AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
DECLA-RING THE INTENTION OF SAID CITY TO EXTEND ITS
MUNICIPAL TERRITORIAL LIMITS BY THE ANNEXATION OF
AN U-NI-NCORPORATED ~TRACT OF LAND LYING CONTIGUOUS
THERETO AND WITHIN PALM BEACH COUNTY, FLORIDA,
TO WIT: LOT 38 and LOT 58, TRADE WINDS ESTATES,
ACCORDING TO THE PLAT THEREOF ON FILE IN THE
OFFICE OF THE CLERKOF THE CIRCUIT COURT IN AND
FOR~PALM BEACH COUNTY, .. FLORIDA, RECORDED IN
PLAT BOOK 21, PAGE 73; PROVIDING FOR REPEALING
AND SAVINGS CLAUSE, AN 'EFFECTIVE DATE, AND FOR
OTHER PURPOSES.
WHEREAS, the owners of a certain tract of land more particularly
described hereinafter, lying adjacent and contiguous to the territorial limits
of the City of Boynton Beach, and within Palm Beach Connty, Florida, have
petitioned the City Council for the annexation of said property by the City of
Boynton Beach, Florida; and
WHEREAS, subject tract contains less than ten registered voters;
and
WHEREAS, it is considered to be for the best interest of the City of
Boynton Beach, Florida, and for the owners of subject tract that same be
annexed and included within the municipal territorial limits of the City;
NOW~ THEREFORE, be it ordained by the City Council of the City of
Boynton Beach, Florida:
SECTION 1: Thai the City Council of the CITY OF BOYNTON BEACH
FLORIDA, hereby declares its intention to annex the following described
tract of land to the municipal territorial limits of the City o£ Boynton Beach,
Florida~ at the expiration of thirty days from the passage of this ordinance.
Lots 38 and 58, TRADE WINDS ESTATES, according to the
l~lat thereof on file in the office of the Clerk of the Circuit
Court in and for Palm Beach County, Florida, recorded in
Plat Book 21, Page 73.
SECTION 2: That subject property, upon annexation, shall be zoned
"ZONE C-I" to authorize use of subject property for bag renovation operation
pursuant to the provisions of ~mh;~'~j~i)~ Section 31-8, of Ordinance No.
62-9 of the City of Boynton Beach, Florida, constituting the master zoning
code of said City.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.: Should any section or provision of this ordinance, or
any portion hereof be declared by a court ofcompetent jurisdiction to be
invalid, such decision shall not affect the validity of the remainder hereof
as a whole or any part hereof, other than the part declared to be invalid.
SECTION 5: This ordinance shall become effective in the manner
and at the time provided by the charter and ordinances of the CITY OF
BOYNTON BEACH~ FLORIDA.
