O64-17ORDINANCE NO. 64 - 17 AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 23A OF THE CODIFIED ORDINANCES OF SAID CITY (OTHERWISE DESCRIBED AS ORDINANCE NO 59-6) ESTABLISHING RATES, FEES AND OTHER CHARGES FOR THE USE OF THE SERVICES AND FACILITIES OF THE MUNICIPAL SEV~ DISPOSAL SYSTEM AND FOR OTHER PURPOSES. Preamble. This ordinance is deemed_to be an emergency measure enacted for the immediate protection of the health, safety and welfare of the citizens oi the CITY OF BOYNTON BEACH, FLORIDA, for the daily operation of lhe Municipal sewer system and the City Finance Department, in order to provide sufficient income to operate and maintain said sewer system. It is further determined as a fact, based upon the report of the City's Consulting Engineers RUSSELL & AXON, that the rate changes or revisions set forth in this ord- inance are substantially pro rata as to all classes of service. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: That Section 23~A~.-3 of the codified ordinances of the CITY OF BOYNTON BEACH, FLORIDA (otherwise described as SECTION] of Ordinance 59-6) is hereby amended to read: "Section 1. The rsVp:es, fees ar~d charges (herein~sometimes called the "Sewer Service Charge") for the use of, and for the services and facilities furnished or to be furnished by, the sewage disposal SYStem, to be paid by the owner, tenant, or occupant of each lot or parcel of land which may be connected with or may use the sewage disposal system by or through any part of the sewer system of the City, shall be based or computed upon the number and kind of plumbing fixtures connec'~_ with the sewer system or upon the quantity of the water supplied therein, as indicated in the following rate schedule: next and over Residential Customers (Each dwelling unit) 5 fixtures or less - $ 4. 00 per month minimum 7 fixtures - $ 0.35 each per month 12 fixtures - $ 0.20 each per month next and over Commercial Customers (Excluding restaurants, laundries, hospitals, nursing homes and instit- u~_io_n_al_ ~_y_p e buildings) (Each establishment) 2 fixtures or less $4.00 8 fixtures $ 0.50 10 fi~nres $ 0.20 per month minimum each per month each per month next next next all over Industrial and Manufacturing Customers, (Including restaurants, laundries, hospitals.~ nursing homes and institutional_type buildings) (E ach e siablishmenz) 0 -- 3, 000 gallons 2, 000 gallons 20,000 gallons 10,000 gallons 35,000 gallons $ 5. 75 per month minimum $0.40 per thousand per month $0.30 per thousand per month $0.25 per thousand per month $0.20 per thousand per month In addition to the rates set forth herein, the City Council reserves the right to require pre-treatment, special rates or other measures necessary to cope with ahd protect the City against the introduction of unusual types of waste in the City sewer system. SECTION 2: Separability. Each of the provisions of this ordinance are separable, including word, clause, phrase, or sentence, and if any provision hereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. SECTION 3: Repealing Provisions: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: Effective Date: This ordinance is deemed ~.o be ar~ emergency measure and shall take effect immediately upon passage. -2- 1964. First reading and adoption this 25th day of September, A.
