10. Applicant seeks to abandon all of S.E. 4th Ave, LESS the East 120 feet thereof
according to the Plat of SUNSET COURT, Plat Book 11, Page 29, Public Records of
Palm Beach County, Florida. The road deadends at the railroad easement; and the
portion of Fourth Avenue sought to be abandoned is being abandoned by the same
owner who is going to be proposing a development of the property.
Applicant states that all existing utilities (water and wastewater conduits) will either be
relocated if their functional purposes on S.E. 4th Avenue are to be continued, or
abandoned, provided such abandonment is agreed to by the Utilities Department.
All other utility services within this project shall be relocated at the Applicant's cost.
The abandonment of the 20-foot street right-of-way on S.E. 4th Avenue shall be so
designated on a required new boundary record plat to reflect same.
The proposed new development shall generate and submit a boundary record plat (as
a minimum) to reflect the area contained therein, the easements for utilities and storm
drainage systems, the abandonment of rights-of-way (after action by the City
Commission via ordinances), L.A.E.s, access locations(s) etc.

properties not included in your letter, and must remain in service.
We will review your application for abandonment when it is provided to staff for processing so as to

Bel/South Telecommunication Inc. has reviewed the above-referenced request provided to this
office in your December 7, 2006 correspondence and has no objection to the proposed
abandonments pursuant to the following conditions:
. That there wil/ be two (2)-four inch (4") Schedule-40 PVC conduits instal/ed along the
northernmost ten-feet (10') of the current right of way of Southeast 4th Avenue, between
Southeast 4th Street and westerly to the Florida East Coast Railroad right of way.
. Also that the above-mentioned ten-feet (10') be recorded and delivered to BellSouth
Telecommunications, Inc. as a utility easement.
. Last, should there be any relocation or adjustments of Bel/South's facilities associated
with this project, those costs would be the responsibility of the property owner.

We have reviewed the properties enumerated in your attached letter, and as a utility, we do not appear to
have any lines or services on or across said properties. We do, however, have utility lines in the short
section of SE 4 th Ave. lying west of SE 4th Street, but east of the FEC Railroad. Those lines serve
properties not included in your letter, and must remain in service.
We will review your application for abandonment when it is provided to staff for processing so as to
determine the exact limits of your request, and provide further comment at that time. Please therefore
provide a precise survey with your application for abandonment.
