possible.
9. Palm Beach County Health Department permits will be required for the
water and sewer system revisions serving this project (CODE, Section 26-
12).
10. If not already paid, the CODE, Section 26-34(E) requires that a capacity
reservation fee be paid for this project either upon the request for the
Department's signature on the Health Department application forms or
within seven (7) days of site plan approval, whichever occurs first. This fee
will be determined based upon final meter size, or expected demand.
11. Water and sewer lines to be owned and operated by the City shall be
included within utility easements. Please show all proposed easements on
the engineering drawings, using a minimum width of 12 feet. Easements
shall be centered on the sanitary sewer main and the minimum width shall
be determined by using two (2) times the depth of the sewer main plus three
(3) feet (for trench bottom). Easements widths will be finalized at the time
of platting and permitting. The easements shall be dedicated via separate
instrument to the City as stated in the CODE, Section 26-33(a).
12. This office will not require surety for installation of the water and sewer
utilities, on condition that the systems be fully completed, and given to the
City Utilities Department before the first permanent meter is set. Note that
setting of a permanent water meter is a prerequisite to obtaining the
Certificate of Occupancy.
13. A building permit for this project shall not be issued until this Department
has approved the plans for the water and/or sewer improvements required to

service this project, in accordance with the CODE, Section 26-15.
14. PVC material not permitted on the City's water system. All lines shall be

construction site security and management plan for review by the City's
Police Department CPTED Official.
a. The developerlproject manager after site clearing and placement
of construction trailers shall institute security measures to reduce
or eliminate opportunities for theft. The management plan shall
include, but not be limited to, temporary lighting, security
personnel, vehicle barriers, construction/visitor pass,
reduce/minimize entry/exit points, encourage sub contractors to
secure machinery, tools at end of work day and/or any other
measure deemed appropriate to provide a safe and secure
working environment. The security management plan shall be
maintained throughout the construction phase of the project.
28. Applicant shall provide a detailed photometric lighting plan.
29. All lighting shall be metal halide following IESNA Lighting standards.
30. Timer clock or photocell lighting for nighttime use shall be above or near
entryways.

· Anti lifting auxiliary locks should be installed on
sliding doors and windows.
· Should be pre-wired for alarm system.
· Telephone lines should be run underground with
box hook-up on inside of building versus the
exterior of building where telephone lines can be
cut making alarm system inoperable. It IS
strongly suggested that the architects and
engineers incorporate this mto the site plans to
insure that the site supervisor is aware of this
condition.

39. A water-use permit from SFWMD is required for an irrigation system that
utilizes water from a well or body of water as its source. A copy of the
permit shall be provided at the time of building permit application, F.S.
374.216.
40. If capital facility fees (water and sewer) are paid in advance to the City of
Boynton Beach Utilities Department, the following information shall be
provided at the time of building permit application:
A) The full name of the project as it appears on the Development Order and
the Commission-approved site plan.
B) The total amount paid and itemized into how much is for water and how

41. At time of permit review, submit separate surveys of each lot, parcel, or
tract. For purposes of setting up property and ownership in the City

42. At time of building permit application, submit verification that the City of
Boynton Beach Parks and Recreation Impact Fee requirements have been
satisfied by a paid fee or conveyance of property. The following information

