This letter is in response to your letter dated September 7,2007, wherein you opine that the above-
referenced item should not be reviewed by the advisory boards. In brief, the review process and
schedule is based on Chapter 1.5, Section 4.3 (B) of the Land Development Regulations, which lists
the application types that are reviewed by the Planning & Development Board prior to the City
Commission's review; paragraph "C" which describes the Community Redevelopment Agency's
(eRA) role; and the fact that the item involves the Zoning Regulations generally, rather than a site-
specific application. It has been our normal procedure to forward such applications to both advisory
boards prior to consideration by the Commission.
However, iftime is an issue, please recall that ifthere are special conditions or a hardship that warrant
a more expeditious review, the City Commission can modify the schedule to allow the item to be heard
at the next Commission meeting (rather than being heard at the second Commission meeting following
the final board review). Furthermore, given the Commission's current dual role, it may not be
necessary for the item to be reviewed by the CRA as well. I will confer with the City Attorney on this
matter and inform you of our position.

We respectfully submit that the Administrative Appeal for Makrista Baby only be heard by
City Commission. A recommendation by the Planning and Development Board and the Community
Redevelopment Agency ("CRA") should not be necessary.
Subsection B of Article 7, Section 1 of the Land Development Regulations (""LOR's") states
that new appeals will be forwarded to the appropriate appeal board for placement on the board's
next available agenda. This section of the LOR's references a single board as opposed to review by
multiple boards. Further, there is no reference to review by multiple boards anywhere within Article
7, Appeals, of the LOR's. In addition, Section 1, Subsection E, Hearing of Appeals, only contains
reference to a singular hearing during which any party may appear in person by agent or by attorney.
Moreover, three (3) hearings for this appeal places a severe economic burden on the appellant.
Accordingly, we do not believe it is necessary that this Administrative Appeal be reviewed for
a recommendation to the City Commission. the Planning and Development Board or the CRA
Board. The City Commission, in its decision-making capacity, is entrusted with the ability to
reverse, affirm or modify the decision of the Administrative Official. Thus, please remove this item
from the PI ning and Development Board agenda of September 25, 2007 and the CRA Board
agenda of ctober 9, 2007.

use within the C-1 district. Thus, the activity of photographing children in their products
and creations is equivalent to this permitted use, as these photographs would not be
developed or sold for retail.
Makrista Baby is a specialized, low traffic, small business. Their activities are
similar to those of a dressmaker and tailor, as they are merely altering, adapting and
embellishing the clothing as it currently exists for specific clienfele. Thus, the operations
of Makrista Baby should be permitted as a conditional use in the C-1 zoning district.
Additionally, if the similarity of use is granted, the use would still be subject to the
additional requirements for a conditional use, including approval by the appropriate City
Boards. This is simply small business owners wishing to conduct themselves in
accordance with the City ordinances, and thus are requesting a similarity of use in order
to do so.
