O65-47 ORDINANCE NO. 65-47 AN E~ERGENCY ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA CALLING A SPECIAL ELECTION FOR SO, MISSION TO THE FREEHOLDERS WHO ARE QUALIFIED ELECTORS RESIDING IN SAID CITY~ THE QUESTIONS OF THE ISSUANCE OF ONE MILLION NINE HUNDRED THOUSAND DOLLARS ($1,900,000) STREET, DRAINAGE, AND SIDEWALK BONDS: THREE HUNDRED TEN THOUSAND DOLLARS ($310,000) ACQUISITION OF ~DDITIONAL BEACH PROPERTIES BONDS; ONE HUNDRRD FIFTY THOUSAND DOLLARS ($150,000) NKINICIPAL FIRE STATION BONDS~ ONE HUNDRED FORTY THOUSAND DOLLARS ($140,000) NKINICIPAL SWIPING POOL BONDS; THIRTY-FIVE THOUSAND DOLLARS ($35,000) ~UNICIPAL BOAT RA~P AND BASIN INSTALLATION BONDS; THIRTY--FIVE THOUSAND DOLLARS ($35,000) SIREET SIGNALIZATION INIPROVF3~NT BONDS; SEVENTY THOUSAND DOLLARS ($70,000) PARK SITES DEVELOPN~FJNT BONDS; SEVENTY THOUSAND DOLLARS ($70,O00)OFF-STREET PARKING ACQUISITION AND DEVELOPN[~NT BONDS; FIFTY THOUSAND DOLLARS ($50,000) ACQUISTiON OF ADDITIONAL STREET RIGHTS OF WAY BONDS. PREAMBLE This Ordinance is deemed to be an emergency measure enacted for the immediate preservation of the health, safety and welfare of the inhabitants of the City of Boynton Beach, Florida, and as an economic measure to enable the holding of the Referendum Election provided for herein in conjunction with the Annual Municipal General Election, rather than incurring the expense of holding ~ Special Election on said matter. BE IT ORDAINED BYWTHE CITY COUNCIL OF THE CITY OF BOYNTON BRACH, FgORIDA: SECTION 1: That the City of Boynton Beach shall issue bonds in an a~gregate pri~al amount of not exceeding One ~illion Nine Hundred Thousand Dollars ($1,900,000), bearing interest at a rate not exceeding four and one half per cent (4.5~) per annum, and maturin~ not later than forty (40) yeg~_s.~f~om the date thereof, for the purpose of financing the cost of street~drainage and sidewalk installation in said City. The full faith and credit of the City of Boynton Beach shall be pledged for the payment of the principal of and interes~ on said bonds and ad valorem taxes shall be lev~ed without limit as to rate or amount for the payment of the principal of and interest on said bonds on all taxable property in said City. Section 2: That the City of Boynton Beach shall issue bonds in an a$gregate principal amount not exceedin~ Three Hundred Ten Thousand Dollars ($310,000), bearing interest at a rate not exceeding four and one half per cent (4.5)~) per annum, and maturing not later than forty (40) yea~s from the date thereof, for the purpose of financing the cost of acquiring additional beach property for said City. The full faith and credit of the City of Boynton Beach shall be pledged for the payment of the principal of and interest on said bonds and ad valorem taxes shall he levied without limit as to rate or amount for the payment of the principal of and interest on said bonds on all taxable property in said City. SHCTION 3: That the City of Boynton Beach shall issue bonds in an aggre§ate principal amount not exceeding One Hundred Fifty Thousand Dollars ($150,000), bearing interest at a rate not exceeding four and one half Der cent ~4o5~) per annum, and maturing not later than forty (40) years from the date thereof, for the purpose of financing the cost of erectin$ a Municipal Fare Station on property now owned by the City. The full faith and credit of the City of Boynton Beach shall be pledged for the payment of the principal of and interest on said bonds and ad valorem taxes shall be levied without limit as to rate or amount for the payment of the principal of and interest on said bonds on all taxable property in said City. S~_CTION 4: That the City of Boynton Beach shall issue bonds in an aggregate principal amount not exceedin9 One Hundred Forty Thousand Dollars ($140~000), bearing interest at a rate not exceeding four and one half per cent (4.5~) per annum, and maturing not later than forty (40) years from the date thereof, for the purpose of financing the cost of the construction of a Municipal Swimming Pool on property now owned by the City. The full faith and credit of the 0ity of Boynton Beach shall be pledged for the payment of the principal and interest on said bonds, and ad valorem taxes shall be levied without limit as to rate or amount for the payment of the principal of and interest on said bonds on all taxable property in said City. SHCTION 5: That the