Dear Mr. Ballbe:
In response to your request date-stamped December 7, 2006 and most
recent response letter date-stamped March 21, 2008, for the
administrative review and approval of the modifications proposed to
the above-referenced approved site plan, depicting the following:
· Modification of the front entry gate (as depicted on the
attached drawing)
Please be informed that the proposed changes on the revised plan
date-stamped 3/21/08 are "minor" as defined within the Land
Development Regulations, Chapter 4 - Site Plan Review. This project
may continue to be processed by the Building Division as a permit
application, subject to the following conditions:
1. The Traffic Markings plan (Sheet #TM1 of 1) incorrectly
identifies the "Through/Turn" pavement markings as Rl-2
("Yield") signs. Per the MUTCD, pavement markings do not
have a set designation. Please correct this on the permit
drawings.
2. Prior to the receipt of any further Certificates of
Occupancy, Provide a hold-harmless agreement for the portion
of sanitary sewer main that runs under the entry bridge. A
standard hold-harmless agreement can be found in Exhibit "M"
of either the Engineering Design Handbook & Construction
Standards or the Utili ties Engineering Design Handbook &
Construction Standards.
3. Acceptance of these plans during the Minor Site Plan
Modification process does not ensure that additional comments
may not be generated during permit review.

Dear Mr. Breese:
Pursuant to the staff review comments dated February 29, 2008 for the minor modification
request 1.0 the entrance at the above referenced project, we offer the following response:
1. A "no right turn" sign has been added at the west gate (eastbound approach). "Residents
keep right" sign has been removed to avoid confusion.
2. Stop signs have been added to the east and west gate at the stop bars. Please note that
buildings number I, 2 & 5 will not be constructed within the near future and therefore,
the entrance revisions are proposed to meet the existing site conditions (temporary sales
center and construction trailer). Developer will apply for another modification at the time
of applying for a building permit for these buildings.
3. Residents will be utilizing clicker devices for access.
4. The Boynton Utilities Department has already accepted the utilities and they have been
conveyed. Also, they are aware of the bridge existence and have not requested a Hold
Harmless Agreement or Waiver. Please discuss this item with Peter Mazzella and if
required, let me know so we can prepare a Hold Harmless Agreement.
5. There are no proposed structures in this submittal; all structures are existing and
constructed as per the approved plans. Enclosed please find a copy of the water and
sewer plan approved by the Utilities Department. Applicant will not be subject to a
review of the utilities as they are existing, approved and conveyed to the City.
6. Plans have been revised to depict existing conditions.

The City of Boynton Beach staffhas reviewed your February 7,2008 responses to our May 21,2007
letter regarding the above-mentioned project. The following comments are being forwarded to you
for your review and response:
1. Ifthe west gate is for egress only (both lanes?), then that is all the more reason to add a "No
Right Turn" sign on the eastbound approach. (The west gate is the gate closest to the main
entrance, east gate refers to the gate directly east of the main entrance and south gate is the
gate entering/exiting on to Chukker Rd.)
2. Ensure "Stop" signs are placed at the stop bars on the egress aisle at both the east and west
gates. Stop bars are not to be used alone (per the MUTCD) but to supplement a stop sign,
traffic control signal or some other traffic control device. Per City and County Standards,
add double lane separators at each stop bar/stop sign location. The gates alone are not
sufficient visual reference to motorists to stop. The gates are painted black and would not be
readily visible at night.
3. Signing at the entrance directs residents to keep right, however the card reader/call box is on
the left side of the two-lane entrance. Please indicate if residents will be utilizing clicker
devices for access.
4. The main entry feature bridge crosses a sanitary sewer main. This violates City standards
that do not allow structures within utility easements. The applicant/developer will be
required to obtain a waiver from the Utilities Department allowing this configuration, as well
as executing a Hold Harmless Agreement. Utility staff finds no evidence of approval for this
arrangement. Should you have any written documentation to the contrary, please submit it
with your responses to the other outstanding items.
5. Show proposed utilities and utility easements on each ofthe plans submitted for Minor Site
Plan Modification so that conflicts between the proposed structures and utility lines (water
and sewer) may be evaluated.
6. The plans provided (Key, P-l, TMl of 1, and A-9) do not correctly depict the field condition
ofthe gates at the west entrance. It shows the one leaf swinging out (to the north); the actual
condition is the leaf sliding to the east. Please correct plans.

