O63-24©,R,I)INAiNCE No. 63-~ AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, LEVYING SPECIAL ASSESSMENTS AGAINST PROPERTY~ BENEFITED BY A CERTAIN STREET IMPROYE- MENT PROJECT WITHIN SAID CITY, TO WIT: THAT PORTION OF S.E. 1S~f AVENUE LYING BETWEEN U. S. HIGHWAY No. 1 and S.E. 6TH STREET, and THAT PORTION OF S.E. 2ND AVENUE, LYING BETWEEN U. S.' HIGHWAY NO. 1 AND S.E. 6TH STREET, AND THAT PORTION OF S.E. 6TH STREET, LYING BETWEEN S.E. 2ND AVENUE AND OCEAN AVENUE; RECITING BY WHAT METHOD SAID SPECIAL ASSESSMENT IS MADE AND THE TIME WHEN SAID SPECIAL ASSESSMENT SHALL.~BECOME PAYABLE; PROVIDING FOR THE METHOD OF COLLECTION THEREOF, AND FOR OTHER PURPOSES. WHEREAS, pursuan~ to the provisions of Section 160 of the charter of the CITY OF BOYNTON BEACH, FLORIDA, the City has'hereto- fore caused a certain public street to be constructed over the property more particularly described as follows: That portion of S. E.~ 1st Avenue, lying between U. S. Highway No. 1 and S.'E. 6th Street, and that portion of S. E. 2nd Avenue, between U.'S. Highway No. 1 and S.E. 6th Street, and that of S.'E. 6th Street, lying between S.E. 2nd Avenue and Ocean Avenue, within the City of Boynton Beach, Florida; and WHEREAS, the City Clerk has heretofore compiled an assess- ment roll showing the lots and land assessed to pay the cost thereof in connec. tion with subject improvement and the amount of assessment as to each such lot or land, which said roll has heretofore been approved by the City Council; and WHEREAS, proper legal notice of the approval of said roll has been given and a public hearing held relative thereto, at which time no objections were made or if objections were made, same were deemed insuffi- cient by the City Council; NOW, THEREFORE, be it ordained by the City Council of the CITY OF BOYNTON BEACH, FLORIDA: 1. Thai the special assessment roll covering the above- described project, a true copy of which is attached hereto and hereby made a LAWNS SUBDIVISION part hereof, is hereby ratified, approved and confirmed, and the amounts indicated for each lot or parcel described therein are hereby levied against same as a special improvement assessment and same shall constitute liens against said land as of the effective date of this ordinance, each of said parcels along subject improvement having been assessed on a front footage basis, charging each parcel its proportionate share by dividing its respectiv front footage into the total improvement cost. Section 2: Each property owner shall have the privilege of paying the entire assessment as to his property within 90 days from the attachment of said improvement lien without penalty. If any owner fails to pay said lien within said 90 day period, it shall be paid in three equal install- ments, payable as other ad valorem taxes are paid, with interest at the rate of 8% per annum from the date of attachment of said lien on the unpaid balanc~ the re of. Section 3: Separability. If any part of this ordinance shall be deemed unlawful by a court of competent jurisdiction, such portion shall be deemed a separate and distinct part hereof and such ruling shall not affect the validity of the remainder hereof. Section 4: Repealing Provisions. All ordinances or parts of in conflict herewith are hereby rep~leld. Section 5: Effective Date.
