O65-18ORDINANCE NO. 65- I~ AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, EXTENDING THE TERR- ITORIAL LIMITS OF SAID MUNICIPALITY BY THE ANNEXATION OF A CERTAIN UNIN- CORPORATED TRACT OF LAND CONTAINING Lt~SS.~[UHAN TEN REGISTERED VOTERS, LYING CONTIGUOUS THERETO AND WITHIN THE SAME COUNTY; TO-WIT: A PARCEL OF LAND LOC- ATED IN SECTIONS 9 AND 16, TOWNSHIP 45 SOUTH, RANGE 43 EAST, PALM BEACH COUNTY, FLORIDA, MORE PARTICULARLY DESCRIBED HEREINAFTER; REDEFINING THE MUNICIPAL BOUNDARIES: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE- WITH; PROVIDING FOR AUTHORITY TO CODIFY, AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. WHEREAS, the owners of the property more particularly des- cribed hereinafter have heretofore petiiioned the City Council of the City of Boynton Beach, Florida, requesting the annexation of certain property lying adjacent and contiguous to the territorial limits of said municipality and within the same county, to the municipal territorial limits of said City; and voters; and WHEREAS, said tract of land contains less than ten registered WHEREAS, all requirements of the charter of the City of Boynton Beach, Florida, relative annexation of contiguous territory have been complied with; and WHEREAS, the City Council of lhe City of Boynton Beach, Florida, deems the annexation of subject tract to be beneficial to the munic- ipality and to the owners of said tract. NOW, THEREFORE, be it ordained by the City Council of the City of Boynton Beach, Florida: SECTION 1: That the City of Boynton Beach, Florida, hereby annexes the following described tract of land to the territorial limits of the City of Boynton Beach, Florida: Commence at the intersection of the westerly boundary of the Seaboard Airline Railway right-of-way and the South line of the NW 1/4 of the NW 1/4 of Section 16, Township 45 South, Range 43 East, Palm Beach County, Florida; thence proceed northerly along the westerly r~ght-of-way of the Seaboard Airline Railway to the southeast corner of Tract D, Lincoln Memorial Gardens;._ recorded in Plat Book 23, Page 179. public records of Palm Beach County, Florida; thence proceed westerly along the south line of said Tract D to the southwest corner thereof; thence proceed northerly along the west line of Tracts D. E and F of said Lincoln Memorial Gardens to the Northwest corner of said Tract F; thence continue northerly along the westerly boundary of the Seaboard Airline Railway right-of-way to the intersection of the north line of Section 9, Township 45 South, Range 43 East, said point being the center line of Hypoluxo Road; thence proceed easterly along the north line of said Section 9 to a point 190 feet west of the northeast corner of the Northwest Quarter of said Section 9; thence proceed southerly a distance of 190 feet to a point; thence proceed easterly 230 feet more or less to the easterly boundary of the right-of-way of Seacrest Boulevard; thence proceed southerly along the easterly boundary of the right-of-way of Seacrest Boulevard to the south line of the Northeast Quarter of Section 9, Township 45 South, Range 43 East; thence proceed westerly along said south line to the center line of Seacrest Boulevard; thence proceed southerly along the center line of said Seacrest Boulevard to a point due East of a point 300 feet north of the Southeast corner of Tract No. 3, reserved of Palm Beach Memorial Park, recorded in Plat Book 25, Page 226, public records of Palm Beach County, Florida; thence proceed westerly to a point in the east line of said Tract 3, Reserved of Palm Beach Memorial Park, 300 feet north of the Southeast corner thereof; thence continue westerly 435.6 feet to a point; thence proceed southerly 300 feet to the southline of said tract 3 Reserved of Palm Beach Memorial Park; thence proceed westerly along the south line of said Tract 3, to the southwest corner thereof, being a point in the easterly right-of-way of proposed~State Road No. 9; thence proceed southerly along the easterly right-of way of proposed State Road No. 9 to the south line of the Northeast Quarter of the Northwest Quarter, Section 16, Township 45 South, Range 43 East; thence proceed westerly along said line to the point of beginning. SECTION 2: The above property, upon annexation, shall be zoned as follows: The North 300 feet thereof and that portion lying west of the Seaboard Airline Railway to be zoned ZONE C-2; balance of property to be zoned ZONE C-l, for use as commercial cemetery and crematory, all pur- suant to the provisions of Ordinance No. 62-9 constituting master zoning code of the City of Boynton Beach, Florida. -2- SECTION 3: The territorial boundaries of the City of Boynton Beach, Florida, are hereby redefined so as to include the above-described property. SECTION 4: Separability. ]Each of the provisions of this ordinance are separable and if any section, subsection, clause, phrase or portion of this ordinance is for any reason held invalid by any Court of competent jurisdiction, the remaining portions shall not be affected but shall remain in full force and effect. SECTION 5: Authority to C0difv~ Sepcific authority is hereby granted to codify and incorporate this ordinance in the City's existing code. SECTION 6: Repealing Provisions. All ordinances or parts of ordinances in conflict herewith are hereby repealed. effective in the of the City of Boynton Beach, Florida First reading this. 3Q~ day of ~\/ A.D. 1965.