I am following up from our meeting of October 24, 2007, where we discussed Public Art
opportunities in High Ridge New Urban Community. New Urban Communities submit-
ted site plans for a major modification for its project on High Ridge Road and Miner
Road from 48 single family homes and 126 fee-simple town homes to 110 single family
detached units.
At the meeting, you presented your concerns for the financial hardship of your project
now that it is subject to the 1 % public Art fee. I explained how the fees are collected,
how they can be applied to components of your project and the public art approval
process. You estimated that the construction value for the project is $10 million. This
calculates the 1 % public art fee at $100,000. This provides you with 70% of the 1 % at
$70,000.00 that can be spent in your project to include public art and 30% of the 1 % at
$30,000.00 due at time of permit that goes to the operations of the public art program.
We discussed considering deferring the $30,000.00 fee until C.O. and identified com-
ponents of your project to budget towards the $70,000.00 public art commitment.
Those components are identified as:
1. A fountain in a two acre retention area.
2. The fountain overlook paved area including landscape and seating.
3. Paver areas that could be artistically created and/or converted to colored cement.
4. Community ID Monuments (pier monuments).
5. Community pool areas that are tiled, fenced, a trellis and possibly a mural.
6. Artistically created unit identification plaques.
7. Metal balconies
You were to provide a budget for these components. Once a budget is established for
specific components, I can publish a call to artists to request qualifications and design
proposals. Once we select an artist you can proceed to contract the public artist to work

At our meeting yesterday, we discussed changing the condition of approval for the
above referenced project, High Ridge, relating to the completion of the off site
improvement in the High Ridge Road right of way. The condition currently reads as
follows:
2. At the time of permitting, improve High Ridge Road to a minimum of three 12 foot
lanes from Miner Road to the northern typical sections, for off-site improvements,
including curb and gutter along High Ridge Road. Palm Beach County permits
will be required for work within the Palm Beach County right-of-way. Staff
recognizes that improvements required by the city may not be required and/or
supported by the County. The developer shall provide a letter of credit in the
amount of 110% of the engineer's estimate for public roadway improvements prior
to issuance of any building permits for this project. The letter of credit shall be held
until such time as the improvements are complete.
We submit the following modified condition as agreed upon yesterday at our meeting:
2. Prior to the issuance of the 56th certificate of occupancy, substantially complete
the improvement of High Ridge Road to a minimum of three 12 foot lanes from

PUBLIC WORKS - SOLID WASTE
1. Prior to permit application contact the Public Works Department (561-742-6200) regarding the
storage and handling of refuse per the CODE, Section 10-26 (a).
PUBLIC WORKS - FORESTRY & GROUNDS
2. Condition of Approval (COA) #3 of the Development Order (DO) dated 9/23/05 states in part: "The
applicant shall provide, through homeowner's documents, an additional buffer area of no less than
5-ft. adjacent to both sides of the proposed rights-of-way to allow for Solid Waste storage and
pickup. The buffer area shall be kept free of all obstructions, including fencing and landscaping,
for this purpose." The landscape plans (Sheet 10-12 of 15) depict shrubs and trees within this
buffer area. Revise the landscape plans to clear the buffer area as required. Please note that in
addition to impacting solid waste pickup the shrubs would hinder visibility for vehicles backing out
of garages.
3. Staff recommends placing larger canopy trees a minimum of 10-ft. off property lines and buildings
to allow room for growth and for maintenance as the trees mature. Alternatively the larger canopy
trees such as Live Oaks could be replaced with smaller species such as Silver Buttonwood.
4. COA #7 states: "It will be necessary to replace or relocate large canopy trees adjacent to light
fixtures to eliminate future shadowing on the parking surface (LDR, Chapter 23, Article II, Section
A.1.b.)" Add a note to the plans indicating this condition.
PUBLIC WORKS - TRAFFIC
5. COA #2 states: "At the time of permitting, improve High Ridge Rd. to a minimum of three 12-ft.
lanes from Miner Rd. to the northern boundary of the proposed development. Provide plans,
including typical sections, for off-site improvements, including curb and gutter along High Ridge
Road. Palm Beach County permits will be required for work within the Palm Beach County right-
of-way. Staff recognizes that improvements required by the city may not be required and/or
supported by the County. The developer shall provide a letter of credit in the amount of 110% of
the engineer's estimate for public roadway improvements prior to issuance of any building permits

