Your request for site plan time extension is scheduled for the January 23, 2007 Planning &
Development Board meeting and the February ~ 2007 City Commission meeting. The
following are very important items to complete by the stated deadline dates to stay on these
agendas:
1.
Submit a revised justification letter which details the following:
accomplishments since City Commission approval which demonstrate your "good
faith" efforts in securing a building permit for the project (i.e. purchased
property, obtained other necessary permits, percentage of construction drawings
complete, building permits applied for, fees paid for utility capacity reservations,
impact fees paid, where revised building permit drawings are in the review
process, and when it is expected that the building permit will be issued). Also
explain in more detail what events occurred which took considerably more time
than expected and reasons why. This justification will be the basis for the
request and the length of the extension
considered (6 months, or 12 months).
You may fax this letter to my attention.

within a 400 foot radius of the subject property. For a site plan time extension
this has to be completed no later than 10 days prior to the first public hearing,
which means January 13, 2007 is your deadline for noticing. Attached is a
copy of the previous notice for the conditional use / site plan approval which can
be modified and updated (agent, request, proposed use, hearing dates, etc.).
You may want to have us review it for accuracy before mailing. Also attached is
the sign information needed. Photos of the posted sign(s), and a copy of the
notice mailed should be taken to the City Clerk by the deadline, where you will
need to sign an affidavit that you have completed the noticing required by the
applicant.
3. Staff is currently recommending a condition of approval that traffic concurrency
approval be obtained prior to the issuance of a building permit. This should have
been included as a condition of approval for the conditional use / new site plan.
Attached is the latest correspondence from the PBC Traffic Division dated
September 14, 2004 for this project. Masoud Atefi has confirmed that he
received no response to this letter and the project does not have the required
traffic concurrency approval.
Please keep me advised of your progress on the above. If you have any questions, or need
