AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING ORDINANCE NO. 62-9 OF SAID
CITY, BY REZONING CERTAIN PORTIONS OF LOTS 20
THROUGH 26 INCLUSIVE, SAM BROWN, JR. SUB-
DIVISION FROM ZONE R 1 TO ZONE R 3A AND RE-
ZONING CERTAIN PORTIONS OF LOTS 21 THROUGH
23 INCLUSIVE, SAM BROWN, JR. SUBDIVISION FROM
ZONE R 1 TO ZONE C 1, REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
SECTION 1: The following parcels shall be rezoned and/or zoned as
follows:
Parcel 1- All that part of Lots 20, 21, 22, 23, 24, 25 and
26 lying West of the East boundary lines of Sec 16/45/43,
Palm Beach County, Florida, less E 40~ of said Lots 20
through 26, inclusive, less the W 50' of Lots 22, 23, 24,
and less the S 60' of Lot 22, also less a parcel of land
lying in Lot 21, 22 and 23, more specifically described as:
From the Southwest corner of Lot 20, of said Subdivision,
run North 2 degrees-02t-25'' West along the West line of
said Lot 20 and 21 a distance of 310'; Thence, South 89
degrees- 56' -48" East along a line that is 309.79' Norther-
ly of the parallel to the South line of said Lot 20 a distance
of 400t to the POINT OF BEGINNING.
Thence, continue South 89 degrees-56'-48" East a dis-
tance of 200'; Thence, North 2 degrees-02'-25TM West a
distance of 435'; Thence, North 89 degrees-56'.,4S"
West a distance of 200'; Thence South 2 degrees-02~-25TM
East a distance of 435' to the POINT OF BEGINNING,
Sam Brown, Jr. , as recorded in Plat Book 1, page 81,
Public Records of Palm Beach County, Florida.
To be rezoned from Zone R 1 to Zone R 3A
Parcel 2 - A parcel of land, lying in Lbt 21, 22 and 23, of
the Sam Brown, Jr. 's Hypoluxo Subdivision, as recorded in
Plat Book 1, Page 81, Public Records, Palm Beach County,
Florida; said parcel of land being specifically described as
follows:
From the Southwest corner of Lot 20, of said Subdivision,
run North 2 degrees-02'-25" ~Test along the West line of
said Lot 20 and 21 a distance of 310'; Thence, South 89
degrees-56'-48" East along a line that is 309.79' Northerly
of the parallel to the South line of said Lot 20 a distance of
400' to the POINT OF BEGINNING.
Thence, continue South 89 degrees-56'-48" East a distance
of 200'; Thence, North 2 degrees-02'-25" West a distance
of 435'; Thence, North 89 degrees-56~-48TM West a distance
of 200'; Thence South 2 degrees-02~-25'' East a distance of
435' to the POINT OF BEGINNING;
To be rezoned from Zone R 1 to Zone C 1
The Official Zoning Map of the City shall be amended accordingly.
SECTION ~.: Separabili!y. Each of the provisions of this ordinance are
separable, including word, clause, phrase, or sentence, and if any portion
hereof shall be declared invalid, the remaining portion shall not be affected
but shall remain in full force and effect.
SECTION 3: Repea~ling provisions. All ordinances or parts of ordinan-
ces in conflict herewith are hereby repealed.
SECTION 4: Effective Date. This ordinance shall become effective in
the manner and at the time provided by the Charter and Ordinances of the
CITY OF BOYNTON BEACH, FLORIDA.
