AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
DECLARING THE INTENTION OF SAID CITY TO EXTEND ITS
MUNICIPAL TERRITORIAL LIMITS BY THE ANNEXATION OF AN
UNINCORPORATED TRACT .OF LAND LYING CONTIGUOUS THERETO
AND WITHIN PALM BEACH COUNTY, FLORIDA, TO WIT: LOT A;
LOTS B AND C, .LESS ROAD RIGHT-OF-WAY, AND LOTS D AND E,
ALL IN BLOCK 1-; LOT A; LOTS B AND C, LESS ROAD RIGHT-OF-
WAY, AND LOTS D AND E., ALL IN BLOCK 2; LOTS A~' B~ C~ D;
AND LO~. Ji~,- LESS-THE-SOUTH 80 FEET THEREOF, ALL IN BLOCK
31; LOTS A, B~ C, D; LOT~E, LESS THE SOUTH 80 FEET THEREOF,
ALL IN BLOCK 32; ALL OF SAID PROPERTY BEING LOCATED IN
PALM BEACH I~ARMS COMPANY PLAT #8, RECORDED IN PLAT
BOOK 5, PAGE 73 PUBLIC RECORDS OF PALM BEACH COUNTY
'FLORIDA; PROVIDING FOR REPEALING AND SAVINGS CLAUSE,
EFFECTIVE DATE, AND OTHER PURPOSES.
WHEREAS, the owners of a certain tract of land more particularly
described hereinafter, lying adjacent and contiguous to the territorial limits
of the City of Boynton Beach, and within Palm Beach County, Florida, have
petitione~d the City Council for the annexation of said property by the City of
Boynton Beach; and
WHEREAS, subject tract contains less than ten registered voters;
and
WHEREAS, it is considered to be for the best interest of lhe City
of Boynton Beach, Florida, and for the owners of subject tract that same be
annexed and included within the municipal territorial limits of the City;
NOW, THEREFORE, be it ordained by the City Council of the City
of Boynton Beach, Florida:
SECTION 1: That the City Council of the CITY OF BOYNTON
BEACH, FLORIDA, hereby declares its intention to annex the following des-
cribed tract of land to the municipal territorial limits of the City of Boynton
Beach, Florida:
Lot A; Lots B and C~ less road right-of-way; and Lots D and E,
all in Block 1; Lot A; Lots B and C, less road right-of-way;
and Lots D andE, all in Block 2; Lots A~. B~ C, D; and Lot E,
less the South 80 feet thereof, all in Block 31; Lots A~ Bt C~ D;
and Lot~, less the South 80 feet thereof, all in Block 32; ALL
of said property being located in Palm Beach Farms Company
Plat #8, recorded in Plat Book 5, Page 73 public .records of
Palm Beach County, Florida.
SECTION 2: That subject property upon annexation shall be
zoned '"Zone M-I", pursuant to the master zoning code of the CITY OF
BOYNTON BEACH, FLORIDA.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4: Should any section or provision of this Ordinance, or
any portion hereof be a~clared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the remainder hereof
as a whole or any part hereof, other than the part declared to be invalid.
SECTION 5: Specific authority is hereby granted to codify and
incorporate this ordinance in the City's existing code.
SECTION 6: This ordinance shall become effective in the manner
and at the time provided by the charter and ordinances of the CITY OF
BOYNTON BEACH, FLORIDA.
