AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
EXTENDING THE TERRITORIAL LIIV[ITS OF SAID MUNICIPALITY
BY THE ANNEXATION OF A CERTAIN UNINCORPORATED
TRACT OF LAND CONTAINING LESS THAN TEN REGISTERED
VOTERS, LYING CONTIGUOUS THERETO AND WITHIN THE
SAME COUNTY, TO WIT: LOT 38 and LOT 58, TRADE
WINDS ESTATES , ACCORDING TO THE PLAT THEREOF
ON FILE IN THE OFFICE OF THE CLERK OF THE CIRCUIT
COURT IN AND FOR PALM BEACH COUNTY, FLORIDA,
RECORDED IN PLAT BOOK 21, PAGE 73; REDEFINING
THE 1VIUNICIPAL BOUNDARIES: REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH: 1
PROVIDING FOR AUTHORITY TO CODIFY, AN EFFECTIVE
DATE~ AND FOR OTHER PURPOSES. t

WHEREAS, the owners of the property more p icularly described
hereinafter have heretofore petitioned the City Council of the City of Boynton
Beach, Florida, requesting the annexation of certain property lying adjanent
and contiguous to the terril~oriat limits of said municipality and within the
same County, to the municipal territorial limits of said City; and
WHEREAS, said tract of land contains less than ten registered
voters; and
WHEREAS, all requirements of the charter of the City of Boynton
Beach, Florida, relative annexation of contiguous territory have been compli~
with; and
WHEREAS, the City Council of the City of Boynton Beach, Florida,
deems the annexation of subject tract to be beneficial to the municipality and
to the owners of said tract,
NOW., THEREFORE, be it ordained by the City Council of the
City of Boynton Beach, Florida:
SECTION 1: That the City of Boynton Beach, Florida, hereby
annexes the following described tract of land to the territorial limits of the
City of Boynton Beach, Florida:
Lots 38 and 58, TRADE WINDS ESTATES, according to the
Plat thereof on file 'in the office of the Clerk of the Circuit
Court in and for Palm Beach County, Florida, recorded in
~Plat Book 21, Page 73.
SECTION 2: That subject property, upon annexation, shall be
zoned "Zone C-i" to authorize use of subject property for bag renovation
operation, pursuant to the provisions of Sub. Paragraph (3t), Section 31-8,
of Ordinance No. 62-9 of the City of Boynton Beach,. Florida, constituting
the master zoning code of said City.
SECTION 3: The territorial boundaries of the City of Boynton
Beach, Florida, are hereby redefined so as to include lhe above described
property.
SECTION 4: Separability. Each of lhe provisions of this ordinanc
are separable and if any section, sub-section, clause, phrase or portion of
this ordinance is for any reason held invalid by any Court of competent
jurisdiction, the remaining portions shall nol be affected but shall remain in
full force and effect.
SECTION 5: Authority to Codify. Specific authority is hereby
granted to codify and incorporate this ordinance in the City's existing code.
SECTION 6: Repealing provisions . All ordinances or paris of
ordinances in conflict herewith are hereby repealed.
SECTION 7: Effective Date. This ordinance shall beeome effectiw
in the manner and at the time provided by the charter and ordinances of the
City of Boynton Beach, Florida.
