In response to your request date-stamped March 5, 2007 for the
administrative review and approval of the modifications proposed to
the above-referenced approved site plan, depicting the following:
. Modification of existing movie theatre building to restaurant
and retail space (as depicted on the attached plan) .

on the attached plan) .

date stamped 5/24/07 are "minor" as defined within the

1. Prior to permit application contact the Public Works
Department (561-742-6200) regarding the storage and handling
of refuse per the CODE, Section 10-26 (a).
2. Correspondence dated 4/30107, accompanying this minor
modification, indicates that two new dumpsters are being
provided. Only one is found on the plan, at the southeast
corner of the building. At time of permitting, please
indicate location of second dumpster.
3. Indicate by note that the site dumpster enclosure shall be
constructed in accordance with City Standard Drawing G-4.
4. On the Site and Civil plans, show and identify all necessary
traffic control devices such as stop bars, stop signs, double
yellow lane separators striping, directional arrows and "Do
Not Enter" signage, etc. Delineate and stripe the "Loading
Area" (LDR, Chapter 2, Section 11. J); include a pavement
message in yellow indicating "No Parking - Loading Zone".
See City Standard Drawings "K" Series for striping details.
5. Provide Fire Lanes in accordance with the LDR, Chapter 23,
Article II, Section B.2 and Section M.

6. Prior to permit application contact the Engineering
Department (561-742-6982) to submit an Administrative Waiver
request to allow use of the original parking stall dimension
for this site. The request is to be directed to the Senior
Engineer for processing.
7. No utility plan was included with this submittal. However,
this project is an existing site located within the
Utilities' service area, and currently is served by the
Utilities Dept. We are providing only a cursory review of
the proposed site plan at this time. Additional comments
will be generated after a utility plan has been submitted and
reviewed.
8. All utility easements and utility lines shall be shown on the
site plan so that we may determine which appurtenances, trees
or shrubbery may interfere with utilities. In general, palm
trees will be the only tree species allowed within utility
easements. Canopy trees may be planted outside of the
easement so that roots and branches will not impact those
utilities within the easement in the foreseeable future. The
LDR, Chapter 7.5, Article I, Section 18.1 gives public
utilities the authority to remove any trees that may
interfere with utility services, either in utility easements
or public rights-of-way.
9. The CODE, Section 26-34 (E) requires that a capacity
reservation fee be paid for this proj ect either upon the
request for the Department's signature on the Health
Department application forms or within seven (7) days of site
plan approval, whichever occurs first. This fee will be
determined based upon final meter size, or expected demand.
10.A building permit for this project shall not be issued until
the Engineering/Utilities Department has approved the plans
for the water and/or sewer improvements required to service
this project, in accordance with the CODE, Section 26-15.
II.Appropriate backflow preventer (s) will be required on the
domestic water service to the building, and the fire
sprinkler line if there is one, in accordance with the CODE,
Section 26-207.
12.0n the permit plans, ensure that the parking data matches the
figures denoted in the parking analysis prepared by Kimley
Horn and Associates, dated May 23, 2007. Submit the Parking
Study as part of the permit package and remove parking data
from the plans, and only refer to the above-noted study.
13.0n the permit plans, provide detailed landscape plans
depicting plant species and sizes for those landscape areas
shown around the building. The City Forester will review the
plan for sufficiency at that time, which may generate
additional comments.
14.AII signage will require separate permits and will be
reviewed for sufficiency at that time.
15.AII comments requiring changes and/or corrections to the
plans shall be reflected on all appropriate sheets.

Minor Modification
A change to an approved site plan or built site which qualifies as a minor
modification as defined by criteria listed in the land Development Regulations,
Chapter 4, Site Plan Review. Modifications qualifying as "minor" may be approved
administratively. This process is initiated with four sets of plans showing the
proposed modifications, a cover letter describing in detail the proposed changes and
requesting the determination of "minor", and a fee of $100.00. The determination
will be made within approximately one week. Those projects deemed "major" must
be processed through the complete site plan process initiated by requesting a pre-
application meeting. Once determined "minor", applications for building permits may
be submitted to the Building Division by the applicant or his/her designee.
NOTE: INTENSIFICATION OF NON-CONFORMING SITES, OR CHANGES IN
USE, MAY INITIATE REVIEW AND RECTIFICATION OF EXISTING NON-
CONFORMITIES SUCH AS NUMBER OF PARKING SPACES, PARKING LOT
LAYOUTS, AND LANDSCAPING.

Dear Mr. Mandel:
Kimley-Hom and Associates, Inc. has undertaken a shared parking analysis for
the Forum Shoppes and Professional Center located in the southeast corner of
Congress Avenue and Boynton Beach Boulevard, in the City of Boynton Beach,
Florida. The existing development on the site contains retail/restaurant uses, a
medical office that is currently under construction, and a movie theater that IS no
longer in operation. It is proposed to convert the vacant theater buIlding into
21,700 square feet ofrcstaurant space and 1,863 square feet of retail space.
Gross Parking Demand Evaluation
The application of thc City of Boynton Beach Code parking requirements to this
proposed plan results in a parking supply requirement of 453 parking spaces. As
shown on the site plan, 405 parking spaces will be provided upon completion of
the medical office building and conversion of the movic theater space. This
results in a 48 parking space shortfall based upon code requirements. Because the
proposed development is to accompany existing land uses that have ditTerent
time-of-day parking demand characteristics, an evaluation was undertaken to
determine the extent to which parking supply may be shared between the various
uses. This analysis assumes that all uses are built to their proposed size and are
fully occupied.
Shared Parking Analysis
Shared parking analyses are typically based upon the methodology developed by
the Urban Land Institute (ULl). The ULl Shared Parking report contains parking
accumulation percentages by time of day for a number of different types of land
uses that have shared parking potential. Additionally, these demands vary
depending upon the time of year and whether or not it is a weekday or weekend.

