O66-04ORDINANCE NO. 66-4 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 8-20 OF THE CODIFIED ORDINANCES OF SAID CITY .PERTAINING TO CIRCULATING CHARGES AGAINST A CANDIDATE FOR MUNICIPAL OFFICE: FURTHER PROVIDING FOR AUTHORITY TO CODIFY, A SAVINGS CLAUSE, REPEALING PROVISION, PENALTY CLAUSE, AN EFFECTIVE DATE AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF. THE CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: That Section 8-20 of the Codified Ordinances of the City of Boynton Beach, Florida be and the same is hereby amended to read: Sec. 8-20. Ci. rculating charges against any candidate; requirements. It shall be unlawful for any candidate or other person, during seven (7) days preceding the day of any election or on lhe day of any election, fo publish or circulate or cause lo be 'published or circulated any charge against or attack against any candidale unless such charge or attack has been personally served upon the candidate at least seven (7) days prior to the day of election, and any person failing to comply with this section shall, upon conviction, be guilty of a violation of the Code of the City of Boynton Beach. Any answer to a charge or attack that contains defensive matter shall not be construed to be a charge or attack. SECTION 2: Separability. separable, including word, clause, hereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. SECTION 3: Repealing Provisions. All ordinances or parts of ordinan- ces in conflict herewith are hereby repealed. SECTION 4: Authority fo Codify: Authority is hereby granted to codify and incorporate this ordinance in the City's existing code. Any person, firm or corporation convicted of violating the provisions of this ordinance shall upon conviction thereof, be penalized by fine not exceeding $500.00 or by imprisonment in the municipal jail for a period not exceeding ninety (90) days or by both such fine and imprisonment. Any day upon which the violation exists or continues shall be deemed a separate and distinct offense. SECTION 6: Effective Date. This ordinance shall become effective in the manner and at the time provided by the Charter and the Ordinances of The City of Boynton Beach, Florida. First reading this 7t~ day of February,A.
