Federal Highway Original: September 19, 2007 Revisions: Application for Annexation, Land Use Amendment/Rezoning & Site Plan Project Description & Justification Statement Proiect Description Pursuant to our pre-application conference on June 28, 2007, this application requests the annexation of a .37 acre property located on the east side of Federal Highway near the southem boundary of the City. Along with the annexation is a request to change the land use from the County designation of Commercial High, CH/5 (underlying residential density of 5 units per acre) to the City's Local Retail Commercial (LRC) and also the zoning from the County's CG district to the City's C-3 district. A site plan application is also included to show how the site is to be redeveloped utilizing the existing building. Historically, the site was developed and used as for commercial retail use known as Gulfstream Carpet. The building has been unoccupied for several months. The new owner of the property, JER ENTERPRISES, LLC, intends to refurbish the existing building, improve the parking and landscaping according to current code requirements and use the site for professional offices. The existing building consists of 2,400 square feet. Based on the building being used for professional offices, the required parking at a rate of 1 space for every 300 square feet requires 8 parking spaces. As indicated on the Site Plan, 9 parking spaces are proposed to be provided. The property is surrounded to the east by single family homes within the Trade Winds Estates subdivision that is under the jurisdiction of Palm Beach County. To the south is an undeveloped property that was recently approved as Tuscan Villas for 22 townhouse units by the City of Boynton Beach. To the east is Federal Highway and across Federal Highway is the site approved as Gulfstream Gardens which has not begun its development of multi-family units. To the north exists the retail commercial use of J&L New Antiques and Outdoor Patio that sells antiques, fumiture and outdoor statues. Landscape buffers are proposed for all sides of the property. A 7 foot wide buffer area is required along Federal Highway, however, as shown on the submitted plans, 16 feet is being provided to give separation from the roadway to the parking spaces within the project. Adjacent to the retail commercial to the north is a 2.5 foot wide buffer as required by City Code. A 5 foot buffer is provided adjacent to the residential uses along the east and south property lines. Although the Code requires walls within the buffers where commercial use abuts residential uses, there are either existing or approved walls or fences on the adjacent properties both to the east and south. To the east is an existing 6 foot high wooden fence. Rather than creating a hiatus between two walls/fences, this application proposes a 6 foot high chain link fence along the east property line along with a hedge that will grow into the fence and fill the area between the chain link and wooden fences. According to discussions with City staff, a wall is proposed along the north property line of the project to the south. Once again, proposing a wall on the subject property would create -. Page 2 a hiatus between two walls which can be problematic for maintenance, loitering, etc. Therefore, we are requesting the requirement of a wall along the south property line be waived. Landscaping is proposed around the entire perimeter as indicated on the attached Landscape Plans. As discussed at our pre-application conference, the professional office use is not anticipated to generate a great deal of solid waste. Accordingly, we are proposing to use roll-out containers that will be rolled to the street on pick up days. The roll out containers will be located at the southwest corner of the building. utilities are generally located near the site and can serve the existing building. A private lift station is required for sewer service and is proposed to be located along the south side of the existing building. The proposed utilities and lift station are shown on the plans with details on the respective Engineering Plans. A drainage statement is also provided to confirm that sufficient drainage and outfall is proposed by the redevelopment of the site. A traffic statement has not been provided considering the equivalent and insignificant impact of traffic from the prior use of the property to the proposed use. The building is proposed to be improved architecturally by adding embellishments to the facade, re-stuccoing and closing off the existing overhead door on the north side of the building. The attached architectural elevations reflect the enhancements and the proposed finishes, materials and colors for the building. A sign exists along the property frontage. The sign was recently permitted and installed under the regulations of Palm Beach County, prior to this application. Accordingly, the sign is legally non- conforming to City regulations. Justification statement This site has historically been used for commercial retail purposes within the unincorporated area of Palm Beach County. The property to the south as well as across Federal Highway to the west is within the City of Boynton Beach and contiguous to the subject property making it eligible to be annexed. The LRC land use and C-3 zoning are comparable to the County's designations of CH/5 and CG respectively. The land use and zoning are consistent with the commercial retail that exists to the north. Buffering and setbacks are being provided along the south and east property lines where adjacent to residential uses. The building and use itself is simply being reinstated after being unoccupied for several months. The approval of these applications will bring the property into the City and be an asset to the City's tax base as well as an aesthetic improvement to the property and surrounding area. The approvals will allow the present owner to proceed with the required permitting to improve the site and building and occupy the property for their use as professional offices.
