BOYNTON BEACH, FLORIDA, PROVIDING FOR
THE APPOINTMENT OF TWO ADDITIONAL
MEMBERS TO THE MUNICIPAL LIBRARY BOARD
OF THE S~AtD CITY; FURTHER PROVIDING FOR
THE AUTHORITY TO CODIFy~A SAVINGS CLAUSE,
AN EFFECTIVE DATE AND FOR OTHER PURPOSES.
PREAMBLE
THIS ORDINANCE IS DEEMED TO BE AN EMERGENCY
ORDINANCE ENACTED FOR THE PRESERVATION OF
THE PUBLIC PEACE, PROPERTY, HEALTh'AND
SAFETY OF THE INHABITANTS OF THE CI~±~Y OF
BOYNTON BEACH, FLORIDA, AND FOR THE EFFI-
CIENT DAILY OPERATION OF THE ADMINISTRATIVE
DEPARTMENTS OF THE CITY OF BOYNTON BEACH,
FLORIDA.
NOW THEREFORE, be it ordained by the City Council of the
City of Boynton Beach, Florida:
Section 1: Section 2-31 of the Codified Ordinances of the City
of Boyn~on Beach, Florida, be and ~he same is hereby amended to read:
Section 2-31.' Creation; membership; ~erms. There is hereby
established a library board hereinafter referred to as "board." The board
shall consis~ of five (5) members who shall be appointed by the City Council.
Ail members of ~he board initially appointed shall serve un~il 2he da~e of ~he
first meeting of ~he City Council in January, 1962, on which date ~hree (3)
members of the board shall be appointed for a term of ~wo (2) years and ~he
remaining two (2) members shall be appointed for a ~erm of one (1) year.
Thereafter, members shall be appointed for a term of two (2) years, or until
~heir successors have been appointed and qualified. In the case of vacancy by
resignation, removal or o~herwise, the City CounCil shall fill such vacancy
for the unexpired term.
In the event the City Council deems it in ~he bes~ interest of the
City and to the more efficien~ accomplishmen~ of the purposes of the Library
Board, i~ may appoint ~wo additional members to said board to serve, wi~h
similar duties and powers as regular board members. Such additional membe:
shall serve the pleasure of the City Council; however their terms shall not
exceed a period of one (1) year from the date of their appointment. No such
specially appointed members shall be disqualified from appointment to a
regular membership on the board upon expiration of their appointed terms.
the event the City Council does appoint two additional members of the board,
members of the enti~e board shall constitute a quorum rather than as [
for in Section 2-33 hereinafter.
Section 2: Repealing Provisions. All ordinances or parts of
ordinances in conflict~herewith are hereby repealed.
Section 3: Separability. If any section, sub-section, clause,
phrase or portion of this ordinance is for any reason held invalid or un-
constitutional by any court of competent jurisdiction, such portion shall be
deemed a separate distinct and independent provision and such holding shall
not affect the validity of the remaining provisions thereof.
Section 4: Authority to Codify. Specific authority is hereby
granted to codify this ordinance.
Section 5. Effective Date. This ordinance is deemed to be an
emergency measure and shall take effect immediately upon passage.
