O65-12©RDINA NCE NO. 65- ~ ~ AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, LEVYING SPECIAL ASSESSMENTS AGAINST PROPERTY BENEFITED BY A CERTAIN STREET IMPROVEMENT PROJECT WITHIN. SAID CITY, TO WIT: THAT PORTION OF N/E 4th AVENUE, LYING BETWEEN N/E 4TH STREET AND RAILROAD AVENUE, RECITING BY WHAT METHOD SAID SPECIAL ASSESSMENT IS MADE AND THE TIME WHEN SAME SHALL BECOME PAYABLE: PROVIDING FOR THE METHOD OF COLLECTION THEREOF, AND FOR OTHER PURPOSES. WHEREAS, pursuant to the provisions of Section 160 of the Charter )f the CITY OF BOYNTON BEACH, FLORIDA, the City has herelofore caused certain public street to be constructed over the property more particularly described as follows: Thai poriion of N/E 4th Avenue, lying beiween N/E 4th Sir eet and Railroad Avenue, within lhe City of Boynion Beach, Florida; and WHEREAS, the City Clerk has heretofore compiled an assessment roll showing lhe lots and land assessed to pay the cost thereof in connection wilh subject improvement and the amount of assessment as fo each such lol or land, which said roll has heretofore been approved by lhe City Council; and WHEREAS, proper legal notice of the approval of said roll has been given and a public hearing held relative ihereto, at which time no objections were made, or if objections were made, same were deemed insufficient by the City Council, NOW, THEREFORE, be it ordained by the City Council of the CITY OF BOYNTON BEACH, FLORIDA: SECTION l: Thai the special assessment roll covering the above- described project, a true copy of which is allached herelo and hereby made a pact hereof, is hereby ratified, approved and confirmed, and the amounls in- dicated for each tot or parcel describedJt~erein are hereby levied against same as a special improvement assessment and same shall constitute liens against said land as of the effective date of this ordinance, each of said parcels along subject improvement having been assessed on a front fooiage basis, charging each parcel its proportionaie share by dividing ils respeciive front fooiage into lhe total improvemenl cost. SECTION 2: Each property owner shall have the privilege of paying the entire assessment as to his property within 90 days from the s~Itachment of said improvement lien without penalty. If any owner fails to pay said lien within said 90 day period, it shall be paid in three consecutive equal installments, payable as other ad valorem taxes are paid, commencing with the tax year 1965, t.ogather with interest at the rate of 8% per annum ftc the date of attachment of said lien on the unpaid balance thereof, SECTION 3: Separability. If any part of this ordinance shall be deemed unlawful by a court of competent jurisdiction, such portion shall be deemed a separate and distinct part hereof and such ruling shall not affect the validity of the remainder hereof. SECTION 4: Repealing Provisions. Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. Effective Date. This ordinance shall take effect at the time and in the manner provided by the charter and ordinances of the CITY OF BOYNTON BEACH, First reading this A.D. 1965. FLORIDA.
