The Dahoon Hollies proposed adjacent to the dumpster enclosure (west side) may cause a vertical conflict with high profile vehicles. Consider replacing with a palm species. The amendments to the approved site plan are as follows: 1. Reduce the driveway aisle (from 22 feet to 20 feet) that runs along the north side of the proposed restaurant and add a 2-foot backing overhang on the property to the north. Originally the driveway aisle was approved at a 22-foot width (meeting the requirements of Engineering Design Handbook and Construction Standards drawing K-1, Parking Stall & Aisle Dimensions), however, there are site limiting factors requiring the reconfiguration. First, the northern boundary of the site cannot be expanded any further north since the vacant property to the north is now under separate ownership. Next, the structure cannot be shifted any further south since no part of the structure can be located within the Lake Worth Drainage District (L WDD) easements that encumber most of the southern portion of the property. Lastly, the 4- foot sidewalk located in between the that runs along the northern side of the restaurant cannot be reduced nor eliminated since this sidewalk is vital to the operation of the approved restaurant, as well as providing the necessary access for the handicapped parking space on that side of the restaurant. Therefore, after a discussion that Jon Schmidt had with you it was our understanding that the driveway aisle could be reduced to 20 feet and that a 2-foot backing overhang would be provided along the south property line of the vacant property to the north to compensate for the 2-foot reduction. Furthermore, it is stated in this section that in making a minor/major modification determination, the planning director shall consider the following (with responses for the Sonic Property in bold): 1. Does the modification increase the buildable square footage of the development by more than five (5) percent. a. Response: The modification will not increase any of the buildable square footage. 2. Does the modification reduce the provided number of parking spaces below the required number of parking spaces. a. Response: The modification will not reduce the number of parking spaces. 3. Does the modification cause the development to be below the development standards for the zoning district in which it is located or other applicable standards in the Land Development Regulations. a. Response: The modification will cause the driveway aisle to be below the standards of the Engineering Design Handbook and Construction Standards drawing K-l, Parking Stall & Aisle Dimensions, however, the inclusion of the 2-foot backing overhang on the property to the north will compensate for this. 4. Does the modification have an adverse effect on adjacent or nearby property or reduce required physical buffers, such as fences, trees, or hedges. a. Response: The modification will require the 2-foot backing overhang to overlap with the landscape buffer for any project that is proposed for the vacant property to the north, however, the necessary landscaping for this buffer will still be provided. 5. Does the modification adversely affect the elevation design ofthe structure or reduce the overall design of the structure below the standards stated in the community design plan. a. Response: The modification will not adversely affect any of the proposed elevation of the structure. 6. Does the modified development meet the concurrency requirements of the Boynton Beach Comprehensive Plan. a. Response: The modification will not affect any concurrency requirements of the Boynton Beach Comprehensive Plan.