for this project. The letter of credit shall be held until such time as the improvements are
complete." Please provide a progress report on the status of this COA.
ENGINEERING
6. Show on the engineering plan what erosion control measures will be used on the project during
construction (LDR, Chapter 6, Article III, Section 4 and Article V, Section 4.B.2.i(7); Chapter 8,
Article III, Section A.1.a(9) and (10), and Article V.) Specify on the plans that erosion and
sedimentation control will be addressed using Best Management Practices (BMPs.)
7. At the time of permitting, all projects one-acre or larger shall submit a Notice of Intent (NO I) to the
FDEP for coverage under the NPDES Generic Permit. Copies of the NOI shall be provided to the
City of Boynton Beach Department of Public Works/Engineering Division and Utilities
Department/Engineering Division.
8. All comments requiring changes and/or corrections to the plans shall be reflected on all
appropriate sheets.
9. Please note that changes or revIsions to these plans may generate additional comments.
Acceptance of these plans during the Technical Advisory Review Team (TART) process does not
ensure that additional comments may not be generated by the Commission and at permit review.
10. A re-plat of this subdivision will be required upon satisfactory Commission approval of this major
site plan modification.
11. Provide written and graphic scales on all sheets. Graphic scales and north arrows are missing on
both civil sheets.
12. Provide an engineer's certification on the Drainage Plan as specified in LDR, Chapter 4, Section
7.F.2.
13. Full drainage plans, including drainage calculations, in accordance with the LDR, Chapter 6,
Article IV, Section 5 and Section 1 O.l will be required at the time of permitting.
14. Paving, drainage and site details will not be reviewed for construction acceptability at this time. All
engineering construction details shall be in accordance with the applicable City of Boynton Beach
Standard Drawings and the "Engineering Design Handbook and Construction Standards" and
will be reviewed at the time of construction permit application.
UTILITIES
15. Even though this development has approved utility plans on file for the original development
concept, please provide a timeline that clearly illustrates when water and sewer services will be
required to serve this revised project. Your starting date for the timeline should be the date of City
Commission approval. Also provide milestone dates for permit application, the start of
construction, and the setting of the first water meter. This timeline should be used to determine
the adequacy of water and wastewater treatment capacity for this project's completion, so please
be as accura'te as possible.
16. All utility easements and utility lines shall be shown on the site plan and landscape plans (as well
as the Water and Sewer Plans) so that we may determine which appurtenances, trees or

shrubbery m~y interfere with utilities. In general, palm trees will be the only tree species allowed
within utility easements. Canopy trees may be planted outside of the easement so that roots and
branches will not impact those utilities within the easement in the foreseeable future. The LDR,
Chapter 7.5, Article I, Section 18.1 gives public utilities the authority to remove any trees that may
interfere with utility services, either in utility easements or public rights-of-way. Relocate any light
poles and canopy trees out of proposed utility easements.
17. Palm Beach County Health Department permits will be required for the water and sewer system
revisions serving this project (CODE, Section 26-12).
18. If not already paid, the CODE, Section 26-34(E) requires that a capacity reservation fee be paid
for this project either upon the request for the Department's signature on the Health Department
application forms or within seven (7) days of site plan approval, whichever occurs first. This fee
will be determined based upon final meter size, or expected demand.
19. Water and sewer lines to be owned and operated by the City shall be included within utility
easements. Please show all proposed easements on the engineering drawings, using a minimum
width of 12-ft. Easements shall be centered on the sanitary sewer main and the minimum width
shall be determined by using two (2) times the depth of the sewer main plus three (3) feet (for
trench bottom). Easements widths will be finalized at the time of platting and permitting. The
easements shall be dedicated via separate instrument to the City as stated in the CODE, Section
26-33(a).
20. This office will not require surety for installation of the water and sewer utilities, on condition that
the systems be fully completed, and given to the City Utilities Department before the first
permanent meter is set. Note that setting of a permanent water meter is a prerequisite to
obtaining the Certificate of Occupancy.
21. A building permit for this project shall not be issued until this Department has approved the plans
for the water and/or sewer improvements required to service this project, in accordance with the
CODE, Section 26-15.
22. PVC material not permitted on the City's water system. All lines shall be DIP.
23. Appropriate backflow preventer(s) will be required on the domestic water service to the building,
and the fire sprinkler line if there is one, in accordance with the CODE, Section 26-207.
24. Provide a minimum of 10-ft. separation between water main, sanitary sewer, and storm sewer
lines. Please note that City of Boynton Beach separation standards are more stringent that FDEP
standards.
25. Provide a minimum of 10-ft. separation between water main, sanitary sewer, and storm sewer
lines and the outside edge of buildings. This includes the project of roof lines to the groiund

