AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, RELATING TO ASSAULT U-PON POLICE
OFFICERS AND ESCAPE FROM CUSTODY BY PERSONS
UNDER ARREST OR IN LEGAL CUS.TOIIY; PROVIDING .FOR
PENALTY UPON CONVICTION OF SUCH OFFENSE, PRO-
VIDING AN EFFECTIVE DATE.
PREAMBLE
This ordinance is deemed to be an emergency measure enacted
for the immediate preservation of the public peace, property,
health or safety of the inhabitants of the City of Boynton Beach,
Florida, and for the effective daily operation of the municipal
police department
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
SECTION 1: It shall be unlawful for any person to resist,
obstruct, or oppose any policeman, police officer, detective, or other
officer of the City in the making of any arrest, or after having been lawfully
taken into custody by any such officer, or in the service or execution of any
process, or in the lawful execution of any legal duty, by offering or doing
violence to the person or such policeman, police officer, detective or other
officer.
SE CTION 2:

officer, detective or other officer of the City, or any person while in the
city jail or while a prisoner working out a sentence on the streets or on
public works of the city under guard,

SECTION 3: Any person convicted of a violatiOn of this
ordinance shall be punished by a fine not to exceed $500. 00 or by imprison-
ment in the city jail for a period not to exceed ninety (90) days, or by both
such fine and imprisonment.
SECTION 4: Authority to Codify.
Specific authority is hereby granted to codify and incorporate
this ordinance in the City's existing code.
SECTION 5: Separability.
Each of the provisions of this ordinance are separable, including
word, clause, phrase, or sentence, and if any provision hereof shall be
declared invalid, the remaining portion shall not be affected but shall
in full force and effect.
SECTION 6: Repealing Provisions.
Ail ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION 7: Effective Date.
This ordinance is deemed to be an emergency measure and shall
take effect immediately upon passage.