City of Boynton Beach shall issue bonds in an aggregate principal amount not excedding Thirty-Five Thousand Dollars ($35,000), bearing interest at a rate not exceeding four and one half per cent (4.5%) per annum, and maturing not later than forty (40) years from the date thereof, for the purpose of financing the cost of installing a municipal boat ramp and basin for said City, The full faith and credit of the City of Boynton Beach shall be pledged for the payment of the principal of and interest on said bonds and ad valorem taxes shall be levied without limit as to rate or amount for the payment of the principal of and interest on said bonds on all taxable property in said City. -2- S~GTION 6. That the City of Boynt0n Beach shall issue bonds in an aggregate principal amount not exceeding Thirty-Five Thousand Dollars ($35,000), bearing interest at a rate not exceeding four and one 5~lf per cent (4.5%) per annum~ maturing not later than forty (40) years from the date thereof, for the purpose of financing the cost of Street Signal- ization Improvement in the said CitY. The full faith and credit of the City of Boynton Beach shall be pledged for the payment of the principal of and interest on said bonds and ad valorem taxes shall be ~levied ~ithout. limit as to rate or amount for the payment of the principal and interest on -said bonds on all taxable property in said City. S~CTION 7. That %he City of Boston Beach shall issue bonds in an aggregate principal amount not exceeding Seventy Thousand Dollars ($70,000), bearing interest at a rate not exceeding four and one half per cent (4.5%) per annum, and maturing not later than forty (40} years from the date thereof, for the purpose of financing the cost of acquiring and developing Municipal Park Sites for said City. The full faith and credit of the City of Boynton Beach shall be pledged for the payment of the principal of and interest on said bonds and ad valorem taxes shall be levied ~ithout limit as to rate or amount for the payment of the principal of and interest on said bonds on all taxable property in said City. $~CTION 8: That the City of Boynton Beach shall issue bonds in an aggregate principal amount not exceeding Seventy Thousand Dollars ($70,000) bearing interest at a rate not exceeding four and one half per cent (4.5%) per annum and maturing not later than forty (40) years from the date thereof, for the purpose of financing the cost establishing off'street parking facilities for said City. The full faith and credit of the City of Boynton Beach shall be pledged for the payment of the principal of and interest on said bonds and ad valorem taxes shall be levied ~ithout limit as %o mate or amount for the payment of the principal of and interest on said bonds on all taxable property in said City. SECTION 9: That the City of Boynton Beach, Florida, shall issue bonds in an aggregate principal amount not exceeding Fifty Thousand ($50,000) Dollars, bearing interest at a rate not exceeding four and one half per cent (4.57~) per annum and maturing not later than forty (40) years fr°m the date thereof, for the purpose of financing the cost of acquiring additional stree~ rights of ~ay, including needed railroad crossings for said City. The full faith and credit of the City of Boynton Beach shall be pledge4 for the payment of the principal and interest chi~ said bonds and ad valorem taxes shall be levied ~ithout limit as to rate or -3- amount for the payment of the principal of and interest on said bonds on ail taxable property in said City. SECTION 10: None of said bonds shall be issued as provided in Sections 1,2,3,4,5,6,7,8, and 9 hereof until and unless the issuance thereof shall have been first approved'by the qualified electors who are freeholders residing in the City, in the manner provided by the Constitution and Statutes of the State of Florida, and the Charter of the City of Bo%alton Beach, at the special election hereinafter provided for. SECTION 11: A special election is hereby called to be held on the 7th day of December, 1965, to determine whether or not the issuance of said bonds shall be approved by the freeholders who are qualified electors residing in the City~ in the manner provided in the Constitution and Statutes of the State of Florida, and the Charter of the City of Boynton Beach, Florida. Notice of said special election shall be given by publishing notice of the