I have viewed the above building plans and have the following comments:
Prior to issuance of the first building permit, the applicant shall prepare a construction site security and
management plan for review by the City's Police Department CPTED Official.
a. The developer/project manager after site clearing and placement of construction trailers shall
institute security measures to reduce or eliminate opportunities for theft. The management plan
shall include, but not be limited to, temporary lighting, security personnel, vehicle barriers,
construction/visitor pass, reduce/minimize entry/exit points, encourage sub contractors to secure
machinery, tools at end of work day and/or any other measure deemed appropriate to provide a
safe and secure working environment. The security management plan shall be maintained
throughout the construction phase of the project.
1. Applicant shall provide a detailed photometric lighting plan.
2. All lighting shall be metal halide following IESNA Lighting standards.

4. Timer clock or photocell lighting for nighttime use shall be above or near entryways.
5. Pedestrian scale lighting shall be used for all street and pedestrian walkways. It is suggested that
interactive or lighting on demand be used in sensitive areas.
6. Numerical address:
a Shall be illuminated for nighttime visibility( dusk to dawn).
b Shall not be obstructed.
c Shall have bi-directional visibility from the roadway.
7. Lighting shall be provided for entrance signage.
The applicant should consider the following:
1. Landscaping should not obstruct view of windows, building address numbers, and walkways.
2. Residential Security:
a The door leading into a residential unit should be a solid core door and equipped with a single
cylinder dead bolt lock (including garage door).
b When placing the order for a front door that will have a side pane window it should be placed
on the opposite side of the door handle and lock making them unreachable.

c If front door has zero visibility to front entryway are, it should be equipped with a 180-degree
peephole.
d Entry door should open outward versus inward.
e All exterior doors should be equipped with security hinges.
f Anti lifting auxiliary locks should be installed on sliding doors and windows.
g Should be pre-wired for alarm system.
h Telephone lines should be run underground with box hook-up on inside of building versus the
exterior of building where telephone lines can be cut making alarm system inoperable. It is
strongly suggested that the architects and engineers incorporate this into the site plans to
insure that the site supervisor is aware of this condition.
4. Ifbenches in a park area are intended for nighttime use, adequate lighting should be provided for the
area in which they are located. They should also be in open view to eliminate concealment areas.

10 At time of permit review, submit separate surveys of each lot, parcel, or tract. For purposes
of setting up property and ownership in the City computer, provide a copy of the recorded
deed for each lot, parcel, or tract. The recorded deed shall be submitted at time of permit
review.
11 At time of building permit application, submit verification that the City of Boynton Beach
Parks and Recreation Impact Fee requirements have been satisfied by a paid fee or
conveyance of property. The following information shall be provided:
A) A legal description of the land.
B) The full name of the project as it appears on the Development Order and the

MEMORANDUM
As part of the City's concurrency requirements, the City Commission directed the Planning & Zoning
Division to report whether or not the City could maintain an adequate level of service with current
infrastructure and / or staffing levels in order to support the proposed development.
Plans for the above-mentioned project have been forwarded to your department's representative
for their technical review and comment. We are requesting that you review the proposed project for
anticipated impacts to your department's level of service (as requested by the City Commission) and
provide us with your comments for direct insertion into our staff report. In the past, you have sent
us something that indicates your current staff / infrastructure would either be able to support the
proposed project or what would be required to meet the adopted level of service. Please respond
no later than 2 weeks from today. Also, any recommendations that you believe that would
