AN EMERGENCY ORDINANCE OF THE CITY OF
BOYNTON BEACH, FLORIDA ADOPTING, BY
REFERENCE, AS VIOLATIONS OF THE CODE OF
ORDINANCES OF THE CITY OF BOYNTON BEACH,
FLORIDA ANY ACT WHICH IS OR SHALL BE RECOG-
NIZED BY THE LAWS OF THE STATE OF FLORIDA
AS A MISDEMEANOR; PROVIDING A SAVINGS CLAUSE,
RE PEALING PROVISIONS, PENALTY CLAUSE,
AUTHORITY TO CODIFY, AN EFFECTIVE DATE,
AND FOR OTHER PURPOSES.
PREAMBLE
This Ordinance is deemed to be an emergency measure enacted for the
immediate preservation of the public peace, property, health and safety of the
inhabitants of the CITY OF BOYNTON BEACH, FLORIDA and for the effective
daily operation of the municipal police department.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH, FLORIDA:
SECTION 1: That Section 17-42.1 of the codified ordinances of the
CITY OF BOYNTON BEACH, FLORIDA, which is set forth in full hereinafter~
'i is hereby re-enacted and re-adopted:
Section 17-42.1~. State misdemeanors.
It shall be unlawful for any person to commit, within the corporate
limits of the City of Boynton Beach, Florida, any act which is or
shall be recognized by the laws of the State of Florida~as a mis-
demeanor, and the commission of such acts is hereby forbidden
and declared a violation of this section.
Whosoever shall violate the provisions of this section, upon
conviction thereof, shall be punished by the same penalty as is
therefor provided by the laws of the State of Florida, but in no
case shall such penalty exceed a fine of five hundred dollars
($500. 00) or imprisonment for more than ninety (90) days, or
both fine and imprisonment in the discretion of the municipal judge."
SECTION 2: Separability. Each of the provisions of this ordinance are
separable, including word, clause, phrase, or sentence, and if any provision
hereof shall be declared invalid, the remaining portion shall not be affected
but shall remain in full force and effect.
SECTION 3: Repealing Provisions. All ordinances or parts of ordin-
ances in conflict herewith are hereby repealed.
SECTION 4: Authority to Codify. Authority is hereby granted to codify
and incorporate this ordinance in the City's existing code.
SECTION 5: Penalty Clause. Any person, firm or corporation con-
victed of violating the provisions of this ordinance shall upon conviction thereof
be penalized by fine not exceeding $500. 00 or by imprisonment in the municipal
jail for a period not exceeding~Wdays or by both such fine and imprisonmen'
Any day upon which the violation exists or continues shall be deemed a separate
and distinct offense.
SECTION 6: Effective Date. This ordinance is deemed to be an emer-
gency measure and shall take effect immediately upon passage.
