O65-15ORD ^NCE NO. marching hazard to City and a City, AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, REGULATING PARADES, PROCESSIONS AND OTHER ~.~ ~l!A~ ~I{CHING.AS~EMBL!ES; PROVIDING FOR AUTHORITY TO CODIFY, A SAVINGS CLAUSE, REPEAL- ING PROVISIONS, AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. That WHEREAS the conduct of parades, ~ ' pro~esslons and other assemblies, if uncoordinated and unregulated, constitutes a the orderly conduct of pedestrian and vehicular traffic within the hazard to the health, safety and welfare of the citizens of said NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: That no parade, procession or other marching assembly, except the forces of the United States Armed ~r~ses, the forces of this State and the forces of the County Sheriff's Department, local except Police and Fire Departments,and/any organized funeral procession under direction and supervision of a duly licensed funeral director, shall occupy, march or parade along any street, thoroughfare or roadway within the municipal limits of the City of Boynton Beach, Florida, except in accordance with a permit issued by the Chief of Police of the City, or his duly designate representative. In connection with the issuance of said permit the Chief of Police shall prepare application forms therefor which shall include among other items, the following information regarding such parade or procession: 1. The route; 2. The point of origin and destination; 3. The total number of marchers or participants; 4. The approximate time of beginning'and ending; 5. The identity of the sponsoring group or groups. All such parades, processions or marching assemblies shall be conducted between the hours of 9:00 o'clock A. M. and 9:00 o'clock P.M. If, at any time, the Police Chief or his duly designated representative shall determine that the continuation of any parade, procession or marching assembly con- stitutes, or may constitute a hazard to the public safety or the welfare of the inhabitants of the City or the participg~sin said parade or assembly, he may terminate same and direct the participants to disburse. SECTION 2: Separability. Each of the provisions of this Ordinance are separable including word, clause, phrase, or sentence, and if any provision hereof shall be declare invalid, the remaining portion shall nol be affected but shall remain in full force and effect. SECTION 3: Repealing Provisions: Ail Ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: Authority to Codify. Specific authority is hereby granted to codify and incorporate this Ordinance in the City's existing code. SECTION 5: Penalty. Any person, firm or corporation convicted of violation of this Ordinance shall be punished by fine not exceeding $500. 0C or by imprisonment in the City jail for a period not exceeding 90 days or both such fine and ~i~prisonment. Any day upon which such violation exists or con tinues shall be deemed a separate and distinct offiense. SECTION 6. Effective date. This Ordinance shall become effective in the manner and at the time provided for by the Ordinances and the Charier of the CITY OF BOYNTON BEACH, FLORIDA. First reading this ~f~ day of April, A.
