AN ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, REQUIRING DEALERS OF
USED AND SECOND HAND ARTICLES IN THE
CITY OF BOYNTON BEACH, FLORIDA, TO
KEEP PROPER RECORDS OF SALES AND PURCHASES
OF SUCH PROPERTY AND TO MAKE PERIODIC
REPORTS TO THE CHIEF OF POLICE OF THE CITY
OF BOYNTON BEACH REFLECTING SUCH TRANS-
ACTIONS~ PROVIDING A SAVINGS.CLAUSE,
AUTHORITY TO CODIFY, AN EFFECTIVE DATE,
PENALTY PROVISIONS AND FOR OTHER PURPOSES.
P REAM BLE
WHEREAS the general sale and purchase of second hand
articles and merchandise by various business concerns in the
City of Boynton Beach, Florida, has in the past presented various
problems to police authorities relative ascertaining ownership of
such articles; and
WHEREAS, in order to facilitate tracing the ownership
and point of origin of such articles, as well as the enforcement
of possible violations of law regarding the purchase and sale of
same, it is deemed essential that all persons engaging in such
purchases and sales be required to keep accurate records relative
all such transactions; and
WHEREAS, the enactment of this ordinance is deemed
necessary for the preservation of the public peace, property,
health and safety of the inhabitants of the City of Boynton Beach,
and essential for the efficient daily operation of the municipal
police department, now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
SECTION 1: Every person, corporation, partnership or association
engaged in the business of buying, selling, exchanging or auctioning second-
hand merchandise or used articles of any and all kinds, excluding automobiles
or motor vehicles~ also excluding articles sold at rummage or second hand
sales conducted by local religious, non-profit, charitable or civic organiza-
tions, within the limits of the City of Boynton Beach, Florida, shall keep a
complete and true record of all transactions showing from whom each article
of their stock was purchased, the date of purchase and the date and to whom
each article was sold, which record shall at all times be open and subject to
inspection by any police or other officer of the City. In addition, every person
corporation, partnership or association so engaged in the business of buying,
selling, exchanging or auctioning second-hand merchandise or used articles of
any and all kinds within the city shall deliver weekly reports to the Chief of
Police of the City indicating the date of purchase and the name and address of
the person, firm, or corporation from which said merchandise or goods were
purchased. Such reports shall be on forms provided by the Chief of Police and
shall contain such information as may be deemed necessary by the Chief of
Police for complying with the purposes of this ordinance. Any person violatin
the provisions of the above requirements shall, in addition to the other penal-
ties hereinafter provided, be subject to having his occupational license re-
voked by action of the City Council.

SECTION 3: Repealing Provisions. All ordinances or parts of ordinar.

SECTION 4: Authority to Codify. Authority is hereby granted to
codify and incorporate this ordinance in the City's existing code.
SECTION 5~ Penalty Provisions. Any person, firm or corporation
convicted of violating the provisions of this ordinance shall upon conviction
thereof, be penalized by fine not exceeding $500.00 or by imprisonment in the
municipa! jail for a period not exceeding sixty days or by both such fine and
imprisonment. Any day upon which the violation exists or continues shall be
deemed a separate and distinct offense.
SECTION 6: Effective Date. This ordinance shall become effective in
the manner and at the time provided by the Charter and the Ordinances of The
City of t~oynton ]~each, Florida.
