O63-29ORDINANCE NO. 63-29 AN ORDINANCE OF THE CITY OF BOYNTON BEACI~ FLORIDA AMENDING PROVISIONS OF CHAPTER 20 OF THE CODIFIED ORDINANCES OF SAID CITY ]~Y DEFINING THE 'TERM TRAILER; PROHIBITING THE PARKIN(), MAINTAINING OR STORING OF ANY TRAILE]{ WHICH IS COMMONLY USED FOR LIVING OR SLEI,PING" PURPOSES, WHETHER THE sAME BE SO U ED OR NOT, UPON ANY LOT, PIECE OR PARCEL OF lAND IN THE CITY OF BOYNTON BEACH,~ EXCEPt[ REGULARLY LICENSED TRAILER SAL~S OR PAR]ES AS DEFINED By ORDINANCES OF BOYNTON BEACH ~kND WHERE SUCH TRAILER IS KEPT WITHIN A CLOSt]D BUILDING AND NOT ~'D FOR LIVIN~ OR SLEt]PING PURPOSES AND EXCEPT WHER~ ~HE OWNER OR LICENSED DEALER OF SUCH TRAILERS SUC IS PER1 [TTED AND LICENSED IN COmmERCIAL ZONES ~NDER THE ORDINANCES OF BOYNTON BEACH, AND WHERE SUCH TRAILERS ARE USED AS TEMPORARY CONSTRUCTION OFFICES PURSUANT TO PERMIT ISSUED THEREFORE; REPEALING SECTIO~ 30-5 OF SAID CODE; F~RTHER PROVIDING A PENALTY FOR VIOLATION THEREOF; A SAVING CLAUSE, AND AN EFFECTIVE DATE, PREAMBLE WHEREAS~ IT HAS BEEN FOUND AND DETERMINED BY THE CiTY COUNCIL OF THE CITY OF BOYNTON BEACH THAT TRAILERS, COMMONLY USED FOR LIVING AND SLEEPING PURPOSES, I~t~VE BEEN PARKED, MAINTAINED OR STORED UPON LOTS, PIECES, AND PARCELS OF LAND WITHIN THE CITY ~IMITS OF THE CITY OF BOYNTON BEACH, AND THAT SAID VEHICLES HAVE BEEN REGULARLY OR INTERMITTENTL USED FOR LIVING OR SLEEPING PURPOSES, AND WHEN NOT SO USED THE PRESENCE OF SUCH VEHICLES GREATLY REDUCES T~E VALUE OF THE PROPERTIES ABUTTING THE LOCATION OF SUCH VEHICLES1 AND IN GENERAL INJURES AND JEOPARDIZES THE HEALTH AND GENERAL WELFARE OF THE CITIZENS OF THE CITY OF BOYNTON BEACH. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. That subsection(e)ofSection 30-1 ofthe Codified Ordinances of the CITY OF BOYNTON BEACH~ FLORIDA, be and the same is hereby amended to read: (e) The phrase trailer, motor trailer, automobile trailer or house car as used in this Ordinance shall be defined as follows: Any of the various types of vehicles wit power or designed to be towed by an automobile, other ve~icle~ and adapted to human habitation e: for the purpose of sleeping or eating or the prep of meals, or both, or designed or adapted to use office or for the purpose of carrying on business h motor or :her ration as an Section~. Section 30-5 of the Codified Ordinances of the CITY O~ BOYNTON B ACH, FLORIDA, is hereby repealed in it entirety. Section4. Penalty: Any person, firm or corporation convicted of violation of this Ordinance shall be punished by fine not exceeding Five Hundre~ ($500.00) Dollars or by imprisonment in the City jail for a period not exceeding ninety (90) days or both such fine and imprisonment. Each day on which the violation exists or continues shall bedeemed a separate offense. Section 5. Separability: If any part of this ordinance shall be deemed unlawful by~ court of competent jurisdiction~ such portion shall be deemed a separate part hereof and such ruling shall not affect the validity of the remainder hereof. Section_6. Repealing Provisions: Ail ordinances or parts of ordinances in conflict ~ierew~th a~e ~er~by r~pealed. Section 7.
