AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING CHAPTER 23A OF THE CODI-
FIED ORDINANCES OF SAID CITY (OTHERWISE DE-
SCRIBED AS ORDINANCE NO. 59-6) ESTABLISHING
RATES, FEES AND OTHER CHARGES FOR THE USE
OF THE SERVICES AND FACILITIES OF THE MUNI-
CIPAL SEWER DISPOSAL SYSTEM; PROVIDING FOR
AUTHORITY TO CODIFY, A SAVINGS CLAUSE, RE-
PEALING PROVISIONS, AN EFFECTIVE DATE AND
FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CLTY OF BOYNTON
BEACH, FLORIDA:
SECTION 1. That Section 23A-3 of the codified ordinances of the CITY
OF BOYNTON BEACH, FLORIDA, (otherwise described as Section 1 of Ordi-
nance 59-6) as heretofore amended, is hereby further amended to read:
"Section 1. The razes, fees and charges (herein sometimes
called the "Sewer Service Charge") for the use of, and for the services
and facilities furnished or to be furnished by, the sewage disposal
syszem, to be paid by the owner, tenant, or occupant of each lot or
parcel of land, or of any un it, apartment, or any other type of improve
merit located thereon, which may be connected with or may use the sew.

In addition to the rates set forth herein, the City Council reserves the t
right to require pre-treatment~ special rates or other ~measures necessary to!
cope with and protect the City against the introduction of unusual types of 1

waste in the City sewer system.
In addition to the rates set forth hereinabove, there is hereby establish-
ed a sewer connection charge of $100. O0 per connection, which shall be
levied against all connections made to the system later than six months after
municipal sanitary sewer service becomes available to individual properties
zn any given area of the City. Such connection charge shall be paid to the
Building Department of the City in connection with and prior to the issuance
of any building permit for property affected by this charge as set forth
hereinabove. This charge shall apply to both newly constructed and existing
buildings. -
SECTION 2: Separability. Each of the provisions of this ordinance are
separable, including word~ clause, phrase, or sentence, and if any provision
hereof shall be declared invalid, the remaining portion shall not be affected
b%%t shall remain in full force and effect.
SECTION 3: Repealing Provisions. All ordinances or parts of ordinan-
ces in conflict herewith are hereby repealed.

SECTION 4: Authority to Codify. Authority is hereby granted to codify
and incorporate this ordinance in the City's existing code.
SECTION 5: Effective Date. This ordinance shall become effective in
the manner and at the time provided by the Charter and Ordinances of the
City of Boynton Beach, Florida.
