O65-25ORDINANCE NO. 65-2~5 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, LEVYING SPECIAL ASSESSMENTS AGAINST PROPERTY BENEFITED BY A CERTAIN STREET IMPROVEMENT PROJECT WITHIN THE SAID CITY, TO WIT: THAT PORTION OF N.W. 8TH STREET, LYING BETWEEN N/W 10th AVENUE AND N/W 13th AVENUE;AND THAT PORTION OF N/W 13th AVENUE LYING BETWEEN N/W 9TH STREET and N/W 8TH ST REET; AND THAT PORTION OF N/W 7TH COURT, LYING BETWEEN N/W 13TH AVENUE AND THE EASTERLY EXTENSION OF THE SOUTH LINE OF LOT 207, LAUREL HILLS, FOURTH ADDITION, RECORDED IN PLAT BOOK 23, PAGE 142, PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, RECITING BY WHAT METHOD SAID SPECIAL ASSESSMENT IS MADE AND THE TIME WHEN SAME SHALL BECOME PAYABLE: PROVIDING FOR THE METHOD OF COLLECTION THEREOF, AND FOR OTHER PURPOSES. WHEREAS, pursuant to the provisions of Section 160 of the Charter of the CITY OF BOYNTON BEACH, FLORIDA, the City has hereto- fore caused a certain publim street to be constructed over the property more particularly described as follows: That portion of N/W 8th Street, lying between N/W 10th Avenue and N/W 13th Avenue; and that portion of N/W 13ti Avenue, lying between N/W 9th Street and N/W 8th Street; and that portion of N/W 7th C~burt, lying between N/W 13th Avenue and the easterly extensio~ of the south line of Lot 207. LAUREL HILLS, FOURTH ADDITION, ~ecorde in Plat Book 23, Page 142, public records of Pal~n Beach County, Florida; and WHEREAS, the City Clerk has heretofore compiled an assess~ ment roll showing the lots and land assessed to pay the cost thereof in connection with subject improvement and the amount of assessment as to eac such lot or land, which said roll has heretofore been approved by the City Council; and WHEREAS~ proper legal notice of the approval of said roll has been given and a public hearing held relative thereto, at which time no objections were made, or if objections were made, same were deemed in- sufficient by the City Council, NOW, THEREFORE, be it ordained by the City Council of the CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: That the special assessment r~ covering the above-described project~ true ~pies of whi~aa~ attached hereto and hereby made a part hereof, sine hereby ratified, approved and confirmed, and the amounts indicated for each lot or parcel described therein are hereby levied against same as a special improvement assessment and same shall constitul liens against said land as of the effective date of this ordinance, each of sai~ parcels along subject improvement., having been assessed on a front footage basis, charging each parcel its proportionate share by dividing its respectiv~ front footage into the total improvement cost. SECTION 2: Each property owner shall have the privilege of paying the entire assessment as to his property within 90 days from the attachment of said improvement lien without penalty. If any owner fails to pay said lien within said 90 day period, it shall be paid in three consecutive equal installments, payable as other ad valorem taxes are paid, commencing with the tax year 1965, together with interest at the rate of 8% per annum fro~ the date of attachment of said lien on the unpaid balance thereof. SECTION 3: Separability. If any part of this ordinance shall be deemed unlawful by a court of oompetent jurisdiction, such portion shall be deemed a separate and distinct part hereof and such ruling shall not affect the validity of the remainder hereof. SECTION 4: Repealing Provisions. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: Effective Date. This ordinance shall take effect at the time and in the manner provided by the charier and ordinances of the CITY OF BOYNTON BEACH, FLORIDA.
