O65-48ORDINANCE NO. 65-46 -888,8888888888- AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 17-32.2 OF THE CODIFIED ORDINANCES OF SAID CITY PERTAINING TO RESISTING ARREST AND ASSAULTING POLICE OFFICERS; PROVIDING FOR AUTHORITY TO CODIFYi REPEALING PROVISIONS:, PENALTY PROVISIONS: SAVINGS CLAUSE: AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: Section 17-32.2 of the codified ordinances of the CITY OF BOYNTON BEACH, FLORIDA, is hereby amended To read: Sec. 17-3'2.2. Police, other officers; resisting, assaulting. (a) Resisting arrest, assaulting officers. It shall be unlawful for any person to resist, obstruct or oppose any policeman, police officer, detective or other person duly vested with police authority by the City of Boynton Beach, in the making of any arrest, or after having been lawfully taken into custody by any such officer, or in the service of execution of any process, or in the lawful discharge of any legal duty or apparent discharge thereof, or to in any way hinder him in the discharge or apparent discharge of such duty either with or without offering or doing violence to the person of such policeman, police officer, detective or other person duly vested with police authority. The refusal of any person to obey or comply with any lawful order or command of any such police officer, or person duly empowered with police authority while in the discharge or apparent discharge of his duty, shall cons tlr'ute a violation of this section. (b) Escape, attempt to escape. It shall be unlawful and will constitute a separate offense for any person, lawfully taken into custody by any policeman, police officer, detective or other officer of the city, or any person while in the city jail or while a prisoner working out a sentence on the streets or on public works of the city under guard, whether such custody, detention or restraint be actual or constructive, to escape or attempt to escape any such jail, guard, detention or custody. (c) Penalty for violation. Any person convicted of a violation of this section shall be punished by a fine not to exceed five hundred dollars ($500. 00) or by imprison- ment in the city jail for a period not to exceed ninety (90) days, or by both such fine and imprisonment. SECTION 2: Separability. Each of the provisions of this ordinance are separable, including word, clause, phrase, or sentence~ and if any provision hereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. SECTION 3: Repealing Provisions. Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: Authority to Codify. Authority is hereby granted to codify and incorporate this ordinance in the City's existing code. SECTION 5: Effective date. This ordinance shall become effective in the manner and at the time provided by the Charter and Ordin- ances of the CITY OF BOYNTON BEACH, FLORIDA. Firs!~reading this \ ~4~ day of ~O~Y~~ A.D. 1965.
