AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
DECLARING THE INTENTION OF~ SAID CITY TO EXTEND ITS~
MUNICIPAL TERRITORIAL LIMITS BY THE ANNEXATION OF AN
UNINCORPORATED TRACT-OF LAND LYING CONTIGUOUS T-HERETO
AND WITHIN PALM BEACH COUNTY, FLORIDA, TO WIT:_ LOT 37,
AMENDED PLAT OF TRADE WINDS ES.TATE~ RE. PEALING ALL
ORDINANCES IN CONFLICT THEREWITH:. PROViDiNG FOR A
SAVINGS CLAUSE, AUTHORITY TO _CODIFY, AN EFFECTIVE
DATE AND FOR OTHER PURPOSES.
WHEREAS, the owners of a certain tract of land more, particu-
larly described hereinafter, lying adjacent and contiguous to the territorial
limits of the City of Boynton Beach, and within Palm Beach County, Florida
have petitioned the City Council for the annexation of said property by the
City of Boynton Beach; and
WHEREAS, subject tract contains less than ten registered
voters; and
WHEREAS, it is considered to be for the best interest of the
City of Boynlon Beach, Florida, and for the owners and inhabitants of sub'
tract that same be annexed and included within the municipal territorial
limits of the City;
NOW, THEREFORE,
City of Boynton Beach, Florida:
be it ordained by the City Council of the
SECTION 1: Thai the City Council of the CITY OF BOYNTON
BEACH, FLORIDA, hereby declares its intention to annex the following
described tract of land to the municipal teri'itorial limits of theCity of
Boynton Beach, Florida:
Lot 37, AMENDED PLAT OF TRADE WINDS ~S~ATES,
a subdivision in Palm Beach. County, Flori ,
to the Plat thereof m~ ~ ~.,_ ..... da,. according
on ~= =. ~e o~ce~ of the Clerk of the
Circuit Court in and for Palm Beach County, Florida,
recorded in Plat Book 21, Page 73.
SECTION 2: That subject property, upon annexation, shall be
zoned "ZONE C-i" pursuant to the master zoning code of the Cily of Boynton
Beach, to allow and authorize operation of a rabbit farm thereon, as a con-
ditional use, pursuant to the provisions of sub-paragraph 3I, of Paragraph A,
Section 8 of Ordinance No. 62-9 of the City of Boynton Beach, Florida.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4: Should any section or provision of this ordinance,
or any portion hereof be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the remainder hereof as
a whole or any part hereof, other than the part declared to be invalid.
SECTION 5: Special authority, is hereby granted to codify and
incorporate this ordinance in the City's existing code.
SECTION 6: This ordinance shall become effeotive in the manne
and at the time provided by the charter and ordinances of the City of Boynton
Beach, Florida.
