AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
DECLARING THE INTENTION OF SAID CITY TO EXTEND ITS
MUNICIPAL TERRITORIAL LIMITS BY THE ANNEXATION
OF AN UNINCORPORATED TRACT OF LAND LYING CONTIG-
UOUS THERETO AND WITHIN PALM BEACH COUNTY, FLORIDA,
TO WIT: A PARCEL OF LAND LOCATED IN THE SW1/4
SECTION 34, Township 45 South, Range 43 East, INCLUDING
PORTION OF LOT 11, BENSON BROS. SUBDIVISION, ACCORDING
TO PLAT THEREOF RECORDED IN PLAT BOOK 5, PAGE 27
PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA;
PROVIDING FOR REPEALING AND SAVINGS CLAUSE, AN
EFFECTIVE DATE AND FOR OTHER PURPOSES.
WHEREAS, the owners of a certain tract of land more particularly
described hereinafter, lying adjacent and contiguous to the territorial limits
of the City of Boynton Beach, Florida, and within Palm Beach County, Florid
have petitioned the City Councilfor the annexation of said property by the
City of Boynton Beach, Florida; and
WHEREAS, subject tract contains less than ten registered voters;
and
WHEREAS, it is considered to be for the best interest of the City of

Boynton Beach~ Florida,/for the owners of subject tract that same be annexe¢
and included within the municipal territorial limits of the City;
NOW~ THEREFORE, be it ordained by the City Council of the City
Boynton Beach, Florida:
SECTION 1: That the City Council of the City of Boynton Beach,
Florida~ hereby declares its intention to annex the following described tract
of land to the municipal territorial limits of the City of Boynton Beach, Flori
at the expiration of thirty days from the passage of this ordinance:
Commence at the intersection of the existing easterly municipal
boundary line of the City of Boynton Beach, Florida, with the
north line of the SW1/4 Section 34, Township 45 South, Range 43
East; thence .proceed easterly along said north line To the northeast
corner of Lot 11, BENSON BROS. SUBDIVISION, according to the
Plat thereof recorded in Plat Book 5, Page 27, public records of
Palm Beach County, Florida; thence proceed southerly along the
easterly line of said Lot 11 BENSON BROS. SUBDIVISION to the
southeast corner thereof; thence proceed westerly along the south
line of said Lot 11, BENSON BROS. SUBDIVISION and the westerly
extension thereof to the existing easterly municipal boundary line
of the City of Boynton Beach, Florida; thence proceed northerly
along said boundary line to the poini of beginning, excluding
therefrom the east 150 feet of the s~uth 150 feet of the north 165
feet of said parcel.
-- SECTION 2: That subject property, upon annexation, shall be
zoned to authorize use as a Trailer Park or in the alternative, as a con-
dorniniurn or CO-operative apartment cor~plex, pursuant to the provisions
of Ordinance No. 62-9 of the City of Bosmton Beach, Florida, constituting
the r~aster zoning code of said City.
St~CTION 3: Repealing Prov~_sions._ All ordinances or parts of
Ordinances in conflict herewith are hereby repealed.
SECTION 4: ~ Should any section or provision of this
ordinance, or any portion hereof be declared by a court of co~mpetent juris-
diction to be invalid~ such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof~ other than the part declare
to be invalid.
SECTION 5: Effective Date: This Ordinance shall become effective
in the manner and at the time provided by the charter and ordinances of the
City of Boynton Beach, Florida.
