O65-03ORDINANCE NO. 65-3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA DECLARING THE INTENTION OF SAID CITY TO EXTEND ITS MUN.ICIPAL TERRITORIAL LIMITS BY THE ANNEXATION OF AN U-NI~NCORPORATED .TRACT OF LAND LYING CONT-IGUOUS THERETO AND WITHIN PALM BEACH COUNTY, FLORIDA, TO WIT: A PARCELOF-LAND LOCATED IN SECTIONS 9 and 16, TOWNSHIP 45 SOUTH, RANGE 43 EAST., PALM BEACH COUNTY, FLORIDA, MORE PARTICULARLY DESCRIBED HEREINAFTER; PROVIDING FOR REPEALING AND SAVINGS CLAUSE, AN EFFECTIVE DATE, AND. OTHER PURPOSES. WHEREAS, the owners of a certain tract of land more particularly described hereinafter, lying adjacent and contiguous to the territorial limits of the CITY OF BOYNTON BEACH, and within Palm Beach County, Florida, have petitioned the City Council for the annexation of said property by the City of Boynton Beach; and WHEREAS, subject tract contains less than ten registered voters; and WHEREAS, it ~s considered to be for the best interest of the CITY OF BOYNTON BEACH, FLORIDA, and for the owners of subject tracl that be annexed and included within the municipal te~'ri~iorial limits of the City; NOW, THEREFORE, be it ordained by the City Council of lhe CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: Thai the City Council of the CITY OF BOYNTON BEAC., FLORIDA, hereby declares its intention to annex the following described tract of land to the municipal territorial limits of the City of Boynton Beach, Florida; at the expiration of thirty days from the passage of ordinance° Commence at the intersection of the westerly boundary of the ~at~aa~nd~ Airline Railway right-of-way and the south line of the f NWl/4 of the NWl/4 of Sectionli:6~, Township 45 South, Range 43 East, Palm Beach County, Florida; thence proceed northerly along the westerly right-of--way of the Seabo~d Airline Railway to the south~ea~t-'corner of Tract D, Lincoln Memorial Gardens, recorded in Plat Book 23, Page 179 public records of Palm Beach County, Florida; thence proceed westerly along the south line of said Tract D to the southwest corner thereof; thence proceed northerly along the west line of Tracts D, E and F of said Lincoln Memorial Gardens to the Northwest corner of said Tract F; thence continue northerly along the westerly boundary of the Seaboard Airline Railway right-of-way to the intersection of the north line of Section 9, TownshiR 45 S~outh~ .R. ange 43 East. said point being the center line of Hypoluxo ~oaa; znence proceec] ~easterly along the north line of said Section 9 to a point 190 feet west of the northeast corner of the Northwest Quarter of said Section~i thence proceed southerly a distance of 190 feet to a point; thence proceed easterly 230 feet more or less to the easterly boundary of the right-of-way of Seacrest Boulevard; thence proceed southerly along the easterly boundary of the right-of-way 'of Seacrest Boulevard to the south line of the Northeast Quarter of Section 9, Township 45 South, Range 43 East; thence proceed westerly along said south line to~ the center line of Seacrest Boulevard; thence proceed south~ly along the center line of.said Seacrest Boulevard to a point due East of a point 300 feet north of the Southeast corner of Tr2a~ No. 3, t~eserved of Palm Beach Memorial Park, recorded in Plat Book 25, Page 226 public records of Palm Beach County, Florida; then~ce proceed westerly to a point in the east line of said Tract 3, Reserved of Palm Beach Memorial Park, 300 feet north of the Southeast corner thereof; thence continue westerly 435.6 feet to a point; thence proceed southerly 300 feet to the south line of said Tract 3 Reserved of Palm Beach Memorial park; thence proceed westerly along the south line of said Tract 3, to the southwest corner thereof, being a point in the easterly right-of-way of proposed State Road No. 9; thence proceed southerly along the easterly right-of-way of proposed State Road No. 9 to the south line of the Northeast Quarter of the Northwest Quarter, Section 16, Township 45 South, Range 43 East; thence proceed wester~°~i~i~ke of be ginning, SECTION 2: The above property, upon annexation, shall be zoned as follows: The North 300 feet thereof and that portion lying west of the Seaboard Airline Railwayt~he zoned ZONE C-2; balance of property to be zoned ZONE C-I, for use as commercial cemetery and crematory, all pursuant to the provisions of Ordinance No. 62-9 constituting master zoning code of the City of Boynton Beach, Florida. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: Should any section or provision of this ordinance, or any portion hereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 5: This ordinance shall become effective in the manner and at the time provided by the charter and ordinances of the City-of Boynton Beach, Florida. -2- A.D. 1965.
