I have been informed by Ms. Kathleen Zeitler, via e-mail, that the Seaview Park
Extension request is not necessary and that our request has been considered
withdrawn. A copy of this e-mail is enclosed.
I am confirming with you that per LOR Chapter 4, Section 5, the building permit
(#07 -6892) for the first vertical phase of the project, which the building permit is now
void, vested the project although commencement of the project has not yet taken place.
Thus, I am confirming with you that further extension requests will never be needed as
the site plan is now vested. In addition, I am also confirming that the only action our
client must take in order to move forward with this project is to apply for a new building
permit
If this information is not correct, please contact me as soon as possible.

Good Morning Jason,
Please be advised that your request for a 4th site plan time extension for the Seaview Park Club
is not necessary and your pending application request is considered withdrawn. Per Chapter 4,
Section 5 of the LDR, the event that "stops the clock" and saves the expiration of the site plan is
the issuance of a building permit, rather than the actual commencement of development. In
your letter to Mike Rumpf dated October 8th you state that your client went so far as to secure
a building permit for the first vertical phase of the project. This has been confirmed with the
Building Division - their records show a permit issued for construction of the first building (#
07-6892). The permit was good for 6 months, and with no activity it is now considered void.
But the issuance of this building permit has vested the project and the only action your client
needs to take (whenever they are ready to go forward) is to reapply for another building
permit. Please accept my apology for the delay in realizing this and for any inconvenience this
may have caused. If you have any questions, please let me know. Thank you.

Located north of NE 15th Place (Yachtsman's Cove) on the east side of N Federal Highway
This letter is in response to your request for written confirmation that a site plan time extension for
Seaview Park Club is not necessary due its vested development status. According to Chapter 4,
Section 5 of the Land Development Regulations, the applicant shall have eighteen (18) months
(formerly 12 months) from the date of site plan approval to secure a building permit from the
Development Department. Building Division records indicate that a building permit (#07-6792) was
issued for this project for vertical construction of the first townhouse building. The issuance of this
building permit vested the project for the approved development. The permit was issued based
upon approved final construction plans that were rectified to comply with all conditions of site plan
approval and the payment of permit fees. Although building permit 07-6792 has since become void
due to inactivity, the project does remain vested. Prior to actual commencement of development,
your client will be required to request and secure a reissued building permit, or secure a new
building permit from the Building Division.
Traffic concurrency approval for this project is based on a build-out year of 2009. No building
permits are to be issued by the City after the build-out year specified by the traffic concurrency
approval. Therefore, a revised traffic concurrency approval from Palm Beach County with an
updated build-out date of 2010 or later will be required should you not commence construction this
year. The project is still subject to the original 60 conditions of the site plan approval and
subsequent conditions of minor site plan modification approvals and site plan time extension
approvals. Lastly, the utilities capacity reservation fee for Seaview Park Club IPUD will expire in
February, 2009. Utilities records indicate the annual utility reservation fee is once again due. The
renewal fee, based upon new units including the clubhouse is $1,524.60. Without payment of the
reservation fee, the Utilities Department cannot guarantee capacity will be available when the
developer is ready to move forward.

We have renewed the permit that was pulled and are hopeful that there is some improvement
in the market that would make it feasible to begin additional construction on the project. We
continue to monitor the market, but I think we all know its current state - both from a buyer
and a financing perspective. We will be requesting another extension of the permit.
We very recently completed a pretty nice dock/marina facility for the project.
Let's cross our fingers for a quick market recovery going forward.
If you or Mr. Rumpf require any additional information, please let me know. We really
appreciate your help and the city's help in this extraordinarily difficult time in the real estate
market.
