AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING SECTION 29-3 OF THE CODIFIED
ORDINANCES OF SAID CITY-PERTAINING TO SPEED
LIMI-T OF RAILROAD TRAINS; PROVIDING AUTHORITY
TO CODIFY, REPEALING PROVISIONS: SAVINGS
CLAUSE., PENALTY PROVISIONS AND PROVIDING FOR
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA.
SECTION 1: Thai Section 29.3 of the codified Ordinances of lhe
CITY OF BOYNTON BEACH, FLORIDA, be and the same is hereby amended
to read:
Sec. 29~ 3. Railroads - Speed Limit of Trains.
(a) Regulating. Il shall be unlawful for any person, firm or
corporation to operate any train, either of passenger cars ,
or freight cars, or both, drawn by one or more locomotives,
driven by deisel or steam power or otherwise, or any other
typ~ '~ of railway vehicles~ other than those set forth in
Sec. 29-3.1 of this Code of Ordinance, upon railway tracks
within the corporate limits of the City of Boynton Beach,
Florida, at a speed in excess of 35 miles per hour.
(b) Penalty. Any person, firm or corporation convicted
of-~violating the provisions of this section shall be punished
by a fine not exceeding $500. 00 or by imprisonment for a
period not exceeding ninety days or both such fine and
imprisonment.
SECTION 2: Specific authority is hereby granted to codify and
incorporate this ordinance in the City's existing code.
SECTION 3: Each of the provisions of this Ordinance are separabl~,
including word, clause, phrase, or sentence, and if any provision hereof
shall be declared invalid, the remainig portion shall not be affected by shall
remain in full force and effect.
SECTION 4: Ail ordinances or paris of ordinances in conflict
herewith are hereby repealed.
SECTION 5: . This ordinance shall become effective in the manner
and at the time provided by the Charter and Ordinances of the CITY OF
BOYNTON BEACH, FLORIDA.
