We are in receipt of your request for an Administrative Waiver to the Engineering Design Handbook
& Construction Standards, Standard Detail K-1, dated October 30,2006. The standard requires a
minimum aisle width (backup distance) of 22-ft. for 600 angled parking from which you wish a 2-ft.
reduction.
This change has been requested due to minor changes in the overall site plan and to accommodate
site limiting factors. The site is encumbered on the south side of the lot by a LWDD easement.
Further, this site is now restricted to the north as the adjacent lot is no longer under common
ownership. However, as proposed, there is an additional 2-ft. of space available adjacent to (and
north of) the drive aisle containing landscaping. This space will be utilized as a "backing overhang",
thus providing the needed overall 22-ft. backing'dimension needed for 600 angled parking.
Subsequently, and in accordance with procedures established in the Engineering Design Handbook
& Construction Standards, your request is hereby approved.

The above referenced Minor Modification Plan, received on October 31, 2006, was reviewed against the
requirements outlined in the City of Boynton Beach Code of Ordinances. This minor modification is for a
reduction in the backing distance for the parking spaces on the north side of the proposed restaurant.
The applicant proposes a reduction of 2-ft. (from 22-ft. to 20-ft. for 600 angled parking.) The applicant
provided a "Request for Administrative Waiver" with the minor modification. The administrative waiver
will be approved and is being processed at this time.
Thus, we have no objection to the proposed site plan modification.

The above referenced Minor Modification Plan, received on October 23, 2006, was reviewed against the

relocation of the dumpster enclosure due to not receiving permission from LWDD to allow the dumpster
to be placed with in their right-of-way easements.
Following please find my comment. Please contact me if you have questions or need clarification of this
item.
1. The Dahoon Hollies proposed adjacent to the dumpster enclosure (west side) may cause a vertical
conflict with high profile vehicles. Consider replacing with a palm species.
We have no objection to the proposed site plan modification with the above condition of approval.

Dear Ms. Logan:
The purpose of this letter is to respectfully request that the Public Works/Engineering Division
review the proposed amendments to the approved site plan for the Sonic Property and confirm
and process these amendments as a waiver (along with the Planning and Zoning Division
processing the amendment to the site plan as a minor modification). The amendments to the
approved site plan are as follows:
1. Reduce the driveway aisle (from 22 feet to 20 feet) that runs along the north side of the
proposed restaurant and add a 2-foot backing overhang on the property to the north.
Originally the driveway aisle was approved at a 22-foot width (meeting the requirements of
Engineering Design Handbook and Construction Standards drawing K-1, Parking Stall & Aisle
Dimensions), however, there are site limiting factors requiring the reconfiguration. First, the
northern boundary of the site cannot be expanded any further north since the vacant property to
the north is now under separate ownership. Next, the structure cannot be shifted any further
south since no part of the structure can be located within the Lake Worth Drainage District
(L WDD) easements that encumber most of the southern portion of the property. Lastly, the 4-
foot sidewalk located in between the that runs along the northern side of the restaurant cannot be
reduced nor eliminated since this sidewalk is vital to the operation of the approved restaurant, as
well as providing the necessary access for the handicapped parking space on that side of the
restaurant. Therefore, after a discussion that Jon Schmidt had with you it was our understanding
that the driveway aisle could be reduced to 20 feet and that a 2-foot backing overhang would be
provided along the south property line of the vacant property to the north to compensate for the
2-foot reduction. This backing overhang will be provided as shown on the enclosed site plan.