driveway located to the south is for "exit only" and the gates will not operate when the
visitors or residents obtain approval to enter the site.
3. Stop bar striping has been added to the egress lanes (westbound and northbound) at the
gate locations as a reference for traffic to use while waiting for gates to open. No stop
sign or double yellow striping has been added because the gates are being use as a
reference to stop and not to overpass other vehicles.
4. "Keep Right" sign has been added at the egress of the east gate.
5. "Right Lane Residents Only" sign has been added at the entrance to direct residents to the
correct lane.
6. New entry feature located north of the entrance is a fountain with a tower. The total
impervious area is 412 s.f. and therefore, no revised plan will be required.
7. Sidewalk has been added on the south side of the entrance to connect to sidewalk along
US1.
8. Main entry feature does not encroach over 8" main with the exception of the "bridge"
over which is 14' minimum in height. The entry feature and utilities have been approved
by the Utilities Department (see attached scketch).

landscaping to be evaluated. Please provide a copy of revised landscape plans for this
purpose.
2. Add a "No Right Turn" sign on the eastbound approach to the west gate. It appears that, with
those gates open, vehicles will cross into the egress traffic making the right turn maneuver.
The plans depict swing gates that open out into traffic approaching from the entry. At the
site it appears that the contractor/developer plans to install sliding gates, as the concrete base
guide has been placed. Revise the plans to depict the desired configuration.
3. Add stop bars, "Stop" signs, and double yellow lane separators for the egress aisle at both the
east and west gates.
4. Add a "Keep Right" sign at the egress of the east gate.
5. Show location of signage at the main entry directing residents and guests into the correct
lanes.
6. New entry features have been added at the main entrance and on the north side of the main
entrance. Provide information regarding the proposed area for drainage design purposes. If
the proposed structures increase the impervious area by 800-S.F. or more a revised drainage
plan will be required.
7. The proposed changes appear to eliminate the sidewalk between the gates and Federal Hwy.
The plans show the sidewalk being placed on the south side ofthe main entry, however the
sidewalk was not placed when the entry feature was constructed. Indicate how and where
pedestrian traffic will be handled.

Pete,
You should have received the original memo via e-mail yesterday. Ed talked me into going
out to the job (sure am glad he did and I did) and found out that the plans don't really
look like the final product. In any event I think they may have to spend a little money
to correct the deficiencies. Probably the biggest issue, cost-wise, will be the water
main easement/entry feature conflict. Expect to hear from them in the near future. I
don't think they have adequate clearance under the entry feature to operate machinery if
repairs to the water main are required at that location.
Let me know if you have questions, or need additional information about this minor
modification. If you would like I can get you a copy of the minor modification plans -
it's just a couple of sheets.

After our site visit to Waterside this morning (5/16/07) I would like to add (or amend)
comments that were sent on the minor modification application currently under review.
* First - the modifications have apparently already been installed. The
applicant/developer should be advised that changes to the site plan are to be approved
prior to constructing them. There is the potential for costly changes to the site from
the City's comments since the modifications have already been installed.
* Add a Comment #11: The main entry feature crosses an 8-in water main. This
violates City standards that do not allow structures within utility easements. The
applicant/developer will be required to obtain a waiver or variance from the Utilities
Department allowing this configuration.
* Add to Comment #2: The plans depict swing gates that open out into traffic
approaching from the entry. At the site it appears that the contractor/developer plans to
install sliding gates as the concrete base guide has been placed. Revise the plans to
depict the desired configuration.
* Comment #8: Add after the first sentence - The plans show the sidewalk being placed
on the south side of the main entry, however the sidewalk was not placed when the entry

9. New entry features have been added at the main entrance and on the north side of the main
entrance. Provide information regarding the proposed area for drainage design purposes. If the
proposed structures increase the impervious area by 800-S.F. or more a revised drainage plan will
be required.

10. Show proposed utilities and utility easements on the plans so that conflicts between the proposed
structures and utility lines (water and sewer) may be evaluated.

swinging door to a sliding gate.
