AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA,AMENDING CHAPTER 23 OF THE
CODIFIED ORDINANCES OF SAID CITY: PROVIDING FOR
THE CREATION OF AN AUXILIA-RY POLICE FORCE IN
THE MUNICIPAL POLICE DEPARTMENT AND SETTING
FORTH THE POWERS AND.-DUTIES OF SAID AUXILIARY
OFFICERS; FURTHER PROVIDING AUTHORITY TO CODIFY,
REPEALING PROVISIONS, AN EFFECTIVE DATE, AND
FOR OTHER PURPOSES.
PREAMBLE
WHEREAS, pursuant to the provisions of Section 7 (15) of the
existing Charter of the CITY OF BOYNTON BEACH~ the City Council of
said City is vested with the power to establish a department or division
of police; and
WHEREAS, pursuant further to the provisions of Section 23 of
the Charter of the CITY OF BOYNTON BEACH, FLORIDA, the City Council
is empowered to create such offices and appoint such additional officers and
employees as may in their judgment be necessary for the government of said
City; and
WHEREAS, it is deemed essential that a force of properly trained
reserve officers be available to assist regular municipal police department
personnel in case of emergency;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
CITY OF BOYNTON BEACH, FLORIDA:
SECTION 1: Thai Chapter 23 of the codified ordinances of the
CITY OF BOYNTON BEACH, FLORIDA be and the same is hereby amended
by adding after Section 23-7 thereof, .an additional Article to be designated
ARTICLE II, to read:
ARTICLE II. Auxiliary Police Force.
Sec. 23-8. In order to provide for the public safety in time of
emergency, there is hereby created and established a Auxiliary Police Forc~
for the City. The Auxiliary Police Force shall be under the direct supervisi,
and control of the Chief of Police.
Sec. 23-9. Applications for membership; qualifications;
investigation and examination of applicants.
Applications for membership in the Auxiliary Police Force shall
be made to the Chief of Police of the City. The applicant shall have such
qualifications and stand such examinations as to their physical and mental
fitness as may be prescribed from time to time by the Chief of Police.
The Police Chief shall also investigate the character and reputation of
applicants for membership in the Auxiliary Police Force. The Chief of
Police is hereby authorized, empowered and directed to appoint Auxiliary
Police Officers to serve in the Auxiliary Police Force of the City, subject
only to approval by the City Council as to ~he total number of such officers
so appointed.
Sec. 23-10. Oath.
Before entering upon his duties as an Auxiliary Police Officer
of the City, each officer~Shall make oath before the City Clerk that he will
uphold and defend the Constitution of the United States and of the State of
Florida, and that he will enforce the ordinances of the City, and all lawful
Orders, rules or regulations promulgated under authority of the Charter and
Ordinances of the City.
Sec. 23-11. Training and active duty.
Auxiliary Police Officers may be called, from time to time, by
the Chief of Police for training in service with the regularly employed Police
Officers of the City. They shall also be subject to c'all for active duty at
such times and places as the Ch'~elf of Police may deem necessary in order
to fully protect life and property. Ail Auxiliary Policemen on training or
active duty shall serve in the capacity of Patrolmen unless otherwise designa
ted by competent authority.
Sec. 23-12. Powers and duties.
While on active duty, under the orders of the Chief of Police or
other duly designated officer in charge of the Municipal Police Department,
Auxiliary Police Officers shall constitute Special Police Officers of the City
and shall be vested with all of the powers and perform all of the duties and
functions as regular members of the police force, including powers of arrest
Sec. 23-13. Uniforms and insignia; compensation.
When called for training in service, or for active duty, Auxiliary
Police Officers are her~b~y required to wear such identifying uniform._ and
~nsignia and utilize such equipment as may be provided from time to time
by the Chief of Police. It shall be unlawful for any reserve police officer
to wear such identifying uniform and insignia, or utilize such equipment,
except while on duty. Auxiliary Policemen shall serve without compensa-
tion.
Sec. 23-14. Auxiliary Police Officers shall be deemed and
considered, while on active duty, or training in service, as part time
employees of the City and not members of the civil service of the City, nor
of the Police Department of the City entitled to benefits under
the police pension and relief fund provisions.
SECTION 2: Separability. Each of the provisions of this ordin-
ance are separable including word, clause, phrase or sentence, and if any
provision hereof shall be declared invalid, the remaining portion shall not be
affected but shall remain in full force and effect.
SECTION 3. Repealing Provisions. Ail ordinances or parts of
ordinances in conflict herewith are hereby repealed.
SECTION 4. AUTHORITY TO CODIFY. Specific authority is
hereby granted to codify and incorporate this ordinance in the City's existing
code.
SECTION 5. Effective Date. This ordinance is deemed to be an
emergency measure and shall become effective immediately upon passage.