Per Chapter 4, Section 9, Modification of approved site plan, of the City of Boynton Beach Land
Development Regulations the following is the definition of a minor site plan modification:
A non-impacting modification which will have no adverse effect on the approved site and
development plan and no impact upon adjacent and nearby properties, and no adverse
aesthetic impact when viewed from a public right-of-way as determined by the planning
and zoning director.
Furthermore, it is stated in this section that in making a minor/major modification determination,
the planning director shall consider the following (with responses for the Sonic Property in bold):
1. Does the modification increase the buildable square footage of the development by
more than five (5) percent.
a. Response: The modification will not increase any of the buildable square
footage.
2. Does the modification reduce the provided number of parking spaces below the
required number of parking spaces.
a. Response: The modification will not reduce the number of parking spaces.
3. Does the modification cause the development to be below the development standards
for the zoning district in which it is located or other applicable standards in the Land
Development Regulations.
a. Response: The modification will cause the driveway aisle to be below the
standards of the Engineering Design Handbook and Construction
Standards drawing K-l, Parking Stall & Aisle Dimensions, however, the
inclusion of the 2-foot backing overhang on the property to the north will
compensate for this.
4. Does the modification have an adverse effect on adjacent or nearby property or
reduce required physical buffers, such as fences, trees, or hedges.
a. Response: The modification will require the 2-foot backing overhang to
overlap with the landscape buffer for any project that is proposed for the
vacant property to the north, however, the necessary landscaping for this
buffer will still be provided.
5. Does the modification adversely affect the elevation design ofthe structure or reduce
the overall design of the structure below the standards stated in the community
design plan.
a. Response: The modification will not adversely affect any of the proposed
elevation of the structure.
6. Does the modified development meet the concurrency requirements of the Boynton
Beach Comprehensive Plan.
a. Response: The modification will not affect any concurrency requirements
of the Boynton Beach Comprehensive Plan.

Dear Mr. Breese:
The purpose of this letter is to respectfully request that the Planning & Zoning Division review
the proposed amendments to the approved site plan for the Sonic Property and confirm and
process these amendments as minor modifications. The amendments to the approved site plan
are as follows:
1. Relocate the dumpsters and the 19' X 26' dumpster enclosure from the southeast comer
of the property to the northeast comer of the proposed restaurant structure; and
2. Reconfigure the loading zone servicing the restaurant.
The purpose of the amendments described above are due to the approved locations of the
dumpsters and enclosure falling within both an existing 40' Lake Worth Drainage District
(LWDD) Drainage Easement (easement recorded in Official Records Book 9742, Pages 199-
203) and an existing 25' LWDD Right-of-Way (ROW) Easement (easement recorded in Official
Records Book 2370, Page 595). As such, LWDD will not permit the dumpsters and enclosure
within said easements so that their access to the property to the east will not be obstructed.

Development Regulations the following is the definition of a minor site plan modification:
A non-impacting modification which will have no adverse effect on the approved site and
development plan and no impact upon adjacent and nearby properties, and no adverse
aesthetic impact when viewed from a public right-of-way as determined by the planning
and zoning director.

Furthermore, it is stated in this section that in making a minor/major modification determination,
the planning director shall consider the following (with responses for the Sonic Property in bold):
1. Does the modification increase the buildable square footage of the development by
more than five (5) percent.
a. Response: The modification will not increase any of the buildable square
footage.
2. Does the modification reduce the provided number of parking spaces below the
required number of parking spaces.
a. Response: The modification will not reduce the number of parking spaces.
3. Does the modification cause the development to be below the development standards
for the zoning district in which it is located or other applicable standards in the Land
Development Regulations.
a. Response: The modification will not cause the development to be below
any applicable standards.
4. Does the modification have an adverse effect on adjacent or nearby property or
reduce required physical buffers, such as fences, trees, or hedges.
a. Response: The modification will not adversely affect any adjacent or
nearby properties and will not reduce any required physical buffers. The
relocation of the dumpsters and enclosure will internalize them and they
will be further away from the perimeter of the property.
5. Does the modification adversely affect the elevation design of the structure or reduce
the overall design of the structure below the standards stated in the community
design plan.
a. Response: The modification will not adversely affect any of the proposed
elevation of the structure. Also, the finish of the dumpster enclosure will
still resemble the materials design and finish of the primary structure.
6. Does the modified development meet the concurrency requirements of the Boynton
Beach Comprehensive Plan.
a. Response: The modification will not affect any concurrency requirements
of the Boynton Beach Comprehensive Plan.

7. Does the modification alter the site layout so that the modified site plan does not
resemble the approved site plan.
a. Response: The modification will alter the site layout, however the site plan
amendment is necessary in order to allow for dumpsters on-site while not
affecting any existing easements.
