AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, EXTENDING THE TERRITORIAL LIMITS
OF SAID MUNICIPALITY BY THE ANNEXATION OF A
CERTAIN UNINCORPOi~ATED TRACT OF LAND CON-
TAINING LESS THAN TEN REGISTERED VOTERS,
LYING CONTI~S-a~OUS THERETO AND WITHIN THE'
SAME COUNTY;TO WIT: LOTS 41, 42 and THE WEST
231 FEET OF LOTS 54 AND 55, AtVIENDED PLAT OF
TRADE WINDS ESTATES, PLAT BOOK 21, PAGE 73,
PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA;
REDEFINING THE MUNICIPAL BOUNDARIES/.')~REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN CON-
FLICT HEREWITI-I~i~PROVIDiNG FOR AUTHORITY TO
CODIFY, AN EFFECTIVE DATE, AND FOR OTHER
PURPOSES.
WHEREAS, the owner~ of the property more particularly des-
cribed hereinafter has hereto;f~e~petitioned the City Council of the City of
Boynton Beach, Florida, requesting the annexation of certain property
lying adjacent and ~guou s to the territorial limits of said municipality
and within the same CoUnty, to the municipal territorial limits of said City;
and
WHEREAS, said tract of land contains less than ten registered
voters; and
WHEREAS, all requirements of the charter of the City of
Boynton Beach, Florida, relative annexation of contiguous territory have bee
complied with; and
WHEREAS, the City Council of lhe City of Boynton Be~aeh,
Florida, deems the annexation of subject tract to be beneficial to the muni.~
cipality and to the inhabitants of said tract,
NOW, THEREFORE, be it ordained by the City Council of the
City of Boynton Beach, Florida:
SECTION 1: That the City of Boynton Beach, Florida, hereby
annexes the following described tract of land to the territorial limits of the
City of Boynton Beach, Florida:
Lots 41, 42 and the West 231 feet of Lots 54 and 55,
Amended Plat of TRADE WINDS ESTATES, according
the Plat thereof on file in the office of the Clerk of the
Circuit Court in and for Palm Beach County, FI orida,
recorded in Plat Book 21, Page 73, Public Records of
Palm Beach County, Florida.
SECTION 2: , That subject tract he re inabove described is hereby
zoned "ZONE R1AA" to allow and authorize eomfl~.~al use of said property
for church and accessory edi~cational and recreational buildings and playgroun
SECTION 3: Ail ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4: Should any section or provision of this ordinance,
or any portion hereof be declared by a court of competent, jurisdiction to be
invalid, such decision shall not affect the validity of the remainder hereof as
a whole or any part hereof, other than the part declared to be invalid.
SECTION 5: This ordinance shall become effective in the mann,
and at the time provided by the charter and ordinances of the City of Boynton
Beach, Florida.