contents of this ordinance in the Boynton Beach Star, once each week for four (4) successive weeks prior to said election, the first publication to be at least thirty (30) days prior thereto, and by posting the same in the City Hall and at the office of the City Clerk and at other conspicuous places within the City at least thirty (30) days prior to the date of said special election. SECTION 12: The City Council shall have prepared and furnished all necessary blanks and ballots and shall make all other necessary preparations for said special election, and shall pay the clerks and inspectors herein- after provided for, and all expenses of said special election, out of funds provided therefor by the City. FOR $50,000.00 ACQUISITION OF ADDITIONAL STRES7 RIGHTS OF WAY, INCLUDING NEEDED RAILROAD CROSSING BONDS AND LEVY OF T~XES FOR P~Y~ENT THER~OF~ AGAINST $50,000.00 ACQUISITION OF ADDITIONAL STREET RIGh~fS OF WAY, INCLUDING NEEDED RAILROAD CROSSING BONDS AND LHVY FOR PAYMiENT THEREOF ~ (If you desire to vote for the issuance of the bonds described in Proposal No. 9 above, and levy of taxes for the payment thereof~ make a cross mark (x) to the left of the ~ords "For $50,000.00 Municipal Street Rights of way Bonds and levy of Taxes for Payment thereof", if you desire to vote against the issuance of said Bonds and levy of taxes for payment thereof, make a cross mark (x) to the left of the words, "Against $50,000.00 Municipal Street Rights of way Bonds and Levy of Taxes for Payment thereof".) None of- said issues of bonds shslt be issued unless a majority of the free- holders.who are qualified electors residing in the City shall participate in said special election, and unless a majority of the votes in said special election shell be in favor of the issuance of said bonds, and levy of taxes for payment thereof. SECTION 13: All freeholders who are qualified electors residing in the City of Boynton Beach shall be entitled to vote in said specisi election. The Supervisor of Registration shall furnish to the inspectors and clerk at every voting place a certified copy of the list of qualified electors who are freeholders residing in the City, in the manner provided in the General Election Law of the State of Florida. SECTION 14: The City Council, at least six (6) days before the date of said special election, shall appoint for each election district of the City at least two (2) inspectors end s clerk of election, to hold said election in the several districts of the City, and such appointment shall be recorded in the minutes of the City Council. If any inspector or clerk of election so appointed shall fail to attend at the proper pollingi~~ place at the time for opening of the Dolls on the day of the election, those inspectors present shall fill the vacancy or ~acancies from the freeholders who are qualified electors present; and if all the inspectors be absent, then those persons qualified to vote at said special election shall fill the vacancies. The polls shall be opened at 7:00 o'clock (7:00) A. M. and close at (7:00) P. 5I., and shall be located at, or as near as possible to the polling places used in the last City general election. The inspectors and clerks of the election in each election district shall make out and sign duplicate returns of said special election and shall deliver one copy thereof to the City Clerk and one copy to the City Council of the City. Said City Council shall, as soon as practicable, canvas~ and declare, from said re%urns of the inspectors and clerks of said election, the result of said special election on the question of the approval of each of said issues of bonds, and shall make and enter in their minutes a finding as to the total number of qualified electors who were freeholders residing in the ~ty who were legally qualified to participate in the election, and also a finding as to the total number of votes cast in said special election in favor of the issuance of each of said issues of bonds and levy of taxes for payment thereof and the total number of votes cast in said special election against the issuance of said ~$~$u~es~f bonds and levy of taxes for payment thereof~ Said special election shall in all other respects be held in accordance with the General Election Laws of the State of Florida. SECTION 15: This O~dinance is deemed %o be an emergency measure and shall take effect immediately upon its passage.
