O66-03ORDINANCE No. 66-3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTIONS 15-11, 15-13 AND 15-28 of the CODIFIED ORDINANCES OF THE CITY OF BOYNTON BEACH, FLORIDA, PERTAINING TO QUALIFICATIONS OF APPLICANTS FOR OCCUPATIONAL LICENSES, DUTIES OF SUCH LICENSEES, AND IDENTIFICATION OF VEHICLES, RESPECTIVELY; PROVIDING FURTHER FOR AUTHORITY TO CODIFY, A SAVINGS CLAUSE, REPEALING PROVISIONS, PENALTY PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER PURPOSES. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: That Section 15-11 of the Codified Ordinances of the City of Boynton Beach, Florida, be and the same is hereby amended by adding an additional sub-paragraph thereto To be designated sub-paragraF (4.) which shall read: (4.) Prior to issuance or renewal of any City Occupational license, the applicant shall furnish proof to the City License Officer that applicant has, in effect, a valid unrestricted County Occupational License issued by Palm Beach County, Florida, in all cases where County Occupational Licenses are required by law. SECTION 2: Section 15-13 of the Codified Ordinances of the City of Boynton Beach, Florida, be and the same is hereby amended adding an additional sub-paragraph thereto to be designated sub-paragrgph (6.) which shall read: (6.) In connection with any construction project within the City, it shall be the duty and responsibility of the genera] contractor to ascertain and furnish proof by affidavit to the City Building Inspector, prior to said officer conducting a final inspection, that all sub-contractors utilized on said project are duly and properly licensed to do business within the City by the City of Boynton Beach. SECTION 3: Section 15-28 of the Codified Ordinances~ of the City of Boymaton Beach, Florida, be and the same is hereby amended to read: Section 15-28. Identification of Vehicles Required. (1) Any and all trucks or other vehicles operated or used in connection with any contracting, building, delivery, maintenance, repair, service or manufacturing business or occupation conducted within the municipal limits of the City of Boynton Beach, Florida, as more particularly defined under the provisions of Section 15-4 of this Code, excluding, howeve] any profession included under the Professional Classification Section of the City's occupational license tax schedule shall have painted or otherwise prominently displayed in a visible and legible manner upon such truck or other vehicle, the name and address of the business in which such truck or other vehicle is used. For the purposes of this Section, such information shall be painted on both sides of the vehicle and the letters included in such sign shall each be a minimum heighth of two inches. (2) Any and all trucks or other vehicles operated or used in connection with any business or occupation, as more particularly defined in hereinabove, Paragraph (1),/conducted within the municipal limils of the City of Boynton Beach, Florida, shall have affixed thereto in a visible location to be designat by the City Licensing Officer, a decal identifying said vehicle, which decal shall be coded in such a manner as to make available to the City or other interested persons, the name and address of the business or occupation in which said truck or other vehicle is used. Such decal s~allbe prepared by the City Licensing Officer and issued by said Officer. SECTION 4: Separability. Each of the provisic~ s of this ordinance are separable including word, clause, phrase, or sentence, and if any provision hereof shall be declared invalid, the remaining portion shall not be affected by shall remain in full force and effect. SECTION 5: Repealing Provisions. Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6: Authority to Codify. Specific authority is hereb~ granted to codify and incorporate this ordinance in the City's existing code. --2- SECTION 7: Penalty Provisions. Any person, firm or corporation violating any of the provisions of this section shall upon conviction thereof be fined in an amount not exceeding $500.00, or by im- prisonment in the city jail for a period not exceeding 90 days, or by both suct fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such he re under. SECTION 8: Effective Date. This ordinance shall become effective in the manner and at the time provided for by the Charter and Ordinances of the CITY OF BOYNTON BEACH, FLORIDA. A. D. 1966.
