3 A RESOLUTION OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, APPROVING AND AUTHORIZING THE MAYOR TO
5 SIGN A WAIVER OF RIGHT OF FIRST REFUSAL FOR THE
6 HOUSE BELONGING TO LATOYA MCCORMICK LOCATED AT
7 220 NE 11TH AVENUE, BOYNTON BEACH, FLORIDA 33435;
8 AND PROVIDING AN EFFECTIVE DATE.

10 WHEREAS, the house belonging to Latoya McCormick Located at 220 NE 11th
11 Avenue, Boynton Beach, Florida 33435 was purchase with the assistance of the State Housing
12 Initiatives Partnership (SHIP) Program; and
13 WHEREAS, the amount of $16,500.00 of the SHIP Program was secured by a thirty'
14 (30) year interest-free deferred loan (second mortgage and promissory note), as well as an
15 Agreement for Right of First Refusal; and
16 WHEREAS, the City has no interest in purchasing the house; therefore, the City has
17 been requested to waive the Right of First Refusal so the property can be sold; and
18 WHEREAS, any funds that the City receives as a result of the sale would be deposited
19 into the SHIP fund and used for future housing related projects/programs; and
20 WHEREAS, the City Commission of the City of Boynton Beach, Florida, upon the
21 recommendation of staff, deems it to be in the best interests of the City residents to approve
22 and authorize the Mayor to sign a Waiver of Right of First Refusal for the house belonging to
23 Latoya McCormick Located at 220 NE 11th Avenue, Boynton Beach, Florida 33435.
24 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
25 BOYNTON BEACH, FLORIDA, THAT:
26 Section 1. The foregoing "WHEREAS" clauses are true and correct and hereby
27 ratified and confirmed by the City Commission
28 Section 2. That the City Commission of the City of Boynton Beach does hereby
29 approve and authorize the Mayor to sign a Waiver of Right of First Refusal for the house
30 belonging to Latoya McCormick Located at 220 NE 11th Avenue, Boynton Beach, Florida
31 33435.

33 Section 3. That this Resolution will become effective immediately upon passage.

WAIVER OF RIGHT OF FIRST REFUSAL
The CITY OF BOYNTON BEACH, FLORIDA (the "CITY"), a Florida municipal corporation,
being the owner, holder and beneficiary of a right of first refusal on any sale or
• resale or transfer of the real property located at 220 NE 11' Avenue, Boynton Beach, FL
33435, hereby acknowledges that it has been offered the following described land
pursuant to its right of first refusal, on the following basic terms, and the CITY hereby
waives its right to exercise such right of first refusal on the following described
transaction.