The medical office rates published by ULI are the same for both weekend and
weekday conditions. It is expected that at least half of the weekday medical
office traffic will not visit the office on the weekend. This discount was used in
the analysis and is shown in Table 2A.
During the weekday, the peak shared parking demand is 340 parking spaces,
which occurs at I :00 p.m., as shown in Table 2F. On weekends, the peak
expected demand is 369 parking spaces, which occurs at 12:00 p.m., as shown in
Table 2II.
The Forum Professional Center includes a total of 405 parking spaces on the
proposed site development plan. Based on the expected peak shared parking
demand of 369 parking spaces, the site is therefore expected to have a surplus of
36 parking spaces when the potential of shared parking is considered.
Conclusion
The foregoing analysis shows that the parking supply provided on the site is
expected to adequately accommodate the parking demand with the proposed plan
of development.

The above referenced Site Plans, received on 5/07/07, was reviewed for Public Works, Engineering, and
Utilities against the requirements outlined in the City of Boynton Beach Code of Ordinances. Following
are our comments with the appropriate Code and Land Development Regulations (LOR) referenced.
PUBLIC WORKS - SOLID WASTE
1. Prior to permit application contact the Public Works Department (561-742-6200) regarding the
storage and handling of refuse per the CODE, Section 10-26 (a).
2. Correspondence dated 4/30/07, accompanying this minor modification, indicates that two dumpsters
are being provided. Only one is found on the plan, at the southeast corner of the building. Please
indicate location of second dumpster.
3. Indicate by note that the site dumpster enclosure shall be constructed in accordance with City
Standard Drawing G-4.
PUBLIC WORKS - FORESTRY & GROUNDS
No comments at this time.
PUBLIC WORKS - TRAFFIC
4. On the Site and Civil plans, show and identify all necessary traffic control devices such as stop bars,
stop signs, double yellow lane separators striping, directional arrows and "Do Not Enter" signage, etc.
Delineate and stripe the "Loading Area" (LDR, Chapter 2, Section 11.J); include a pavement
message in yellow indicating "No Parking - Loading Zone". See City Standard Drawings "K" Series
for striping details.
5. Provide Fire Lanes in accordance with the LDR, Chapter 23, Article II, Section B.2 and Section M.
6. Provide an Administrative Waiver request to allow use of the original parking stall dimension for this
site. The request is to be directed to the Senior Engineer for processing.
ENGINEERING
7. Provide a site survey, no older than six months, in accordance with the LOR, Chapter 4, Section 7.A.

8. All comments requiring changes and/or corrections to the plans shall be reflected on all appropriate
sheets.
9. Please note that changes or revIsions to these plans may generate additional comments.
Acceptance of these plans during the minor modification process does not ensure that additional
comments may not be generated at permit review.
UTILITIES
10. No utility plan was included with this submittal. However, this project is an existing site located within
the Utilities' service area, and currently is served by the Utilities Dept. We are providing only a
cursory review of the proposed site plan at this time. Additional comments will be generated after a
utility plan has been submitted and reviewed.
11. All utility easements and utility lines shall be shown on the site plan so that we may determine which
appurtenances, trees or shrubbery may interfere with utilities. In general, palm trees will be the only
tree species allowed within utility easements. Canopy trees may be planted outside of the easement
so that roots and branches will not impact those utilities within the easement in the foreseeable
future. The LDR, Chapter 7.5, Article I, Section 18.1 gives public utilities the authority to remove any
trees that may interfere with utility services, either in utility easements or public rights-of-way.
12. The CODE, Section 26-34(E) requires that a capacity reservation fee be paid for this project either
upon the request for the Department's signature on the Health Department application forms or within
seven (7) days of site plan approval, whichever occurs first. This fee will be determined based upon
final meter size, or expected demand.
13. A building permit for this project shall not be issued until this Department has approved the plans for
the water and/or sewer improvements required to service this project, in accordance with the CODE,
Section 26-15.
14. Appropriate backflow preventer(s) will be required on the domestic water service to the building, and
the fire sprinkler line if there is one, in accordance with the CODE, Section 26-207.

This shall serve as our letter of record and summary of changes proposed for the old Boynton
Beach Theater located close to the intersection of Boynton beach Blvd. and Congress Avenue
proposed for minor site plan modification.
Our client proposes to modifY the existing structure to completely ref ace the building and by
doing so, bring the building up to current code for structure and building. A number of minor
site plan remedial revisions are proposed but are considered minor in overall modifications.
Listed below are the items:
Provide a protected entrance to the remodeled building in two locations with striped
cross entrance.
Reconfigure parking to add one more parking space
Reconfigure parking to add Handicapped parking with curb ramps and sloped access
