AN ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, AMENDING SECTION 22-69
OF THE CODIFIED ORDINANCES OF
SAID CITY REQUIRING PERMIT FOR SEPTIC TANK
INSTALLATION WITHIN SAID MUNICIPALITY;
FURTHER PROVIDING FOR A SAVINGS CLAUSE,
AUTHORITY TO CODIFY, AN EFFECTIVE DATE AND
PENALTY PROVISIONS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA.
SECTION 1:

That Section 22-69 of the codified ordinances of
Florida, be and the same is hereby amended to
"Sec. 22-69. Septic Tank Installation - Permit
Required.
Prior to the installation of any septic tank within the
City, the owner of the property involved, or any
person erecting, installing or constructing the same,
must secure therefor a permit from the Plumbing
Inspector of the City, and prior to the issuance of
such permit by the Plumbing Inspector, the install-
ation of such septic tank must be approved in writing
by the City Engineer. The City Engineer may, if
he deems necessary, require the applicant to procure,
at his expense, a percolation or other reasonable
test to ascertain whether or not any adverse effect to
the health and safety of the neighborhood or the
community will result from the installation of such
septic tank. In the event the City Engineer deems
that the installation of any particular septic tank
shall adversty affect the health of~_ inhabitants of
the City by contamination of water supply or other-
wise, he shall disapprove such application in writing
stating his reasons therefor and such permit shall
not be issued by the Plumbing Inspector. The oullet
to such septic tank shall be connected to approved vents
and no septic tank shall be installed where sanitary
City sewer service is available.
SECTION 2: Separability. Each of the provisions of this
Ordinance are separable, including word, clause, phrase, or sentence, and
if any portion hereof shall be declared invalid, the remaining portion shall
not be affected but shall remain in full force and et~ect.

SECTION 3: Repealing Provisions. All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
SECTION 4: That authority is hereby granted to codify and
incorporate this ordinance in the City's existing Co. de.
SECTION 5: Penalty Provision. Any person, firm or corp-
oration convicted of violating the provisions of this ordinance shall, upon
conviction thereof be punished by a fine not exceeding the sum of $500.00,
or by imprisonment in the City Jail for a period not exceeding 90 days, or
by both such fine and imprisonment. Any day upon which such violation
exists or continues to exist shall be deemed a separate and distinct offense.
SECTION 6: Effective Date. This ordinance shall become
effective in the manner and at the time provided by the Charter and Ordin-
ances of the City of Boynton BEach, Florida.
