AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, DECLA~RING THE INTENTION OF SAD CITY
TO EXTEND ITS MUNICIPAL TERRITORIAL LIMITS.BY
THE ANNEXATION OF AN UNINCORPORATED-TRACT OF
LAND LYING CONTIGUOUS THERETO AND WITHIN PALM
BEACH COUNTY, FLORIDA~ .TO WIT: A PAR~CEL OF
LAND LOCATED IN SECTION 19, TOWNSHIP 45 SOUTH,
RANGE 43 EAST,-PALM BEACH COUNTY FLORIDA, MORE
PARTICULARLY DESCRIBED HEREINAFTER; PROVIDING
FOR. REPEALING AND SAVINGS CLAUSE, AN EFFECTIVE
DATE, AND OTHER PURPOSES.
WHEREAS, the owners of a certain tract of land more particularly
described hereinafter, lying adjacent and contiguous to the territorial limits
of the City of Boynton Beach, Florida, and within Palm Beach County, have
petitione¢~ the City Council for the annexation of said property by the City of
Boynton Beach, Florida; and
WHEREAS, subject tract contains less than ten registered voters;
and
WHEREAS, it is considered to be for the best interest of the CITY
BOYNTON BEACH, FLORIDA, and for the owners of subject tract that same
be annexed and included within the municipal territorial limits of the City;
NOW, THEREFORE, be it ordained by the City Council of the CITy
OF BOYNTON BEACH, FLORIDA:
SECTION 1: That the City Council of the CITY OF BOYNTON BRACt
FLORIDA, hereby declares its intention to annex the following described
tract of land to the municipal territorial limits of the City of Boynton Beach,
Florida~~ ~t the expiration of thirty days from the passage of this ordinance.
Commence at the intersection of the southerly right-of-way ~
line of Old Boynton Road West with~the west section line of
Section 20,.~ Township 45 South, Range 43 East; thence proceed
westerly along said southerly right-of-way line to a point due south
of the southeast corner of Block 10 West Boynton Plat 2C,
recorded in Plat Book 15, ~Page 14; thence proceed northerly
to the said southeast corner of said Block 10; thence proceed
northerly along the east line of Lots 19~ 18, 17 and 16, Block 10
o~ said Subdivision to ~he northeast corner thereof; thence
proceed westerly along the north line of Lots 16, 15, 14, 13 and
12, Block 10 of said Subdivision to the northwest corner of said
Lot-12; thence proceed northerly to the southwest corner of
Lot 49, Block 9 of said Subdivision and continue northerly along
the west-lines of Lots 49 and 2~ Block 9, Lots 49 and 26,
Block 8, Lots 49 and 26, Block 7, Lots 49--and 26, Block 6 of
the northwest corner of said Lot 26~ Block 6 of said subdivision;-
thence proceed northerly to the southwest corner of Lot 31,
BlockI0 West Boynton Plat 2B, recorded in Plat Book 15,
Page 13 public .records of Palm Beach County, Florida; thence
continue northerly along the west lines of Lots 31 and 8, Block
10, Lots 31 and 8, Block 9, Lois 31 and 8, Block 8, Lots 31
and 8, Block 7, and Lots 31 and 8, Block 6to the northwest
corner.of L0l 8, Block 6 of said Subdivision; thence proceed
northerly to the north right-of Sway line of the Boynton Canal;;
thence proceed easterly along the north lright~of-way line of
the Boynton Canal~to a point due north of the northwest corner
of Lot i, Block 1i of said West Boynton Plat 2B; thence proceed
southerly.lo the northwest corner of said Lot 1-, Block 11
West Boynton Plat 2B; lhence proceed southerly along the
easterly :right-of-way line of Nickels Boulevard lo the intersection
with the northerly right-of-way line of Old Boynton Road West;
thence proceed easterly along the northerly right-of-way line
of Old Boynton 1toad West to the point of intersection with the
westerly line of Section 20, Township 45 South, Range 43 East;
thence proceed southerly along said west line to the point of
be ginning.
SECTION 2:
The above property, upon annexation, shall be zoned
"ZONE 1%-2" pursuant to the provisions of Ordinance 62-9, constituting the
master zoning code of the City of Boynton Beach, Florida.
SECTION 3: All ordinances or paris of ordinances in conflict
herewith are hereby repealed.
SECTION 4: Should any section or provision of this ordinance, or
any portion hereof be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the remainder hereof as
a whole or any part hereof, other than the part declared to be invalid.
SECTION 5: This ordinance shall become effective in the manner
and at the time provided by the charier and ordinances of the City of Boynlon
Beach, Florida.
